12-056CITY OF SHOREWOOD RESOLUTION NO. 12 -056 A RESOLUTION GRANTING PRELIMINARY PLAT APPROVAL FOR ASHLAND WOODS WHEREAS, Ashland Woods, LLC (Applicant) has an interest in certain lands within the City of Shorewood and has applied to the Council for preliminary plat approval of a plat to be known as Ashland Woods; and WHEREAS, the Applicant's request has been reviewed by the City Planner and the City Engineer and their recommendations have been duly set forth in a memorandum to the Planning Commission, dated 31 July 2012, which memorandum is on file at City Hall; and WHEREAS, a Public Hearing was held by the Shorewood Planning Commission on 7 August 2012, for which notice was duly published and all adjacent property owners duly notified. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Shorewood as follows: 1. That the Applicant's request for preliminary plat approval of Ashland Woods is hereby approved. 2. That such approval is subject to the following conditions: a. Plans for streets, utilities, grading, drainage and erosion control are subject to the recommendations of the City Engineer. b. The final plat submission must include the documents establishing a homeowner's association and protective covenants providing for maintenance of the drainage facilities on the property. c. Prior to final plat release, the developer must pay $7200 in local sanitary sewer access charges. d. Prior to final plat release, the developer must pay $70,000 in water connection charges. Upon completion of the improvements, expenses for water main will be refunded, not to exceed $10,000 per lot. e. Prior to release of the final plat, the developer must pay $30,000 in park dedication fees. f. The developer must submit a final tree preservation and reforestation plan, prepared by a registered landscape architect or forester. The plan shall include saw - cutting of the roots of significant trees along the southerly border of the property. g. Lot 1 shall get a sanitary stub or a notification to use the existing service on Strawberry Lane. h. The yard drain located near 6075 Strawberry Lane can not connect to the drain tile located along Strawberry Lane. The existing drain the is for groundwater management only (household sump pumps are only allowed to connect to this line). A majority of the storm water solution hinges on Lot 5, precautions need to be taken to educate homeowners in perpetuity that any alteration of the Swale will impact at least a dozen homeowners. A conservation easement over the storm water solution, a requirement for a dry rock riverbed or approved alternate and a storm water maintenance plan to include a minimum of annual topography verification reports are some methods to assure the storm water solution works in perpetuity. As part of the submission of the final plat, the developer shall submit a storm water maintenance agreement, identify the responsible entity for entering into the maintenance agreement, and a mechanism for establishing a storm water maintenance fund to the Planning Commission for review and recommendation to the City Council.
