CALL TO ORDER:
Chairperson Goettelman called the regular Park Commission meeting to order at
7:39 P.M. on Monday, December 7, 1981.
ROLL CALL
Present: Gary Carl, Carol Chapman, Gordon Lindstrom, Bob Nygaard, Conrad Schmid,
Roger Stein, Don Goettelman; also, Council Liaison Tad Shaw
APPROVAL OF "PARK COMMISSION" MINUTES DATED NOVEMBER 16, 1981
Lindstrom moved, Stein seconded, that the Park Commission minutes dated Monday,
November 16, 1981 be approved as written. Motion carried 7 -0.
DORSEY SMITH'S OLD FASHIONED CONCESSIONS
Mr. Dorsey Smith petitioned the Park Commission to use his Concessionaire truck
on Shorewood's City parks during the hockey season.
Reference was made to the fact that it was the Park Commission's intent to prevent
the usage of City Park facilities for personal or group profit or gain (See
Ordinance No. 91 and the "Park Facility Usage Plan" attached to the Park Commission
minutes dated May 4, 1981).
• It is possible that Mr. Smith's Concessionaire could be handled by contract
through the applicable athletic association (in this case Minnetonka Youth Hockey
Association) and arrangements made with them and their contractural agreements with
the City.
Smith commented as follows: He is willing to give 10 per cent of the GROSS profit,
not the NET profit, to the City. Anytime a bona -fide organization comes in and
wants to earn money for their own equipment, repairs, and benefit, he would not
show up so as not to interfere; however, he would like sufficient notice to enable
him to plan otherwise. Hennepin County had informed him that he has a "public
service" rather than a "private service." The 10 per cent gross could go towards
maintenance of the hockey rinks.
Upon further discussion, there is a building on Badger Park that could be used for
concessions. Smith offered to manage the concessionaire at that site and leave his
truck at home. However, he would want to do the buying of everything; he prefers
the City pay the insurance on the building and he would pay the insurance on every-
thing else. The building has electrical outlets, bathrooms, washroom, hot and cold
water, and a window for serving. Yet, that facility would have to be licensed and
there is not enough time to have it licensed as the hockey season is too close.
This should be pursued during the off season.
Goettelman'suggested'Smith contract on a year - -to -year basis to supply a public
service on 10 per cent of the gross to all facilities rather than just with the
hockey association, and for other non - profit organizations who want to use the
concessionaire as a profitable tool for their organization. Ten percent of the
gross could go to the City.

A sample Agreement between the City of Excelsior and the Rosencrantz's Concess-
ionaire was looked at by the Park Commission. Upon discussion, it was generally
agreed that "net profit" should be changed to "gross profit" and "Commons" to
"Parks."
Lindstrom moved, Chapman seconded, that we recommend to the City Council acceptance
and approval of the request by Mr. Smith to operate a Concession stand on a trial
basis for the hockey season, subject to review next year. Further, if Mr. Smith
is not to show up for any particular event, he should be given five (5) days'
notice prior to the start of the event. The Concession stand is not to be operated
during organized events unless requested to do so by the Director of the particular
event. Motion carried with 6 ayes and 1 nay (Carl).
TOM MUEHLBERG - SECOND ANNUAL SHOREWOOD INVITATIONAL HOCKEY TOURNAMENT
- February 5, 6, and 7, 1982
Mr. Tom Muehlberg asked permission of the Park Commission to hold the Second
Annual Shorewood Invitational Hockey Tournament on February 5, 6, and 7, 1982
(Friday through Sunday).
Carl moved, Schmid seconded, that we approve the Second Annual Shorewood Invitational
Hockey Tournament under the same terms and conditions as for 1981 (See Park
Commission minutes dated Monday, January 19, 1981, pp 2 and 3, and Council minutes
dated Monday, January 26, 1981, p. 3.) However, Badger, Cathcart, and Freeman Parks
• will all be used because three groups — Bantam, Peewees, Squirts --will be playing.
Motion carried 7-0.
Muehlberg is interested in the Concessionaire and is to contact Mr. Smith.
FREEMAN PARK
Arne Bronken, Northwest Associated Consultants
Ms. Bronkken presented a preliminary Concept Plan for Freeman Park to the Park
Commission for discussion. She will prepare a combination of sketches and show
them to the Park Commission in January, 1982 for further discussion.
REPORTS
—Carl reported from the Council meeting that some land might be donated to the
Park Commission in lieu of payment of $500 per lot. The Park Commission would
want to look at the land first.
=The Council agreed to let the Babe Ruth shed stay put on the Freeman Park field.
Due to budget cuts, several outbuildings are going; the various organizations
could help share the expenses.
= =The Council agreed to let the Southwest Trail Association Sno- Skippers mark the
snowmobile trails in Shorewood; further, the Council will ask the Hennepin County
Rail Authority to allow the marking for snowmobiling and cross - country skiiing
only, and to monitor the currently vacated rail line.
OTHER MATTERS
Roger Stein said he would continue on the Park Commission.
that officers will be elected on Monday, December 21, 1981.
