RESOLUTION NO. 15 -039
A RESOLUTION GRANTING A SETBACK VARIANCE
TO IAN AND CAROL FRIENDLY
WHEREAS, Ian and Carol Friendly (Applicants) are the owners of real property
located at 5590 Shore Road, in the City of Shorewood, legally described on Exhibit A, attached
hereto and made a part hereof; and
WHEREAS, the Applicants have an existing single - family dwelling with a detached
garage, which are nonconforming with respect to front, rear and Lakeshore setback requirements;
and
WHEREAS, the Applicants propose to replace the existing home and garage with a new
house and a three -car, attached garage, which necessitates a rear yard setback variance; and
WHEREAS, the Applicants' request was reviewed by the City Planner, whose
recommendations are included in a memorandum, dated 30 April 2015, a copy of which is on file
at City Hall; and
WHEREAS, after required notice a public hearing was held and the application reviewed
by the Planning Commission at a regular meeting held on 5 May 2015, the minutes of which
meeting are on file at City Hall; and
WHEREAS, the City Council considered the application at its regular meeting on 26
May 2015, at which time the Planner's memorandum and the Planning Commission's
recommendations were reviewed and comments were heard by the Council from the Applicant
and from the City staff, and
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Shorewood as follows:
FINDINGS OF FACT
1. The subject property is located in an R -1C /S, Single - Family
Residential /Shoreland zoning district, which requires a 40 -foot setback from the rear lot line and
a 23 -foot setback from the front lot line (due to the average setbacks of adjoining properties).
2. The subject property contains 33,079 square feet of area and is occupied by an
existing home that does not comply with front, rear or lakeshore setback requirements and
exceeds the amount of hardcover allowed on a lakeshore lot.
3. Shore Road extends up to the westerly side of the lot, resulting in the easterly side
of the lot being a rear yard by definition. In addition, a sanitary sewer easement extends through
the applicants' property, further diminishing the buildable area of the lot.
4. The owners of the property propose to build a new home with an attached three -
car garage which will comply with all required setbacks except for the rear yard setback, for
which they have requested a 30 -foot variance. Design of the home and site will result in
compliance with the 25 percent maximum hardcover requirement for lakeshore properties.
CONCLUSIONS
A. The Applicant has satisfied the criteria for the grant of a variance under the
Shorewood City Code and has established practical difficulties as defined by Minnesota Statutes.
B. Based upon the foregoing, the City Council hereby grants to the Applicant a
setback variance to build a new home 10 feet from the rear lot line.
C. The City Clerk is hereby authorized and directed to provide a certified copy of this
resolution for filing with the Hennepin County Recorder or Registrar of Titles.
