Gagne moved, Stover seconded, to approve the Regular City Council
Meeting of August 27, 1990 with the following changes:
1. Pg. 3 - The last paragraph, first sentence should
read; "Froberg said there would not be a hardship
if the owner knew he couldn't add on to the house
when he constructed it, because he created his own
problem. "
2. Pg. 13 - Under Council Reports; Haugen has been
appointed to the Local Officials Advisory Board
of the Regional Transit Board.

COMMISSION REPORTS
PLANNING COMMISSION
Councilmember Stover reported there was no Planning Commission meeting
the previous week.
LETTER OF RESIGNATION FROM PAT MASON
Mayor Haugen read a letter from Pat Mason resigning from the Planning
Commission.
Watten moved, Gagne seconded, to accept the resignation of Pat Mason
from the Planning Commission.
Motion carried - 5/0.
Haugen expressed her thanks to Pat Mason for her time and
consideration. She also announced that there is an opening on the
Shorewood Planning Commission for the N. E. Area of the City. If
anyone wished to apply, they can contact the City Hall.
PARK COMMISSION
Park Commissioner Andrus reported that the Park Commission had a frank
discussion with the Tonka United Soccer Association. He felt both
sides had aired their differences and felt there would be better
communication between the groups.
Haugen asked if it was Andrus' understanding that they could work
together. He indicated yes.
Councilmember Watten said the organization knows they have to comply
with the rules.
The Commission recommended the Council raise the Park Dedication fee
to $750.00.
They recommended the Council direct Park Planner Koegler to initiate
the bond referendum process for the parks.
They also recommended the Council accept layout * 1 for the Freeman
Park Little League Field.

Councilmember Stover asked why they did not accept Koegler's
recommendation for layout * 2. Andrus said Koegler had no strong
feeling for either layout. The difference was in the orientation of
the field.
Gagne moved, Brancel seconded to approve the Park Commission's
recommendation for layout * 1 for Freeman Park Little League Field.
Motion carried - 5/0.
Gagne asked about the completion of the Little League Field. Andrus
said the Tonka Men's Club has the financing.
Administrator Whittaker said they are starting to grade. He also said
there will be a proposal from the planner. at the September 25th
Council Meeting for coordinating the referendum.

his gazebo. Nielsen felt 60 days should be sufficient.

property in 60 days.

SETBACK VARIANCE - FINDINGS OF FACT/RESOLUTION
RESOLUTION NO. 93-90

Brancel moved. Gagne seconded. to adopt RESOLUTION NO. 93-90 "A
Resolution Granting a Variance to Rockford Waldin to add on to a Non-
Conforming Structure and a Conditional Use Permit for Additional
Accessory Space."

TRAFFIC CONTROL AT RADISSON AND COVINGTON ROADS. RESOLUTION NO. 94-90
Nielsen received a letter from Mr. Jerry Hayes requesting traffic
control signs on Radisson Road. The request comes as a result of
increased traffic in the area.
The City Planner and City Engineer visited the site. They recommend
the following:
1. The proposed stop sign at Covington and Radisson is not a
good idea. They recommend a sharp curve sign and a 20 MPH
speed limit sign and that yield signs be placed at eastbound
and westbound ramps from the Covington Road ingress/egress at
HwY. 7.
2. It is recommended that stop signs be placed on the service
road to HwY. 7 at Covington Road and on the wayside rest
exit at Covington Road.
3. A stop sign on Radisson at Shore Road is not warranted.
Clearing the brush at this site would improve visibility.
4. The stop sign on Shore Road is considered warranted; along
with clearing brush on the East side of Shore Road.
Gagne requested the Planner notify residents when they decide to clear
the brush to avoid any problems.
Mr. Hayes was in the audience and was satisfied with the proposals.
Stover moved. Brancel seconded. to adopt RESOLUTION NO. 94-90 " A
Resolution on Traffic Control at Radisson and Covington Roads. on
Shore Road. the service road to HwY 7 and at the wayside rest at
Covington Road and to place signs as indicated in the Planner's report
dated 6 September. 1990.
Motion carried - 5/0. On a roll call vote.
8:00 P.M.. - PUBLIC HEARING ON DELINQUENT BILLS/PROPERTY CLEAN UPS/
WATER CONNECTIONS/DELINQUENT DEVELOPERS FEES - COSTS TO BE CERTIFIED
FOR COLLECTION WITH PROPERTY TAXES.
Haugen asked if there was any discussion from the audience.
Rolek said these bills were delinquent as of August 31. 1990.
Gagne said that delinquent water bills should have their water turned
off and he would like the matter tabled until they were.

