19-061RESOLUTION 19 -061 CITY OF SHOREWOOD A RESOLUTION GRANTING A CONDITIONAL USE PERMIT FOR ACCESSORY BUILDINGS TO EXCEED 1,200 SQUARE FEET IN AREA AT 27850 WOODSIDE ROAD WHEREAS, Mike and Joanne Nicklaus has applied to construct a total area of 1,900 square feet for all accessory buildings where 1,200 is permitted without a conditional use permit, on the property legally described as: Lot 6, Block 1, Woodside, Hennepin County; and WHEREAS, the property owners will be removing the existing home and attached garage and propose construction of a new home with two attached garages; and WHEREAS, after required notice, a public hearing was held and the application reviewed by the Planning Commission on June 4, 2019, the minutes from the meeting are on file at City Hall; and WHEREAS, the City Council considered the application at its regular meeting on June 24, 2019, at which time the Planning Director's memorandum and the Planning Commission's recommendations were reviewed and comments were heard by the City Council from the Applicant, staff and the public; and NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SHOREWOOD, MINNESOTA FINDS AS FOLLOWS: FINDINGS OF FACT 1. The subject property is located in an R -1A/S, Single - Family Residential/ Shoreland zoning district, which allows the total area of accessory buildings to exceed 1,200 square feet subject to the approval of a conditional use permit. 2. The applicant's proposal is identified on plans submitted to the City on April 23, 2019. 3. The applicant's proposal includes two attached garages with a combined square footage of 1,900 square feet; with 800 feet in the southerly garage and 1,100 square feet in the northerly garage. 4. The proposed garages do not exceed the floor area of area above grade of the proposed home and are less than 10 percent of the zoning district's minimum lot size. CONCLUSIONS The Applicant's request has satisfied the criteria for granting a conditional use permit to exceed 1,200 square feet of total accessory building area under the Shorewood City Code. 2. The Applicant's plans indicate the new home and garages proposed would be compatible with the neighborhood and would not tend to depreciate the area, subject to the conditions listed below in item 3. 3. Based upon the foregoing, the City Council hereby approves a conditional use permit to construct a combined total of 1,900 square feet of accessory building area, based on the plans submitted April 23, 2019, subject to the following: a. The applicant may not proceed with improvements prior to issuance of required permits. b. Prior to issuance of building permits, the applicant shall submit the following, consistent with city requirements: i. Submit a stormwater management plan including supporting drainage calculations. ii. Revise the plans to show conforming setbacks for the home and all accessory structures. iii. Revise the driveway accessing Woodside Road to be no greater than 25 feet wide at the property line. iv. Show the proposed grading on the survey. V. Submit a tree preservation /landscaping plan consistent with the City's tree policy. vi. Submit fixture details for the freestanding light fixtures and a sound source study for the backup generator. 4. The City Clerk is hereby authorized and directed to record a certified copy of this resolution with Hennepin County.
