1967 Council Minutes
Special meeting of the Council of the Village of Shorewood January 3, 1967 After the new Trustees John D. Chandler and Jack D. Stansbury, Assessor Ray Friede and new clerk- treasurer Muriel Whowell subscribed to their, respective oaths of office, the special meeting of the Shorewood Village Council was called to order by Mayor Robert McDougall at 7.30 p.m. at the Minnewashta Elementary school on January 3, 1967. Present were Mayor McDougall, Trustees F ryermuth, Chandler and Stansbury. Trustee Wakefield was absent. Also present was the village attorney, William F. Kelly. RESOLUTIONS The attached ! (in detail) were adopted by the ADOPTED council as follows: I 1. Making appointments 2. Setting salaries 3. Designating the official newspaper and depository 4. Appointing council members to head up various committees. 5• Appointing council representatives to affiliated organizations. 6. Approving transfer of funds from Municipal Liquor Store Fund to Park and General Fund as provided for in the 1967 budget. LIQUOR STORE Mayor McDougall moved that Harry Feichtinger and Edwin VACATION PAY Mwynard,_manager and clerk of Liquor Store, be reimbursed for vacation pay for years 1965 and 1966. Trustee Chandler seconded the motiob, motion carried all voting aye. FIRE CONTRACT WITH EXCELSIOR FIRE DEPT. calls made by t LIQUOR STORE SPECIFICATIONS & BIDS FOR NEW FIXTURES all voting aye. Council tabled approval the Fire Contract with the Village of Excelsior. Mayor McDougall authorized the Village ,Attorney to write village of Excelsior requesting that contract be made to cover charge for First Aid he Rescue Squad. A.me - ft"TOW1 was introduced by Mayor McDougall to authorize Trustee Chandler to approve the specifications for new fixtures for the Liquor Store. Also that the clerk be authorized to publish legal notice requesting bids for furnishing and installing fixtures. REQUEST TO Upon a request from Grant Sperry regarding operatYhn LOCATE POPCORN of a popcorn trailer on commercial property across TRAILER from Minnetonka Plaza on Co.Rd. #19, council gave its permission for operation of the trailer. PRIVATE Gerald Peterson, the present owner of the Lester SKATING RINK Badger property, informed council he was making a skating rink on his property and needed a shaver to complete work on the rink. Council suggested tht he use the shaver belonging to the South Shore Community Council for this purpose. RESOLUTION The attached" (on file) was adopted by APPROVING council as follows: CIGARETTE LICENSES FOR 1967 Approving cigarette license applications for 1967. DOG LICENSES Council authorized Clerk Whowell to of. $11.00 penalty that will go into effect on January 16 1967., on all dog licneses for 1967. BILLS APPROVED On motion of Trustee Freyermuth, seconded by Mayor FOR PAYMENT IN McDougall, bills were approved for payment in JANUARY January, 1967, for a total of $5,575. for village purposes and a total of $12,587.25 out of the Liquor Fund. WEEDS ON LAKE & SWEEPER Aft BIDS — POLICE CAR Following a complaint by Mrs. Haugen and Mrs. Peterson, residents of Lakeway Terrace, regarding weeds on Lake William and suggestions they had received from a weed spraying firm Trustee Freyermuth suggested that the firm contact him with regard to type of chemicals to be used for weed destruction. Trustee Freyermuth also said he would check into a road sweeper for village use. The only bid for a new police car submitted by Jordan Ford Inc., was opened which was in accordance with specifications drawn up by the village. The net price was $2,044.51. It was moved by Mayor McDougall, seconded by Trustee Chandler., that the bid be accepted. Motion carried, 4 ayes with Trustee Freyermuth voting nay. PUBLIC HEARING Upon notice having been published on May 25, 1967, a public hearing MANSON CAVERLY was held at the request of Manson Caverly to engage in a home HOME OCCUPATION occupation of assemblage of berry crates upon residential property PIT (Lot (part) 113, aud. sub.No.120, Hennepin County, formerly tl.lenore Nursery). Mr. Caverly stated that the assembling of berry crates would last approximately three months and there would be no employees apart from his immediate family. Following discussion between council and Mr. Caverly, council recessed for a short