15-031CITY OF SHOREWOOD RESOLUTION NO. 1.5 -031 A RESOLUTION ADOPTING A TREE REPLACEMENT POLICY FOR CITY TRAIL /SIDEWALK PROJECTS WHEREAS, the City of Shorewood (City) has adopted a Tree Preservation and Replacement Policy (the Policy) for the purpose of protecting natural vegetation in new developments and construction sites; and WHEREAS, the Policy does not require the City to replace trees lost to public improvement projects; and WHEREAS, the City has undertaken a program of building trails /sidewalks in the community, which frequently results in loss of trees within the public rights -of -way; and WHEREAS, the City values and wishes to preserve the tree -lined appearance of various streets within the community; NOW, THEREFORE, BE IT RESOLVED that the Shorewood City Council hereby approves the following tree replacement policy: A. In instances where trail /sidewalk construction projects result in loss of significant trees or significant clusters of vegetation (at the discretion of the City Council), as defined in the Policy, the City shall offer abutting property owners replacement trees as follows: If the property owner wishes to plant the trees, it will be offered two, two -inch caliper, deciduous trees, or two, four -foot high, coniferous trees from a list of available trees provided by the City. Under this option, the owner is responsible for initial and ongoing care and maintenance of the trees. 2. If the property owner prefers planted trees, the City will plant one, two -inch caliper, deciduous tree, or one, four -foot high, coniferous tree from a list of available trees provided by the City. Under this option, initial care and maintenance will be done by the City's tree vendor. Ongoing care and maintenance of the trees will be the responsibility of the property owner. All replacement trees must be planted outside the public right -of -way or easement areas, but no farther away than 20 feet from such right -of -way or easement. B. In instances where the City must acquire public right -of -way or easements, replacement trees may be provided as part of the financial compensation negotiated through the acquisition process.
