C. REVIEW AGENDA
Administrator Hurm asked that item 3C of the Consent Agenda be
changed to a Motion to Deny an Extension on Notice to Remove for
Scott Gysland. He also asked that item 3G and 3H be pulled from
the Consent Agenda for discussion.

2. APPROVAL OF MINUTES
A. City Council Meeting - September 9, 1991
Gagne moved, Stover seconded to approve the City Council Minutes of
September 9. 1991 with the following corrections:
1. Pg. 9 - Gagne said he would like to see the City mail a
calendar of holiday recycling pick-ups to each resident.
2. Pg. 11 - item C - Councilmember Stover - Stover said she
received a letter from the Deephaven Mayor concerning the
division of costs by the Excelsior Fire Department.

I. Motion to Adopt RESOLUTION NO. 102-91 "A Resolution Approving the
Revised Concept Plan for Gideon's Cove P.U.D."
Consent Agenda item G - Resolution Setting a Public Hearing for
Special Assessments of Church Road Improvements.
City Engineer Dresel informed the Council that not all the residents of
Church Road have granted easements for the construction project.
He said the bid was awarded to Widmer construction during the summer and
there is not enough time left to start the project before winter.

Gagne asked how many residents want the project.

Gagne asked how many residents want the project.
Dresel said he has held meetings with the neighbors and there are eleven
who want the project and one that does not.
Daugherty asked if the time has expired on the bid from Widmer.
Dresel said the bid has already expired. He said the project can be bid
again in the winter.
Dresel told the Council they may have to condemn the land for the
easements.
Councilmember Stover asked how long the condemnation process takes and
how much will it cost.
Dresel said the process takes 90 days and the costs are negotiated with
the resident.
Stover said this additional cost will be added to the cost of the
project.
Gagne said, because of the delay, the street will flood again in the
spring.
ORDINANCE NO. 244
4. ORDINANCE ESTABLISHING A SENIOR HOUSING COMMITTEE
Brancel read the purpose of the Senior Housing Task Force.
Administrator Hurm added minor changes to the Ordinance.

A.
Subd. 2 Meetings: The Task Force shall meet monthly or at
the call of the chair, and all meetings shall be open to the
public.
B. SUNSET CLAUSE - Unless sooner completed the duties of the Task
Force shall be completed and the Task Force disbanded by
31 December 1993.
Stover moved, Gagne seconded to adopt ORDINANCE NO. 244 "An Ordinance
Amending Title 200 of the Shorewood City Code Establishing a Senior
Housing and Services Task Force. II
Motion carried - 5/0.
Stover asked Hurm if he will be contacting the previous Senior Housing
Task Force to serve on the new Task Force.
Hurm said he will do what the Council wants.
Gagne said the positions should be open to everyone in Shorewood who
qualifies. The Council agreed.

REVIEW LANDSCAPE PLANS - EXCELSIOR COVENANT CHURCH

Planner Nielsen explained that the Excelsior Covenant Church was
granted a C.U.P. to build an addition to the Church. However,
the C.U.P. was contingent upon their submitting a landscape plan
for approval by the City Council.
Nielsen said his staff report recommended landscaping on the north
and west sides of the site.
He said he talked with Jim Vol ling, Chairman of the Excelsior
Covenant Church Building Committee and they propose to transplant
arborvitae from the front of the church to the north and west
sides. Nielsen said this would be consistent with the landscape
plan.
Jim Vol ling - addressed the Council and told them he disagrees with
Nielsen's report. He said the west side of the church is adjacent
to a heavily wooded lot and this screens the west side.
Nielsen said the lot has deciduous trees and there will be no cover
in the winter.
Brancel said she thought someone had tried to develop the lot next
to the church.
Nielsen said yes, there was a proposal to develop the lot at one
time and it is zoned two family, residential. He said there is a
gap between the woods and the church and tranplanting arborvitae
will fill the gap and not as many will be needed.

Daugherty said he drove by the church and thought the northwest
side of the church needed more screening than the west side.
Councilmember Lewis asked Nielsen if he had come to an agreement
with Vol ling. Nielsen said Vol ling will transplant the trees to
the west side if he has to.
Lewis asked how many trees will be needed for the buffer. Nielsen
suggested six.
Brancel said the Council cannot make decisions based on financial
hardship.
Lewis said it should be possible to satisfy the C.U.P. with
existing material and not have to have an added expense. He
suggested planting half the existing trees to the west and half to
the north of the church.
Lewis moved, Daugherty seconded to approve the landscape plan of
Excelsior Covenant Church and transplant 4 existing trees from the front
of the church to the west side and 4 existing trees to the northwest
side.
Motion carried - 3/2 (Gagne, Brancel)
6. COMMISSION REPORTS:
A. Planning Commission

Stover said there was no Planning Commission meeting.

B.
Park Commission
Steve Dzurak reported to the Council from the Park Commission.
1. He said the Snowmobile Ordinance was not discussed at the last
Park Commission meeting. The Commission is awaiting language
from Police Chief Young to incorporate into the Ordinance.
They expect to finalize the Ordinance by the Oct. 8 meeting.
Dzurak said enforcement of an Ordinance is important and the
Commission would like to see a volunteer patrol established
under the administration of the Chief of Police and City
Administrator.
2. The fee schedule for the use of Park facilities will be
finalized at the Oct. 8th meeting.
3. The Park Commission will hold a meeting with area businesses
to discuss volunteer opportunities in the Shorewood Park
System.