time, Following recess Mayor McDougall moved, seconded by Trustee Freyermuth, that Mr. Caverly be granted a home occupation permit.until October 1, 1967 only,on a harship basis. SDE #60 Mr. Ray Latterner who will do proposed excavating work for Mr. Noble at Oak Ridge Estates requested information regarding permit for doing such work. Mayor McDougall stated that Trustee Freyermuth had contacted McKown Spraying Company, Maple Plain, regarding spraying of the lake and the total cost would be $685.00, and the Mayor suggested that residents of Lake William pay half of this amount. Mayor McDougall, seconded by Trustee Murfin, moved that the bid be accepted with the village paying half the cost with the clerk to notify the spraying company to start work immediately. Also present was the Village Attorney, William F. Kelly. MINUTES APPROVED On motion of Mayor McDougall, seconded by Trustee Freyermuth, reading of the minutes was suspended as copiescf the minutes had already been read by council members. Motion carried, all voting aye. FIREWORKS PERMIT On motion of Trustee Freyermuth, seconded by Trustee Chandler, a ISSUED TO MRS. 'permit for display of fireworks was issued to Mrs. Marion Goodman as MARION GOODMAN head of the Fireworks Display Committee. The fireworks to start at approximately 10 p.m. and lasting one half hour on July 4 1967, at Grathwol and Shady Hills Parks and Badger and Cathcart Fields under adult supervision. FIRELANE AT Mr. Hirsch of Birch Bluff informed council that people using the firelane BIRCH BLUFF adjacent to his property to obtain access to the lake were abusing his property. Mayor McDougall requested that Mr. Hirsch give council time to consider the problem, to which Mr. Hirsch agreed. NO PARKING Mr. James Blakeborough, Galpin Lake Road, complained of "No Parking" signs SIGNS ON on Galpin Lake Road. Mr. Kelly suggested to council that the Police GALPIN LAKE Department be advised to make a, report to council on the matter. Present were Mayor McDougall, Trustees Chandler and Freyermuth. The Local Assessor, Ray Friede, and a representative of the County Supervisor of Assessments office, RoVert Martin, were also present. Nor. Graham Mandeville submitted a letter to the Board signed by himself and Mrs. Mandeville requesting 25% reduction in valuation of Lot 7, Timberlane, due a club on the 3rd lot from Lot 7. Board stated that matter would be considered. Mayor McDougall moved, seconded by Trustee Freyermuth, that the council accept the assessments as prepared by the Assessor. Present were Mayor McDougall, Trustees Chandler and Murfin. Trustees Cronin and Freyermuth were absent. Also present was the Village Attorney, William F. Kelly. MINUTES On motion of Trustee Chandler, seconded by Trustee Murfin, reading of the APPROVED minutes was suspended as copies of the minutes had already been read by council members. Motion carried with Mayor McDougall and Trustees Chandler and Murfin voting aye. LETTER FROM Mayor McDougall read a letter from Mrs. Paul Bilka of the League of LEAGUE OF Women Voters stating that members were interested in local government WOMEN VOTERS and would like to attend council meetings. Mayor McDougall had answered the letter stating that he would welcome them to attend any of the council meetings. REQUEST FOR At the present time there is no light at Woodend Road, Minnetonka Manor, at IGHT AT which location a resident had requested a light. Mayor McDougall, having ODEND ROAD studied the plan submitted by Northern States Power Company on proposed lighting within the Village of Shorewood, recommended submitting the plan to the Planning Commission for their recommendations which the clerk was instructed to do with the request that the recommendations be submitted to council at the August 28, 1967, meeting. INSURANCE - Bids for renewal of insurance policies were opened by Trustee Chandler in BIDS OPENED accordance with specifications drawn up by Shorewood village. Four bids were received - Roger Hennessy Agency, Sentry Insurance, Schmidt- Andrus Insurance and MAgnuson Insurance Agency. Mayor McDougall referred the bids back to Trustee Chandler for his perusal. GAS PERMIT An application from Minneapolis Gas Company for installation of gas NO.S -198 -1967 main permit No.S -198 -1967 was approved by Mayor