PLEIX;E OF ALLEGIANCE. AND PRAYER: The meeting opened with the pledge of allegiance and payer. ROlL CALL: Present: Mayor Baird, Haugen, Shaw, Leonardo, and Rascop. Staff: Attorney Larson, Engineer Frigaard, Clerk Kennelly APPROVAL OF JUNE 22, 1981 COUNCIL MINUTES: Moved by Haugen, seconded by Leonardo, to approve the minutes of June 22, 1981 as su1:mitted. Motion carried unanimously. DIVISION: GOERING, P. J. COURTURE, & C. C. COURTURE Lots 12 and 13, Radisson Inn Addition , Attorney Van Brockenberg representing Goering, Courture & Courture presented a request to separate Lot 12 from Lot 13 Radisson Inn Addition m.ich currently are combined in one parcel Property Identification No. 36-117-23-22-0013. Concerns about the shortage of square feet to meet the R-l zoning and the lack of opened access over platted Garden Lane were expressed by the Council. Moved by Haugen, seconded by Shaw, to deny the request for division of Lot 12 from Lot 13 Radisson Inn Addition was made. Motion carried unanimously. Council recommended to applicant to request reimbursement of one of the two A-unit sewer charges originally assessed to this property. VARIANCE: FRANK IDRMS RESOLUTION NO. 20-81 5570 Woodside Lane The request by Dr. Frank Worm to build additional garage space for personal use that would exceed the square footage requirement was heard. Moved by Rascop, seconded by Haugen, to approve the variance as requested. Motion carried 4-1. 4 ayes with 1 abstaining (Shaw). PLANNING COMMISSION. REPORT: Planning Comnission requested to study road section in Subdivision Ordinance No. 77. Planning Comnission would like policy set by Council to follow. Council would like the Planning Comnission to study and recorrmend new require- ments for total garage and storage sheds for residential use. I PARK COMMISSION: Gary Carl, Park Corrmission, represented a request from Tom Muehlberg of Minnetonka Youth Hockey Association (MYHA) to move a Tanka Bay Hockey Rink to Badger Park at no expenses to the City. Carl stated Muehlberg had been advised to have an adequate plan su1:mitted by MYHA showing locations of new rink. SHOREWOOD PROFESSIONAL/MEDICAL BUILDING: RESOLUTION No. 21-81 Complying with request of Council, Mike Murray m.o represented the Shorewood Professional/Medical Building, su1:mitted a traffic study which was completed by Bennett-Ringrose-Wolfsfeld-,Jarvis-Gardner, Inc. The impact of added traffic to Lake Linden Road, Yellowstone Trail, and County Aid Highway No. 19 was discussed. A petition was su1:mitted by Paul Swanson of 24460 Yellowstone Trail as he was representing neighbors in opposition to the development. Moved by Haugen, seconded by Shaw, to approve the Conditional Use Permit subject to conditions to be spelled out in resolution. Motion carried 4-1. (Leonardo-nay) NEAR MOUNTAIN. DEVELOPMENT: RESOLUTION NO. 22-81 Mike and Peter Pflaum of Near Mountain Properties complied with the request of the Council and submitted their final plan to the Council by June 30, 1981. Council determined that a central well with back-up water would be required in this development. Council ordered City Engineer to do a Water Feasibility Update Study (at the cost of the developer). . Moved by Shaw, seconded by Rascop, that as a general concept the present Council of Shorewood will drill and finance a well/or wells provided,thata~, request be received by Near Mountain Development within six months from the date of July 13, 1981. Motion carried 4-1 (Leonardo-nay). DRAINAGE PROBLEMS: Gene Patch, 23930 Smithtown Road Gene Patch requested the City to supply the labor at City cost to correct a drainage problem, from County Road No. 19, that affects Mr. patch and Mr. fun Shafer of 23880 Smithtown Road. He would like to alter current drainage. In the absence of Engineer Norton, it was moved by Shaw, seconded by Leonardo, to table the request to the meeting of August 10th m.en Mr. Patch and Engineer Norton will be available for further information. Motion carried unanimously. DRAINAGE PROBLEMS: Mike Schmidt, 6110 Lake Virginia Drive Mike Schmidt requested the Council to have the City clean out the drainage ditch along his north lot line. Moved by Haugen, seconded by Rascop, to approve work, subject to a release of responsibility for damages, signed by Mike Schmidt, property owner, to correct drainage problems m.en gound condi- tions will permit. MATTERS FRCM FLOOR: Question on why road was swept by City in Boulder Bridge Development was re- ferred to Field Engineer on project. INFORMAL DISCUSSION: - McCartney Property 24035 Yellowstone Trail Attorney Richard Speeter of Speeter, Johnson, Hautman, and Olson, 604 Minnesota Federal Building, Minneapolis, Minnesota and Mr. John McCartney came to discuss the possible development of Mr. McCartney's property. After the proposal was sul:mitted to and turned down by the Planning Corrmission, McCartney requested the Council to give suggestions as to what development might be accepted by the Council. General consensus of the Council was to submit plans under the P.U.R.D. or P.U.D. zoning to best utilize this property or stay with current R-l zoning. ENGINEER'S REPORT: - Engineer Frigaard Letter from Engineer Norton, dated June 30, 1981, regarding "Updated Costs - Water Report", was submitted for discussion. Tabled until further date. ATTORNEY'S REPORT: - Adoption of :ksolution of Assessment Rolls regarding Boulder Bridge was tabled to August 10th. . - Attorney Larson has been in contact with the City's insurance company, Home Insurance Company; they have detennined that they will take care of flJrther action regarding the Pfiffner litigation claim. - The zoning 'violation regarding R. R. Johnson was tabled until further contact with Johnson's attorney. DISEASED TREE.PRcx;RAMDISCUSSION: A sample resolution was submitted for removal of diseased trees on private property of non-complying residences, and authority to assess property owner for cost incurred by City for removal. Tabled for discussion and later approval. A letter dated June 30, 1981 from the Shade Tree Program, State of Minnesota, was submitted to the Council, in which a reduction of eligible reimbursible expenditures from 50 per cent in past years to 25 per cent for the current calendar year 1981 was indicated. After discussion of current expended funds and r'emaining budgeted funds available, the Council determined to continue the program and re::,idence reimbursement subsidies with reviewal of the Program later in the program's season. .
