102003 CC WS Min . . . , .. . CITY OF SHOREWOOD CITY COUNCIL WORK SESSION MONDAY, OCTOBER 20, 2003 5755 COUNTRY CLUB ROAD COUNCIL CHAMBERS 7:00 P.M. MINUTES 1. CONVENE WORK SESSION MEETING Mayor Love called the meeting to order at 7:00 P.M. A. Roll Call Present: Mayor Love; Councilmembers Lizee, Turgeon, and Zerby; Administrator Dawson; Attorney Keane; Deputy Clerk Panchyshyn; Engineer Brown; Finance Director Burton; and Planning Director Nielsen Absent: Councilmember Garfunkel B. Review Agenda Without objection from Council and Staff, Mayor Love proceeded with the Agenda for the evening. 2. SHOREWOOD CITY CODE RECODIFICATION REVIEW Administrator Dawson explained the City Council had authorized contractual legal review and recodification of the City Code Book in May of 2002. The process for recodification was entering its second phase, which included review of editorial and legal reports submitted by American Legal Publishing and Duke Addicks, League of Minnesota Cities' Codification Attorney. Introductions were made by all parties present. Mr. Addicks reviewed his career history, noting he had worked with more than eighty cities in the recodification process. He explained to Council the process to be utilized in the review of suggested changes for recodification, and noted it was not the time to rewrite ordinances in the code, but rather to consider if suggested changes would be helpful in providing clarity to residents. Council reviewed suggested changes regarding consistent language to be utilized throughout the Code Book. Mr. Addicks also explained laws and rules may not be adopted by reference without verbiage that appropriately provided updates as laws and rules change. A brief discussion ensued regarding the legality of enforcing resolutions versus amending ordinances related to fees. Mr. Addicks went on to explain issues pertaining to General Provisions in the Code; as well as Administrative Penalties found in Chapters 101 to 104. Changes were suggested for Sections 105.05, 109.01 and 109.02, 201.05 and 201.06, and 204.01. Suggested changes were also heard regarding Chapters 305, 307, 310, 312, 401, 403,502,507,600, 701, 702,801,903, and 904. The following Chapters were suggested for deletion: 108, 203, 205, 502.02, 504, 506, and 509. Administrator Dawson noted Chapter 903 had been replaced by Ordinance No. 395 in July of this year. , . . . " . CITY COUNCIL WORK SESSION MEETING MINUTES October 20, 2003 Page 2 of2 The following Chapters were to be reviewed by Attorney Keane for additional suggestions: 301, 308, 502, and 503. Director Nielsen also would review Chapter 508 for further suggested changes. It was suggested Chapter 501 be removed or merged with Chapter 502. Many Chapters being considered for removal were also to be held in reserve for potential future use. Council briefly discussed issues related to inspections, harbor limits, curfew, and a fee schedule adoption process. More discussion was needed on all topics, and a second Work Session Meeting was scheduled for November 3,2003, at 7:00 P.M. to fulther discuss recodification issues. 3.
