STAGE APPROVAL FOR THE LAWTONKA VILLAS P.U.D. WHEREAS, Greenwood Design Build, LLC. (Applicant) has requested a Concept and Development Stage Plan for a residential Planned Unit Development (P.U.D.) to be known as Lawtonka Villas on property legally described as: Lot 6, Block 1, Lawtonka, City of Shorewood, Hennepin County, Minnesota; and WHEREAS, the Applicant's request dated September 24, October 29, and November 26, 2018 and January 9, 2019 was reviewed by the Planning Director, whose memo was forwarded to the Planning Commission for their meeting on December 4, 2018, a copy of the memo is on file at the Shorewood City Hall; and WHEREAS, the application was considered by the Planning Commission at a regular meeting held on December 4, 2018, the minutes of which meeting are on file at City Hall; and WHEREAS, the City Council considered the application at its regular meeting on January 28, 2019, at which time the Planning Director's memorandum and the Planning Commission's recommendations were reviewed and comments were heard by the Council from the Applicant and from the City staff. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SHOREWOOD, MINNESOTA AS FOLLOWS: The Applicant's request for Concept and Development Stage Plan for Lawtonka Villas PUD is hereby approved according to the plans submitted September 24, 2018 and January 9, 2019, subject to the following conditions: a. The PUD shall consist of two single - family homes and the allowed accessory uses listed in the R -1 B zoning district. b. All structures in the PUD shall meet the following setbacks and height restrictions, subject to the definitions in City Code: 1) Front property line: 30 feet 2) North property line of Parcel A and east property line of Parcel B: 10 feet 3) Shared property line: 5 feet 4) Rear: 40 feet 5) Wetland Buffer: 15 feet 6) Height: 30 feet, which shall include no more than one story over a walkout basement c. Each lot shall be limited to 25 percent impervious surface coverage. d. For the initial construction, the siding materials and colors shall be compatible with the siding materials and colors of the homes within the Gideon Cove PUD. The homes in Lawtonka Villas shall remain consistent with each other. 2. Prior to construction of the second home, the applicant shall provide proof of recording for the minor subdivision and all related documents. 3. No construction or demolition may occur without the applicable building and right - of -way permits. 4. Both homes shall be connected to municipal water. 5. Except as approved above, all construction must be consistent with City Code. 6. Both homes shall use the same garbage and recycling hauler. 7. Prior to issuance of any building permits, the applicant shall complete the following: a. Submit any unpaid fees as required by the subdivision. b. Submit building permit plans in conformance with all city and state requirements. c. Submit a construction management plan for each lot, detailing where workers will park, how deliveries will be made without blocking public streets, where storage of materials will occur, hours of construction and how often streets will be swept. d. Revise the plans to indicate all disturbance within the wetland buffer shall be restored with an approved wetland buffer mix. e. Revise the plans or submit the documents indicated in the City Engineer's memos dated January 18 and 28, 2019. f. Revise the grading plan to add the wetland buffers as indicated on the survey submitted January 9, 2019. g. Surveys submitted for new construction shall include wetland buffers, retaining walls and cantilevers in addition to the information required by City Code.