McDougall, Trustees Chandler and Murfin subject to the recommendations as note by Village Engineer. N.W. BELL An application from N.W. Bell Telephone Company for installation of one TELEPHONE manhole on Excelsior Boulevard Permit No. A-M @35 was approved by Mayor CO. Further he sated that the Village of Shorewood has no authority to do anything about the matter and the council cannot take any action except to discuss it with the Village of Chanhassen. Councilman Cronin was.absent. Altso present were'the Village Attorney, William F. Kelly, and the Village Engineer, Bernie Mittelsteadt. MINUTES On motion of Mayor McDougall, seconded by Councilman Freyermuth, reading APPROVED of the minutes of the regular meetings of September 11 and September 25 1967, was suspended as copies of the minutes had already been read by council members. Motion carried with Mayor McDougall, Councilmen Freyermuth, Murfin and Chandler all voting aye._ PUBLIC HEARING Upon notice having been published on September 14, 1967, a public MRS. BONNIE hearing was held at the request of Mrs, Bonnie Arnold to build a DOUBLE ARNOLD bungalow on residential property located.at the corner of Timberlane.and County Road No.19 (Lots 293 and the south part of lot 294,.Auditor's subdivision 135). Mr. Rice, attorney, presented architect's drawing and plans to council of the proposed double bungalow, entrance to which would be from Timberlane. Mr. Edward Turner, Timberlane, was concerned about the 20 ft. of lakeshore available with the property and the possibility of the other part of lakeshore owned by Mrs. Arnold being used by the public. Following a short recess called by the Mayor he suggested that the hearing be continued at the October 9 1 1967, regular meeting. Banker. (South 1/2 of the N.E. 1/4 of Sec-36, except the E-300 ft of the Worth 1/2 thereof) Vine Hill Road. Following the presentation by Mr. Ryan of the proposed layout of the Day Camp, Council requested that the discussion be continued at the regular meeting on October 23, 1967. LAKE MTKA. Hennessy, Netland and Ryan regarding the issuance of a Special Use Permit was,continued from September 27, 1967, council meeting. Mayor McDougall stated he would like to persue the matter farther and instructed Mr. Kelly to obtain opinions from the former Metropolitan Planning Commission, State Business Development Planning Commission and the University of Minnesota (League of Munioipalities) who are experts in the field of land use and planning. He anticipated that Council would further discuss the matter at the next Council meeting. Also in attendance were the Village Attorney, William F. Kelly, and the Village Engineer, Bernie Mittelsteadt. MINUTES On motion of Mayor McDougall, seconded by Councilman Freyermuth reading of APPROVED the minutes was suspended as copies of the minutes had already been read by Council members. Motion carried with Mayor McDougall and Councilmen Cronin, Freyermuth, Chandler and Murfin all voting aye. DAY CAMP — Mayor McDougall read the minutes of the Shorewood Planning Commission BANKER meeting of November 22, 1967, in which the motion made that the Day Camp PROPERTY VINE proposal receive consideration,was defeated. Mayor McDougall also read HILL ROAD the Engineer's report and recommendations on the project. Following a short recess called by the Mayor, Councilman Freyermuth moved, seconded by Councilman Murfin, that the proposal be abandoned and that no further consideration would be given to it. Motion carried unanimously with Mayor McDougall and Councilmen Cronin, Chandler, Freyermuth and Murfin all voting aye. Mr. Roger Hennessy, representing Mr. Ryan (one of the partners in the Day Camp Proposal) requested permission to return to the Council for further discussion in 1968 after Mr. Ryan had had an opportunity to diwuss and review problems with his two partners. Mayor McDougall stated that Council would entertain any request todLsouss the matter in the future. JAMES BARNHART Mr. James Barnhart, owner of Lots 7,8,9 and 10, Idlewild Path, Minnetonka PROPERTY — Manor, presented plan to Council of location of said lots and requested IDLEWILD PATH permission to take 30 feet in depth from lot 8 and add to lot 7 in order that MTKA. Mayor McDougall and Councilmen Murfin and Cronin were present. Also