RESOLUTION NO. 12 -046
A RESOLUTION GRANTING A CONDITIONAL USE PERMIT
FOR A DYNAMIC DISPLAY SIGN TO OUR SAVIOR'S LUTHERAN CHURCH
WHEREAS, Our Savior's Lutheran Church (Applicant) is the owner of the real property
located at 23290 State Highway 7 (the Subject Property) in the City of Shorewood, County of
Hennepin, State of Minnesota; legally described in Exhibit A, attached hereto and made a part
hereof; and
WHEREAS, the Applicant has submitted plans for a dynamic display sign to be located
on the above - referenced property; and
WHEREAS, the Applicant has applied for a conditional use permit, pursuant to Section
1201.03 Subd. 1 l .g. of the Shorewood City Code, to install a dynamic display sign on the above -
referenced property; and
WHEREAS, the Applicant's request was reviewed by the City Planner, and his
recommendations were duly set forth in a memorandum to the Planning Commission and City
Council, dated 27 June 2012, which memorandum is on file at City Hall; and
WHEREAS, after required notice, a public hearing was held and the application was
reviewed by the Planning Commission at its regular meeting on 3 July 2012, the minutes of
which meeting are on file at City Hall; and
WHEREAS, the Applicant's request for conditional use permit was considered by the
City Council at its regular meeting on 23 July 2012, at which time the Planner's memorandum
and the minutes of the Planning Commission were reviewed and comments were heard by the
Council from the City staff.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Shorewood as follows:
FINDINGS OF FACT
L The Subject Property is located in a R -1 C, Single- Family Residential zoning
district.
2. The City Zoning Code allows dynamic display signs for certain conditional uses
in residential zoning districts.
3. The proposed sign is limited to an alpha - numeric display and measures 2.67 feet
by 6.25 feet and contains 16.7 square feet of area.
4. The Applicant has submitted a certification letter confirming that the various
brightness levels and software controls required by the Zoning Code are being complied with.
5. The Applicant has submitted aphotometric plan illustrating that light levels are
below the .4 foot - candle maximum provided by the Zoning Code.
CONCLUSIONS
1. That based upon the foregoing, the City Council hereby grants the Applicant's
request for a conditional use permit subject to the following:
a. All signs on the property shall comply with the Applicant's application and with
the requirements of Shorewood' s Zoning Code, as may be amended.
b. Controls for the sign must be set so that the message remains static for at least 90
minutes at a time and programmed to remain static between the hours of 10:00 P.M. and 6:00
A.M.
2. The City Clerk is hereby authorized and directed to provide a certified copy of
this Resolution for filing with the Hennepin County Recorder or Registrar of Titles.