Steven Pahl of 24860 Smithtown Road - Mr. Pahl felt that the clean up
of his yard was handled badly. The materials taken off his property
were not on the list of materials to be removed. The City took
firewood and building materials. He said he received no notification
from the City. He checked with other cities in the area and they issue
a citation before they come on a citizen's property.
Nielsen said Pahl received the registered letter. He appealed the
removal and was given a 30 day extension. Nielsen said they typically
wait one week after the deadline for the extension before they start
to remove the material. Pahl did not come back to appeal.
Attorney Froberg stated that the Ordinance does provide for the City
to follow this procedure. If Pahl feels this is unconstitutional. he
can appeal through the courts.
Haugen said they could remove his bill from the list and look into the
problem. His bill for the clean UP is $868.99.
Stover asked when it happened. Rolek said the clean up was done on
April 9. 1990.
Nielsen read the list of materials to be cleaned up. On Feb. 26. 1990
Pahl was granted a 30 day extension. The inspector visited the site
on April 2. 1990 and many of the same items were still there. The
cars did have licenses and some of the brush was removed.
Mr. Pahl reiterated his position that the City took materials off his
property that were not on the list.
Watten asked him if he had a list of these materials. Pahl said the
list is at home.
Councilmember Brancel felt they needed to back UP the City inspector.
he was the one at the site.
Gagne said if the mess wasn't there to begin with. there would not be
a problem now.
Haugen wanted to look at the Ordinance closer. but not at this
meeting.
Pahl said he does have witnesses.
Stover said if the place had been cleaned up within 30 days there
would be not problem or he could have applied for an extension of
time.
Pahls said there was no final walkthrough on the property with the
inspector.
Whittaker said that Joe Pazandak often stays late and comes in early
to take calls from people regarding these cleanups.
Haugen asked Pahl if he had any further comments.
Pahl said he refuses to pay the $868.99 and he cannot afford to fight
this in court. He feels the City is at fault.
Haugen asked if there were any other people who wished to speak at
this Public Hearing. She closed the Public Hearing at 8:30 P.M.

Resolution Directing Delinquent Developer Fees be Placed on the 1991

RESOLUTION NO. 97-90
Watten moved, Gagne seconded, to adopt RESOLUTION NO. 97-90. "A
Resolution Approving Special Assessments for Municipal Water Service
Connection Charge." (Robert Berg, Owner)
Motion carried - 5/0 on a roll call vote.
Haugen asked Rolek if any of the delinquent water bills were for
commercial properties.
Rolek said three were commercial.
Gagne said if commercial users are not paying their water bills. the
City should not subsidize them.
Haugen felt there should be a grace period and then a shut-off.
Stover asked if there was a code regarding this.
Whittaker said the City had the authority to shut-off both residential
and commercial.
Haugen said the Council passed a motion last year regarding shut-off
of commercial water.
Watten asked if residents are given notification.
Rolek said there was no special notification.
Gagne asked for the total amount for certification for water.
Rolek said it is about $10,000.
Stover asked for the total certification.
Rolek said there is another $45,000 for sewer plus $10,000 for clean
up, developer fees and water hook-up.
Gagne felt the Council would not be fiscally responsible if they let
this go.
Stover felt the City should notify the commercial properties and then
follow policy.
Watten said delinquency notices should be sent and the Ordinance
enforced.
Watten felt the Council should obtain all the information regarding
Mr. Pahl's complaint.
Stover felt that six months was sufficient time to object to the
City's clean-up.
Watten said the people in the building trade keep irregular hours.
He asked the Attorney if the Council needed a full trial on this
matter.
Froberg said Pahl could file an appeal within 30 days of the date that
the assessment role is adopted by filing notice with the district
court.