present were the Village Attorney, William F. Kelly, and the Village Engineer, Bernie Mittelsteadt. Councilmen Freyermuth and Chandler were absent. MINUTES On motion of Mayor McDougall, seconded by Councilman Murfin reading of APPROVED the minutes was suspended as copies of the minutes had already been read by Council members. Motion carried with Mayor McDougall and Councilmen Murfin and Cronin all voting aye. PUBLIC Upon the request of Stanley Kinghorn and others notice was published and HEARING - public hearing was called to consider granting the renewal of a special SPECIAL USE use permit to moor their private boats at a dock located on their jointly PERMIT - R.S. owned property in the Timber Lane area. KINEUMM Several residents from the Timber Lane area were present to voice their feelings on the renewal of the special use permit. Following discussion on the matter Mayor McDougall asked that the public hearing be cotinued at the first council meeting in February 1968 at which time he hoped the full council would be present. SNOWMOBILES Mr. B. Witrak, manager of the Minnetonka Country Club, complained that ON MINNETONKA snowmobiles were damaging the Club golf course and abusing private COUNTRY CLUB property. Mayor McDougall suggested that Mr. Witrak post the property PROPERTY with "No Trespassing" signs and that the Police Department would be informed to pay particular attention to the area. Mayor McDougall asked Mr. Kelly to research the problem who said he would have suggestions at the next council meeting. FATIMA A delegation of residents from Fatima Place were present to hear the report PLACE from the Village Engineer regarding the requirements for streets before they could be accepted by the Village. He stated that the cost for upgrading, replacing sod and extending culvert would be approximately $3,400-00. Following discussion by Council and residents regarding the diameter of the cul-de-sac and the width of the road Mayor McDougall asked that a meeting between the engineer and the residents of Fatima Place be arranged to view the street and widening of same from its present 18 feet to 25 feet which Mayor McDougall stated was the minimum width which the Village could accept. CHURCH ON Mr. W.C. Anderson, representing the Lake Fellowship of Unitarians and GLEN ROAD Universalists, presented a map and layout of proposed location of church on Glen Road, west of Co.Rd.#19, Lot Nos. 20 and 21. Mayor McDougall instructed the Clerk to mail Mr. Anderson a building permit application for completion. REQUEST FOR F011owing reading of written request from Kaufman Outdoor Advertising Company SIGNS-TOM for installation of signs at the Tom Thumb Superette, Co.Rd.#19, the Mayor THUMB instructed the Clerk to send a building permit application to the Company SUPERETTE for completion. Regular meeting of the Council of the Village of Shorewood • December 11, 1967 RESOLUTION - A resolution (on file) renewing the Contract with the Suburban ADOPTING Hennepin County Relief Board for 1968 for the administration RELIEF CONTRACT and supervision of poor relief in the Village of Shorewood was adopted by a unanimous vote of the Council with Mayor McDougall and Councilmen Murfin and Cronin all voting aye. TRANSFER OF $4 Mayor McDougall moved, seconded by Councilman Murfin, that $4y5 TO LIQUOR STORE be transferred from the General Fund back to the Liquor Store CHECKING ACCOUNT Checking Account to replace loan from Liquor Store Fund in August, 1967. Motion carried with Mayor McDougall and Councilmen Cronin and Murfin all voting aye. HOUSING AND URBAN A l awmv p aw " . W (on file) approving Appendum No.1 to the Agreement DEVELOPMENT SEWER for engineering services between the Village of Shorewood and Orr- STUDY Schelen-Mayeron and Associates relating to sanitary sewer facilities was offered for adoption by Mayor McDougall, seconded by Councilman Cronin. Resolution adopted with Mayor McDougall and Councilmen Murfin and Cronin all voting aye. Mayor McDougall instructed the Clerk to inform the Department of Housing and Urban Development that the meeting between the Village Engineer and the Minnesota Pollution Control Agency, which was scheduled for December 12, 1967, has been postponed until the Minnesota Pollution Control Agency's first meeting in January.
