051280 CC Reg Min CITY OF SHOREWOOD COUNCIL MEETING MAY 12, 1980 . M I NUT E S CALL TO ORDER The regular meeting of the Shorewood City Council was called by Mayor Frazier at 7:35 P.M. on May 12, 1980, in the council chambers. PLEDGE OF ALLEGIANCE Meeting opened with the Pledge of Allegiance followed by prayer. ROLL CALL Council members present: Mayor Frazier, Keeler, Naegele, Haugen and Shaw. Staff present: Engineer Norton, Attorney Sanders, Clerk Wiltsey, Planner Nielsen APPROVAL OF MINUTES Moved by Haugen, seconded by Naegele, to approve the minutes of April 28, 1980, as submitted. Motion carried unanimously. CLERK'S WEEK PROCLAIMED RESOLUTION NO. 32-80 Mayor Frazier read a resolution proclaiming a week as Municipal Clerk's Week. Moved by Haugen, seconded by Shaw, to adopt a resolution to proclaim the week of May 12-16 as Municipal Clerk's Week. Motion carried unanimously. e BUILDING PERMIT: Tennis Court, Baker (off of Kathleen Court) Moved by Haugen, seconded by Shaw, to approve a building permit for a tennis court to be located at 28085 Woodside Road in accordance with the engineer's recommendation pending evidence from the owner that the area designated as a storm drainage ponding area be filed of record as a permanent easement on the Baker property, Lot 2, Noelwood Heights. Motion carried unanimously. BUILDING PERMIT: Swimming Pool, 27720 Island View Road Jim Sutherlin appeared before the Council requesting approval of his application for construction of a swimming pool at 27720 Island View Road. After further discussion with the engineer, it was moved by Keeler, seconded by Naegele, to approve the permit in accordance with the recommendations of the engineer (dated 5/12/80) subject to receipt of a complete mechanical drawing from the Baker Pool Manufacturing Company. Motion carried unanimously. BEER LICENSES: 3.2 Renewals Approved Moved by Haugen, seconded by Shaw, to table approval of a 3.2 off-sale Beer License renewal for Little Store until an official of the City has discussed the provisions of the City sign ordinance with the owners of Little Store. Motion carried unanimously. Moved by Keeler, seconded by Shaw, to approve the renewals of 3.2 beer licenses for one year starting June 1 for the following: e 1. Howards Point Marina - On and off-sale 2. Tom Thumb - Off-sale 3. Driskill's Super Valu - Off-sale Motion carried unanimously. COUNCIL MINUTES - 2 - May 12, 1980 e MATTERS FROM THE FLOOR Brian Lee, owner of property located at 25620 Smithtown Road appeared before the Council to request a variance to the fencing ordinance for permission to replace an 8' fence between his property and the neighbor's, who was also present to register his approval of the fence construction. Inmaking application, Mr. Lee appealed to the Council to review the policy recently adopted and to cancel or reduce the $200.00 charge for variances where no staff reports are necessary. Moved by Keeler, seconded by Shaw, to approve the application for the 8' fence and to defer payment of the $200.00 variance fee until the policy is reviewed. Motion carried unanimously. ORDINANCE NO. 120: to Amend Ordinance No. 18 and No. 64 Re: Well Inspection Fees and Sewer Connection Fees Upon the 2nd reading, it was moved by Keeler, seconded by Haugen, to adopt an ordinance amending Ordinance No. 18, as it pertains to license and inspection fees for well installations, and amending Ordinance No. 64, as it pertains to license and inspection fees for sewer connections. Motion carried unanimously. ORDINANCE: Providing for Private Use of Publicly Owned Right-of-Ways An ordinance providing for lawful incidental private use of publicly owned right-of-ways had its frist reading for adoption at the next regular meeting. e ORDINANCE: Regulating Roadside Sales Moved by Haugen, seconded by Naegele, to ask the staff to research the necessary information toward possibility of an ordinance to regulate roadside sales and report back. Motion carried unanimously. PLANNING COMMISSION MINUTES: Re: Amesbury West PURD The minutes of the planning commission of May 6, 1980, indicated that the commission would like input from the Council as to the concept of the Amesbury West PURD, based on the findings of the planning commission, so as to give the developer further direction for preparation of the detailed preliminary plan. Kristi Stover of the planning commission was also present to convey some of the commission's concerns. Council members expressed their general preference and their interpretation of the PURD ordinance and how it could apply to this development. Density figures mentioned were between 32 and 42 units. C.N. RAILWAY - Intent to Abandon Service Acknowledged receipt of a notice from Chicago-Northwestern Railway of intent to abandon a line of railroad known as the Hopkins-Norwood line including the stations of Deephaven, Excelsior, Manitou, Victoria and Waconia. Council referred notice to the Park Commission for their consideration and recommendation. e . e e COUNCIL MINUTES - 3 - May 12, 1980 JUNK ORDINANCE VIOLATIONS There was general discussion about the number of properties with accumulation of junk, etc., that may be in violation of the City junk ordinance. Moved by Haugen, seconded by Shaw, to follow up on those properties as reported by neighboring property owners, and make inspections along with pictures of all supposed violations, giving them ten days to comply. Motion carried unanimously. Moved by Haugen, seconded by Keeler, to authorize the purchase of an instant develop camera for use by the City. Motion carried unanimously. SET MEETING - May 28, 1980 Because of the holiday on the 26th, it was moved by Haugen, seconded by Keeler, to set the next Council meeting on May 28, 1980, around 4:00 or 5:00 P.M., exact time to be set by the administrator. Motion carried unanimously. APPROVAL OF CLAIMS AND ADJOURNMENT (11:15) Moved by Haugen, seconded by Naegele, to approve payment of claims to be followed by adjournment.