Haugen said Pahl was told it would cost $800 to file an appeal and it
must be done with a lawYer.
Froberg said it is not necessary to use a lawYer.
Gagne moved, Stover seconded, to include all items on the
certification list be approved for inclusion in the 1991 tax rolls.
Motion carried - 3/2 Watten and Haugen nay.
Froberg said Minnesota Statute No. 429.081 states that within 30 days
after the adoption of the assessment any person who is aggrieved, and
is not precluded, may appeal by serving a notice with the District
Court on the Mayor or Clerk of the Municipality. The notice shall be
filed with the Court Administrator of the District Court within 10
days after it's service on the municipality.
Mr. Pahl said it would cost him $100 to file this appeal; he has to
take off a day of work. He felt the City Attorney should help him file
this or someone should be appointed to help him.
Haugen said this would be a conflict of interest and Attorneys (Public
Defenders) are appointed only in criminal trials.
Pahl felt his rights were being violated.
Haugen said the majority of the Council had spoken.
RESOLUTION NO. 98-90
.
Brancel moved, Gagne seconded, to adopt RESOLUTION NO. 98-90. "A
Resolution Directing Delinquent Sewer and Water Utility Charges and
Private Property Clean-Up Charges Be Placed on the 1991 Tax Rolls."
Motion carried - 5/0 on a roll call vote.
Gagne moved, Brancel seconded, to establish a Water Shut-Off Policy.
Motion carried - 3/2 Watten and Stover.
Stover objected to a residential shut-off policy. She felt water was
essential.
Gagne asked her if she wanted to subsidize the people who won't pay.
He totally disagreed. There are privileges and responsibilities that
go along with City water.
Haugen said many people don't pay their water bills. The water system
must pay for itself and cannot if people don't pay their bills.
Stover asked Rolek if the same people were delinquent on their bills.
Rolek said yes.
Watten felt people should be notified before they are put on the list.
He thought they often were unaware the bills went on their property
taxes.
Whittaker said there is a penalty on the water and sewer bills and the
penalty increases per quarter.
Rolek said the fine is 10% per quarter on the unpaid bill.

Watten moved, Gagne seconded to notify all delinquent utility users
that their unpaid bills will be certified to their property taxes.

FINAL PLAT - SHOREWOOD SUBURBAN ESTATES
RESOLUTION NO. 99-90
Mr. Steve Johnston of Merrill & Associates questioned item 6-C of the
Development Agreement. He said there are no easements on the
property.
Nielsen said this is true. The paragraph is a standard phrase.
Johnston said the State now requires property irons to be placed
before the final plat is filed. He said the developer would like to
grade first and then put in the irons.
City Engineer Norton said it did not matter as long as they are in.
Nielsen said the Council should approve the agreement as is and then
if there is a problem Merrill & Associates can ask for an extension.
Gagne moved, Brancel seconded to adopt RESOLUTION NO. 99-90. "A
Resolution Approving the Final Plat of Shorewood Suburban Estates."
Motion carried - 5/0 on a roll call vote.
Haugen asked Norton if he was comfortable with the drainage in this
area. He said he was, this project is taken care of as far as
drainage is concerned. The staff talked about having easements over
drainage areas.
WATERFORD III DEVELOPMENT STAGE PLAN
RESOLUTION NO. 100-90
Stover moved, Gagne seconded, to adopt RESOLUTION NO. 100-90. "A
Resolution Approving a Revised Development Stage Plan and Preliminary
Plat for Waterford Third Phase."
Motion carried - 4/1 (Brancel) on a roll call vote.
Brancel stated that she voted against the gas station and restaurant.
BREAK 9:30 TO 9:40
Watten felt that he would like more detail regarding the signage
requirements. He wants the development to have a residential attitude
and maintain this from the start.
He was also inquired about other plantings aside from the canopy
trees.
Nielsen said there would be a detailed landscaping plan before any
development started.
Watten felt the developers should know before they draw up a plan what
the City is requiring.
Nielsen said the design framework manual discusses the landscaping and
signage.
Haugen asked Froberg if Watten's concerns should be added to the
Resolution.
Froberg said his concerns will be noted as part of the minutes.
Watten was also concerned that the fuel tanks conform to PCA
guidelines.
ESCROW FOR PREPARATION OF PLANS AND SPECIFICATIONS PUBLIC IMPROVEMENTS
Whittaker said the developer discussed an escrow account for plans and
specifications. This is not completed and will be presented at the

timetable for the completion of this project.
LEASE FOR LIQUOR STORE * 2
Haugen asked Gagne and Stover if they were satisfied with this
agreement.
Gagne said the agreement is for rent only and is satisfactory.
Stover moved, Gagne seconded, to approve the Lease Amendment for
Liquor Store * 2 in Shorewood.

