A RESOLUTION APPROVING A PRELIMINARY AND FINAL PLAT FOR
JARRETT ADDITION AT 5315 HOWARDS POINT ROAD
WHEREAS, Sathre - Bergquist, Inc. has applied to the City for a preliminary and final plat
to subdivide the property located at 5315 Howards Point Road and legally described as:
All that part of Lots 4, 6, 7, 8 and 10 " Howards Point ", Hennepin County, Minnesota and of
Maple Avenue vacated and of Elm Court vacated as platted in Howard's Point described as
follows: Commencing at the Northeast corner of Lot 3 in said Howard's Point; thence West
along the North line of said Lot 3 a distance of 100.8 feet; thence at right angles South 43.7
feet; thence South 18 degrees 28 minutes East, 202.8 feet; thence South 47 degrees 28
minutes East, 330.50 feet, said point being hereinafter referred to as point "A "; thence
continuing South 47 degrees 28 minutes East, 90.3 feet, said last described line being
hereinafter referred to as "Line X" thence South 13 degrees 47 minutes East, 186.52 feet to
a point on the Westerly line of Maple Avenue as laid out and dedicated in the plat of
Howard's Point distant 248.76 feet Southerly of, measured along the Westerly line of said
Maple Avenue from the Southeast corner of Lot 7 in said Howard's Point, said last described
course being hereinafter referred to as "Line Y "; thence Northeasterly along said Westerly
line of Maple Avenue 76.66 feet to the actual point of beginning of the tract of land to be
described; thence South 13 degrees 47 minutes East deflecting to the right at an angle of
148 degrees 35 minutes from last described course to the center line of said Maple Avenue;
thence Northerly along the center line of said Maple Avenue a distance of 74.03 feet; thence
Northeasterly in a straight line passing through a point in the South line of said Lot 4 distant
91.4 feet East of the Northeast corner of said Lot 6, Howard's Point to the shore of Lake
Minnetonka; thence Northwesterly along the shore of Lake Minnetonka 100 feet more or
less to an intersection with a line bearing North 53 degrees 21 minutes East from
aforementioned point "A "; thence South 53 degrees 21 minutes West to an intersection with
a line drawn parallel with and 40 feet at right angles Northeasterly from aforementioned
"Line X "; thence South 47 degrees 28 minutes East parallel with the aforementioned "Lien
X" to an intersection with a line drawn parallel with and 40 feet at right angles Northeasterly
of aforementioned "Line Y" thence South 13 degrees 37 minutes East parallel with
aforementioned "Line Y" to the actual point of beginning. For purposes of this description
the North line of Lot 3 is assumed to be a true East and West line.
AND
Tracts B and C, Registered Land Survey No. 1735, Hennepin County, Minnesota, except
the part of said Tract C lying Southerly of the Westerly Extension of the South line of Tract
B, said Survey; and
WHEREAS, the Applicant has applied to the City to subdivide the property into two
parcels; and
WHEREAS, the Applicant's request dated September 9 and October 4, 2019 was
reviewed by the Planning Director, whose memo was forwarded to the Planning
Commission for their meeting on October 22, 2019, a copy of the memo is on file at the
Shorewood City Hall; and
WHEREAS, the Planning Commission considered the application at a public hearing
held on October 22, 2019, the minutes are on file at City Hall; and
WHEREAS, the City Council considered the application at its regular meeting on
November 12, 2019, at which time the City Council reviewed the Planning Director's
memorandum and the Planning Commission's recommendations and all additional
public testimony was heard.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Shorewood
as follows:
1. The preliminary and final plat for "Jarrett Addition" is hereby approved based on the
plans submitted September 9 and October 4, 2019, subject to the conditions in this
resolution.
2. Prior to recordin the subdivision, the applicant shall submit the following consistent
with City Code and the Comprehensive Plan:
a. An executed encroachment agreement.
b. A revised final plat drawing with a correction to the note regarding the
requirement for a 10 -foot easement, instead of the five -foot easement indicated.
3. Prior to issuance of a building permit on Lot 2, the applicant shall complete the
following:
a. Submit proo of recording for the final plat, resolution, and encroachment
agreement.
b. Request and acquire any right -of -way permits necessary to install services or
conduct any other work in the right -of -way.
c. Submit proof of a MN Department of Health permit and evidence that a new well
has been inst ,-;fled on Lot 1 for the existing home.
d. Reduce the a;nount of impervious surface coverage on Lot 1 to no greater than
25 percent ar 1 request an inspection for confirmation.
e. Submit plans � conformance with the Engineer's memo dated September 27,
2019 and all c'i'ty and state requirements.
f. Submit a construction management plan for construction on the easterly lot,
detailing where workers will park, how deliveries will be made without blocking
public street. where stoi age of materials will occur, hours of construction and
how often sti its will be -wept.
4. No construction c r demolition may occur without the applicable permits.
5. No variances are granted or implied.

6. The City Clerk v.,i'I furnish the Applicant with a certified copy of this resolution for
recording purpc ;s when the above applicable conditions are satisfied.
7. The Applicant sh ;ll record this resolution and the easements with the Hennepin
County Recorder or Registrar of Titles within thirty (30) days of the date of the
certification of this resolution.
