TO ORDER: The last regular meeting of the Shorewood City COl..U1ci1 was called to order by Mayor Baird on Monday, June 1, 1981, at 7: 40 P.M. in the Council Chambers. PLEJX;E OF ALlEGIANCE AND PRAYER: Meeting opened with the Pledge of Allegiance and a prayer. ROLL CALL: Present: Mayor John Baird, Jan Haugen, Tad Shaw, A1 Leonardo, Bob Rascop. Staff: Attorney Gary Larson, Engineer Bernie Mittelsteadt, Clerk Elsa Wiltsey APPROVAL OF MINUTES: Moved by Shaw, seconded by Haugen, to approve the minutes of the Board of Review Meeting of May 20 as corrected (the vote on Marguerite Franzen valuation -P.LD. 32-117-23-14-0026 should read Rascop, Haugen, and Leonardo voted aye, Shaw passed, Baird nay). Motion carried unanimously. Moved by Rascop, seconded by Leonardo, to approve the minutes of the regular meeting of May 11, 1981 as subnitted. Motion carried unanimously. BUILDING PERMIT - 4245 Enchanted Lane - Setback Variance: Chester Yanik appealed before the COl.mci1 on his application for a building penni t for a wood deck 20 x 24 with a proposed setback from the lake of 30 feet. Discussion as to the classification of the deck followed. Moved by Rascop, seconded by Haugen, to approve the application for a building permit at 4245 EnchantedLane for a deck to be built not closer than 35 feet from the 1akeshore in accordance with the Zoning Ordinance No. 77, Section 11, Subdivision 7A. Motion carried unanimously. PUBLIC HEARING - CDBG FUND AMENJlvIENT RESOLUTION NO. 17-81 A public hearing was called pursuant to published notice to consider amendments to the designated uses for Comrmmity Development funds by transferring balances in funds from previous years into the funds for Housing Rehabilitation. Hearing declared closed. Discussion followed. Moved by Haugen, seconded by Rascop, to raise the maximt.nn income limits to qualify for total payment in the Diseased Tree Removal Program only - up to Section 8 standards of $13,000. Motion carried unanimously. Moved by Shaw, seconded by Rascop, to approve the Clerk's reconrnendation to transfer the balance from the Projects No. 613, architectural barriers of $10,224; No. 660, administration of $1,000 - totalling $12,445, and add to funds available for Housing Rehabilitation - Project No. 586. RENEWAL OF 3.2 BEER LICENSES: Moved by Rascop, seconded by Haugen, to approve the 3.2 beer licenses for one year to expire May 31, 1982 for the following establishments: Howards Point Marina Little Store Tom Thumb Driskill's Super Value - On and Off Sale - Off Sale - Off Sale - Off Sale Motion carried unanimously. MAGAZINE SALES: Discussion followed relative to the display of adult pornographic magazines in certain establishments where they are displayed and readily available to children and the possibility of sending such notices to them along with the beer licenses. Moved by Haugen, seconded by Leonardo, to send notices to all those who sell magazines to notify them of the Council's concern over the open display of adult magazines. Motion carried unanimously. RENEWAL OF LIQUOR LICENSES: Moved by Shaw, seconded by Rascop, to approve the On Sale and Sunday Liquor License for Minnetonka Country Club, and the C1ub-On Sale and Sunday Liquor License for American Legion Post #259 - each for one year to expire May 31, 1982. Motion carried unanimously. . ENGINEER'S REPORT: RESOLUTION NO. 18-81 Moved by Haugen, seconded by Leonardo, to approve a resolution awarding the bid on the Amesbury Improvements, Project No. 80-3, to Richard Knutson, Inc. of Burnsvi11e, the low bidder at $193,949.80, as recorrmended by the engineer. Motion carried unanimously. ATTORNEY'S REPORT: Discussed the problem the City Maintenance Crew has encountered in using the private road in Amesbury for access to the well and pumphouse. Attorney will c..t"eck further. REPORTS: Mayor reported on the items discussed at the Amesbury Homeowner's Association. Park Corrmission: Due to the increased activities at the Freeman Park, the access of Highway 7 used for both ingress and egress is becoming quite a problem. It was suggested that the Park Corrmission make a recommendation and also discuss with the Planner the possibility of a better access and its effect on the future plans for the Park. FIRECRACKER FUN RUN: Moved by Haugen, seconded by Rascop, to approve the request of Jerry Johnson, Race Director, to support the Fun Run on the 4th of July - to n.m through portions of Shorewood roads as per schedule suhnitted. ATh1INISTRATOR CLERK REPLACEMENT: There was discussion as to the need for a replacement for the Administrator/ Clerk/Treasurer. An ad has been placed in the Sun. Councilwoman Haugen agreed to post a notice at the League Conference in St. Paul next week. The Mayor acknowledged receipt of three applicants for the position. APPROVAL OF CLAIMS AND ADJOURNMENT: Moved by Haugen, seconded by Rascop, to approve the claims for payment to be followed by adjournment at 10: 10 P.M. Motion carried unanimously.