PARK PLANNER'S REPORT
BIDS FOR IRRIGATION
RESOLUTION NO. 101-90
Park Planner Koegler, said the bids received for the irrigation
project were very favorable. He recommended awarding the project to
Showcase Landscape. They had the lowest bid and also the lowest on
the alternate bid. The total cost will be slightly over the budget,
but he recommends accepting the alternate as the price is so low.
Watten moved, Gagne seconded, to Adopt RESOLUTION NO. 101-90. "A
Resolution awarding the bid for the Freeman Park Irrigation Project to
Showcase Landscape."
Motion carried - 5/0 on a roll call vote.
UPDATE ON LITTLE LEAGUE FIELD
Koegler said the Tonka Men's Club has hired Perkins Landscaping to
grade and seed the site for the Little League Field in Freeman Park.
He had no objection to their choice. The grading will be done this
week and the seeding by the 15th of September.
Whittaker asked if Koegler would be observing. He said he would.

CITY PLANNER'S REPORT
A. Traffic control on Radisson and Covington Roads
Discussed previously.
B. Review Park Dedication Fees.
ORDINANCE NO. 231
Froberg explained this is amends Section 1207.07 of the City
Code, changing the park dedication fees for new lots.
Haugen explained the park dedication fee.
Watten asked if this fee is for maintenance. If there is a
referendum, should this fee remain at $750. He felt it is
double funding.

Haugen said it is for capital improvements.
Andrus said it would be for land purchases or capital
improvement.
Nielsen said it cannot be used for maintenance.
Whittaker said the Park Capital Improvement Plan anticipates
the use of dedication fees as part of the plan. Existing park
lands and improvements have been paid for by current lot
owners and taxpayers.
Gagne moved, Brancel seconded, to adopt ORDINANCE NO. 231.
"An Ordinance amending Chapter 1207.of the Shorewood City
Code Relating to Subdivision Regulation", to increase the
Park Dedication Fees to $750 per lot.
Motion carried - 5/0 on a roll call vote.

Policy on Grant-Lorenz Drainage

Nielsen said the City has received a petition
requesting that the drainageway between Smithtown
Road and Grant Lorenz Rd. be cleaned out to
restore and enhance drainage through the area.
The staff recommends that the Council authorize the
City Engineer to prepare a preliminary report addressing
what needs to be done.
Some of the staff's concerns include:
a. When should the City get involved in the clean-up.
b. Cost of legals, survey and easements and who pays
for them.
c. The City will need right-of-entry on the property.
The administrative costs maybe higher than the actual cost
of clean-up.
Gagne felt the payment of costs should be the same as it
is for everyone.
BAYLOM J. LE I FERMAN , 5775 GRANT LORENZ ROAD.
Mr. Leiferman said he was told by the City, 15 years ago
that he could not clean out the ditch. It is 2 1/2 ft.
deep in the creek. He has water in his basement and there
is a strong runoff.
BILL SMITH OF GRANT LORENZ ROAD

Mr. Smith is concerned that the new development on Straw-
berry Lane would increase the runoff in his direction.
He does not want a new drainway installed, just wants to
clean out the ditch. Wants the City to use a little common
sense. He said the school pavement adds to the runoff in
direction.

runoff.
Engineer Norton said there is more to look at than is
stated in the petition.
Watten moved, Brancel seconded, to direct the City Engineer
to prepare a preliminary report and estimate of costs
to clean out the drainage ditch between Smithtown Road and
Grant Lorenz.

ATTORNEY'S REPORT
.
1. AMENDMENT TO DOG ORDINANCE ORDINANCE NO. 232
Shorewood's dog Ordinance contains a provision making
it a nuisance for any dog to bark "excessively,
continuously or untimely."
Edina had a similar Ordinance, which the Court has
declared unconstitutional. The language must be more
definitive for the Ordinance to be upheld. The proposed
Amendment defines the phrase "to bark excessively."
Brancel felt nothing much was done with the barking
dog problem.
The owners just paid the fines, which did not solve the
problem. The police are fed up with the calls.
Froberg said the judge can set fines according to his own
discretion but the prosecuting attorney can advise the judge
that the citizen has had many offenses. Any person can
testify for the filing of a complaint under the provisions
of the amendment.
Stover moved. Gagne seconded. to adopt ORDINANCE NO. 232
"An Ordinance Amending Chapter 701 of the Shorewood City
Code Relating to Dogs.", which defines "barking
excessively".
Motion carried - 4/1 (Watten) on a roll call vote.