MATTERS FROM THE FLOOR.

CHARLES THOMPSON - 5260 ST. ALBANS BAY RD. asked the Council for a
30 day extension of time to file the final plat of his subdivision.
He said the signing of some paperwork is being delayed.
City Attorney Sellergren said the Council can grant ~ 30 day
extension.
Gagne moved. Stover seconded to grant a 30 day extension for the filing
of a final plat to Charles Thompson.
Motion carried - 5/0
LEROY KRAMER - asked about his 30 day extension. Brancel said it
was granted. Kramer asked if he could get a 60 day extension to
remove an old car.
Brancel said they usually grant only 30 days for an extension.

ADMINISTRATOR'S REPORT
1. Report on Excelsior Fire Department Formula.
Hurm said the Excelsior Fire Department is gathering
information about the formula used to determine cost
basis for each City and will make a presentation to the
Council.
2. Resident Letter Requesting Signage in the Covington/Vine Ridge
Area.
Hurm said "Slow - Children at Play" signs were requested in
Shorewood Oaks and have been requested by the Covington/Vine
Ridge Homeowners Association. He said Mn/Dot does not approve
of these signs because they give a false sense of security and
are ineffective.
Hurm suggested the Council request more Police patrol in these
two areas.
He said a sign has been placed at Covington Road directing
traffic away from Covington Court.
3.
Update on Speed Study - Shorewood Oaks Drive/Oak Leaf Trail.
Hurm said Mn/Dot has completed it's speed study of Shorewood
Oaks Drive and does not recommend lowering the speed limit.
However, they recommend the installation of two "turn ahead"
arrow signs.
He said speed limit signs have been installed as directed by
the Council.
He said the residents of Shorewood Oaks want to talk to
the Council at the next meeting.
Gagne said there are a lot of children in the Shorewood Oaks
neighborhood.
Daugherty said additional patrol in the Covington and
Shorewood Oaks neighborhoods should be added.
Steve Dzurak said he lives on Vine Ridge and that most of the
speeding problems are from non-residents. He said more police
patrol would help the problem.
Stover moved. Gagne seconded to request increased Police patrol in the
Shorewood Oaks and Covington/Vine Ridge and send a report to the City
Counci 1.

Policy on Cost Reimbursement for Citizen Request for Minutes,
Agendas and Documents.
Hurm said a lot of time and money is spent copying and mailing
agendas and minutes of City Council meetings.

He suggested the following policy regarding distribution of
agendas and minutes.
1. Agendas: $35.00 per year or 25 cents per page.
2. Minutes (After City Council Approval): $75.00 per year
or 25 cents per page.
Daugherty moved. Lewis seconded to approve the policy on cost
reimbursement for Minutes. Agendas and Documents.

A presentation by Judith Marshik concerning a public opinion
poll.
Discussion of R& W Roll Off - concerning fall clean-up.
The Council agreed to hold these discussions at the 7:00 P.M. meeting.
Finance Director Rolek informed the Council that he asked Springsted,
Inc. if the bond issue should be lowered because the Church Road project
is delayed. Springsted advised against this. They said the cost of
issuing a separate bond for the Church Road project will be higher. In
addition, the interest rates are currently at a low point.
Gagne asked what will happen if the Church Road project is not done.
Hurm and Rolek said the money could be used for other projects.
Sellergren said the City may not be able to use the money, it depends on
how the bond is structured.
COUNCIL REPORTS.
A. MAYOR BRANCEL
1. Report on Prosecuting Attorney Selection Committee.
Brancel said the Committee will interview the following
attorneys on October 2, 1991:
A. Kenneth Potts
B. William Henney
C. Greg Keller
D. George Hoff
Stover asked if a decision will be made on Oct. 2.
Daugherty asked Hurm how much money the City will save on
prosecutions.
Hurm said the City may pay under $20,000 per year. The
formula will be divided among the four cities, similar to
the Police Department formula. Shorewood will pay a lump
sum only for it's own prosecutions.

Request for City Flag
Brancel said the North American Vexillological Association
is holding a convention in Minneapolis Oct. 11,12,13 and Mayor
Don Fraser has asked for Shorewood's flag.
Gagne moved. Lewis seconded to send the City flag to the Vexillological
Society convention in Minneapolis.
Motion carried - 4/1 (Stover)
3. Parade of Homes Resident Sign Request - Christmas Lake Road.
Brancel presented pictures of the parking along Christmas
Lake Road during the Parade of Homes. She said there have
been numerous complaints. She said the Council should
consider the parking problem for next year's Parade of
Homes and restrict the parking on substandard streets.
Brancel and Hurm said the motion to allow parking for the
Parade of Homes did not specify parking on only one side of
the street. They sent a clarifying letter to the developer.

He had no report.
C.
COUNCILMEMBER STOVER
Stover asked Hurm if the staff routinely sends follow up letters
to individuals who have applied for positions within the City.
Hurm said yes. She also asked if the Finance Board had received
letters. Hurm said yes.
Stover also asked if meetings can be held on Nov. 5, Election Day.
Hurm said the City can have meetings because Shorewood has no
elections.

He had no report.
E. COUNCILMEMBER DAUGHERTY
He had no report.
The Council reviewed a list of meetings through the end of the year and
decided to cancel the meetings on Nov. 11 and Dec. 23, 1991.
