CONVENE CITY COUNCIL WORK SESSION

Mayor Zerby called the meeting to order at 6:00 P.M.
A. Roll Call
Present. Mayor Zerby; Councilmembers Johnson, Labadie Siakel, and Sundberg; City
Administrator Lerud; Planning Director Darling; Director of Public Works Brown; City
Attorney Keane, and Engineer Fauske
Absent. Council member Sundberg
B. Review Agenda
Johnson moved, Labadie seconded, approving the agenda as presented. Motion passed 4/0.
2. RIGHT OF WAY ORDINANCE
Administrator Lerud said following approval of the small cell wireless Legislation passed during the last
Legislative session, the city was going to be required to update its right of way ordinance to reflect those
statutory requirements. Upon reviewing the code, it became obvious that the entire code was in need of
review and updating. He said that Brown, Keane, Fauske, Darling and he met on a regular basis since
June and the draft ordinance before you is a result of those discussions.
Council member Sundberg arrived at 6:03.
Lerud said the update process was guided by three primary principals:
1. Rights -of -way and other public ground owned by the City of Shorewood are an asset of the city
and must be proactively managed on that basis.
2. Controlling access and establishing rules that can be enforced for the use of the rights -of -way by
utilities and other users.
3. Establishing regulations for the preservation and restoration of the rights -of -way by utility and
other uses is central to protecting the city's investment.
Lerud said that he would like to go through the ordinance page by page at this meeting, and answer
questions the council has as well as hearing suggested changes. He said staff would then go back and
make changes to the draft, and present it at the January 22 council meeting for consideration.
Through the discussion about the draft ordinance, the city council raised matters and questions that need
to be resolved in the final draft: Does the city have the authority to charge additional fees to right of way
users who regularly use the rights of way but do not have a franchise? Could solar panels be required to
power the small cell wireless equipment? Can the city require screening or other "disguising" of small

cell wireless equipment? Is there a way that permit information can be made available to others or
publicly made available?
The discussion of Item 2 concluded at 6:50 P.M.
Mayor Zerby announced that Council was going to address Item 3 on the agenda in the large conference
room.
3. PLANNING COMMISSION INTERVIEW
Council interviewed Todd Eggenberger, 6105 Chestnut Terrace, for consideration of appointment to the
Planning Commission for a three -year term.
4. ADJOURN
Siakel moved, Labadie seconded, Adjourning the January 8, 2018 City Council Work Session at
7:00 P.M. Motion passed 510.