Rapid Oil Change
The Rapid Oil people said they would work with the City to
remove the sign. Naegele has refused to remove the sign
and will contact the City, Froberg will contact Naegele
this week and he suggested tabling the revocation of the
C.U.P until he spoke with Naegele.
Gagne said he did not want to get involved in another
lawsuit with Naegele and wants the sign out.
Stover said Rapid Oil should contact Naegele. They are the
ones that have a contract with Naegele. No meaningful
cooperation is possible with Naegele.
Froberg said this is a valid position but he would still like

get the City to continue the C.U.P. Since he now knows the

He said there are other businesses involved in this
C.U.P. Lariat Companies owns the property that Rapid Oil
leases. If Rapid Oil Shuts down. what happens to Video
Update.
Stover asked if the Council can revoke the C.U.P and
authorize a different use of the land. Froberg said yes.
Stover moved. Gagne seconded. to table the revocation of
the C.U.P until the City Attorney talks to Naegele.

ENGINEER'S REPORT
1. CONTINUING INFILTRATION AND INFLOW INSPECTION-VISU SEWER.
Norton said the I & I inspection was the third year of a ten
year inspection plan.
Norton would like authorization to continue the project for
a third year. This would include Howard's Point Road.
Edgewood. East on Smithtown.
Haugen asked how much of the City had been done. Norton said
only 1/3 to 1/2 of the City is done and it should take about
4 to 5 years. The worst areas have been done first.

Engineer to get plans and specifications for the third year
of the I & I Inspection and sewer repair.

dry wells. Camtex - Dry wells have had many accidents.
Wet wells are safer and only need one person to maintain.
Norton will advise the Council about the costs to convert
the wells.
Gagne moved. Stover seconded to authorize the Engineer to get
costs on the sewer lift stations.

3. Update on Cellular One Antennaes.
Ted Broich said the work is finished. Norton said he
notified Broich that they needed a letter from CBI. Broich
said he would get it.
Haugen asked if there was any hazard to aircraft. Norton said
no.
ADMINISTRATOR'S REPORT
1 .
Underground tank removal.
Zdrazil will work with the PCA to remove the tanks. One
must be removed by spring. The PCA will reimburse the
City for soil removal but this takes time.
Watten moved. Gagne seconded. to instruct the Administator
to proceed with the tank removal.

2. Fall Milfoil Inspection. Christmas Lake.
Whittaker said treatment of Milfoil cannot be done now.
It would be better to wait until spring. DNR will only
do initial treatment. not comprehensive inspection.
Bob Rascop said milfoil harvesting has stopped on Minnetonka.
Corp of Engineers will not help.
The LMCD is still presenting their Comprehensive Plan.
Some Cities are still resistant to the Plan. At this time
Minnetonka may withhold their contribution to the LMCD budget
because they object to the Plan.
Stover suggested the City start the milfoil inspection early
in the spring.
3. Policy on remembrances.
Watten moved. Gagne seconded. to approve the Administrator's
recommendation for a Policy on Remembrances.

5. Review Special Taxing Districts
Whittaker said the City must establish a Special
Taxing District to pay for drainage improvements with
an Ad Valorem Tax.
6. Reschedule Hearing on Shady Hills
RESOLUTION 103-90
The Public Hearing notice was not published by the paper
even though it was sent to the paper when Glen Road was.
Gagne moved. Watten seconded. to Adopt RESOLUTION NO. 103-90.
IIA Resolution Setting a Public Hearing to Consider a Special
Taxing District. II rescheduling the Public Hearing on the
Ordinance for Shady Hills to Oct. 8. 1990 at 8:00 P.M.

COUNCIL REPORTS
Stover said Excelsior has been contacted regarding the Excelsior Apt.
dumping of trash and they have responded many times. They have
cleaned up.
Brancel said she has not received the list of Freeman Park Expenses
that she requested on June 7th.
Watten said he wanted to thank Councilmember Gagne for sitting in at
Park Commission meetings for him.
