FREEMAN PARK - 6:00 PM - Chairman Schmid, Commissioner's Vogel, Lindstrom and
Laberee; and Council Liaison Shaw visited Freeman Park to look at Various concerns.
CALL TO ORDER
Chairman Schmid called the regular meeting to order at 7:00 PM.
ROLL CALL
Present: Chairman: Schmid Commissioners Linustrom,Vogel, Laberee and Jakel (7:35);
Council Liaison Shaw and Park Assistant NIccum.
PLEDGE OF ALLEGIANCE
Chairman Schmid led those present in the Pledge of Allegiance.
APPROVAL OF MINUTES
Vogel moved, Lindstrom, seconded, to approve the minutes of Monday, August 18th,
and Monday, September 16th, as written. Motion carried unanimously.
APPLICANT DISCUSSION SESSION
Mr. James D. Andrus of 4971 Kensington Gate had a previous out of town commitment.
Staff will write a letter unviting him to the meeting of Monday, October 20th.
• Mr. Gordon Christensen of 26190 Birch Bluff Road was present at the meeting.
The Commission acquainted him with the various parks and gave him a copy of
Report No.5 of the comprehensive plan, "Parks and Open Space detailed Facilities
Plan ". Mr. Christensen complimented the Park Commission on the way they dealt
with the Snowmobile Ordinance. He also said he'd hate to see the Commission get
so bogged down in daily problems that the long range plan would be ignored.
BADGER FIELD UPDATE /MANOR PARK UPDATE
The Commission went over the letter to City Attorney Froberg from Daniel E. Polin,
representing Aspen Excavating. The Commission felt that paragraph 4 relating
to Zdrazil was misleading and untrue.
Staff informed them that Attorney Froberg is setting up a meeting with Aspen's
Attorney and that Attorney Froberg, Public Works Director Zdrazil, Administrator
Vogt, and possibly herself would be present. Chairman Schmid said he would
like to attend the meeting.
The Commission feels that the "Jurgens -Aspen relationship" should be discussed at
the meeting. They also said it would be nice to be able to sue Aspen for punitive
damages. They do realize the legal cost involved and that it can only be carried
so far but are angry about the trouble caused.
Commissioner Laberee has talked to Don Wagner of "Don's Sod Service ". He said
there were only about two weeks when he could seed and it was too wet. Now he
wants to wait until there isn't any chance of the seed germinating this year.
The prject will take 2/3 days. Chairman Schmid asked Commissioner Laberee to
have Mr. Wagner call Sue. He can explain to her when he will visit Manor to
give an estimate and when he plans to do Badger field.

SILVERWOOD PARK The Commission wondered when the grading plan would be done.
41 Staff said it probably would be done sometine this winter.
CATHCART PARK - SNOWBLOWER STORAG
Permission has been given to store the snowblower in the storage shed now existing
in Cathcart Park.
FREEMAN PARK
Plum Tree
Mr. John Levering's request to dig a small wild plum tree sapling out of the
Park to pollinate his existing trees was turned down. They felt it would
set precedence. They also discussed the fact that the City would be liable
if something happened while the tree was being removed.
Staff will write him a letter informing him of the Commission's decision.
Commissioner Laberee, who has expertise in this area stated Mr. Levering
would get a better tree, probably for around $10.00, at a place that sells
the saplings. This information will be passed on to Mr. Levering.
FILL STORAGE LOCATION /FREEMAN PARK
Chairman Schmid, Commissioner's Vogel, Lindstrom and Laberee; and Council Liaison
Shaw visited Freeman Park to look at the fill. The Commissioners present were
disatisfied with the location where the fill was dumped and asked that Engineer
Norton be informed of this. They asked if there is a grading plan of Freeman
• Park on paper and asked staff to check on it.
The Park Commission would like to be consulted before any more fill is dumped in
the Parks. The Commission asked that Administrator Vogt, Planner Nielsen,
Engineer Norton, and Public Works Director Zdrazil be notifed that the topsoil
should be scraped off before any dumping is done unless top soil is being hauled
in.
The Commission would like to see the berm shaped this fall, to prevent breeding
of mosquitoes in the "pockets ", to prevent injury, and to improve the appearance.
ROAD COST AND BLACKTOP FILL /FREEMAN PARK
The Commission discussed who should be responsible for the cost of contracting
a backhoe to dig out the proposed road to bury the blacktop fill. They would
like to have it done as soon as possible because it is an eyesore and a hazard,
also there is not any room left to dump any more fill, Chairman Schmid said
he feel's the parks have been utilized, land taken, and he doesn't feel parks
should have to pay. He questioned how much money was saved on the project by
using Freeman Park for dumping. The minutes of April 7, 1986 state: "The Park
Commission feels that subcutting the road and parking lot and the expense of
hauling fill should be paid for by the street department, and that the park
department should pay for the gravel." The Park Commission still feels the same.
After discussing the issue at length Commissioner Schmid suggested meeting with
Administrator Vogt and.clarifying the above issues. Staff will talk to Administrator
Vogt and try to set up a meeting.

Council Liaison Shaw said the 1987 Budget was tentatively approved.

years proposed use.

MEMORANDUM

RE: FREEMAN PARK — FILL LOCATION AND ROAD EXPENSE
On Tuesday, October 7th, 1986, the following people were present at
a meeting to discuss the above:

FILL LOCATION
Park Commission Chairman Schmid and Park Commissioner Lindstrom said
the Park Commission (except Jakel) had gone out to Freeman and looked
at the fill. They did not like the location.
Administrator Vogt and Planner Nielsen explained that the opportunity
to receive the fill came up unexpectedly and a snap decision had to
be made. Engineer Norton had talked to the contractor about the type
of fill to be received, using this as a basis he looked at the grading
plan and decided the fill was suitable for one of the proposed berms
but may not be suitable for a ballfield. Planner Nielsen then had
staff contact both the Council and the Park Commission for feedback.
Due to Park Commission feedback he had the blacktop separated to use
that fill for the proposed road. Both Administrator Vogt and Planner
Nielsen felt that they were doing the Park Commission a favor by
bringing in fill for the park.
• Commissioner Lindstrom mentioned that they would like to have had
the topsoil scraped off before the fill was dumped. Planner Nielsen
said that in this particular instance there was no time to do so.

16 Administrator Vogt and Planner Nielsen discussed the possibility of
future fill and said they would try, when these projects come up in
the future, to find out if fill will be available and let the Park
Commission know so that they will have time to take the proper steps,
such as planning where to use the fill and putting the excavating
up for bids. Hopefully, this will prevent future problems. Every—
one appeared to agree on this way of handling future fill situations.
Park Commissioner Lindstrom said they would like to grade the berm
this fall. Planner Nielsen asked if they wanted to move the berm
and scrape off the topsoil. Lindstrom and Schmid did not feel that
this was necessary.
ROAD EXPENSE
There was a controversy here on who is benefiting whom? Was the City
benefiting the Park Commission by providing fill for the parks? Or
was the Park Commission benefiting the City by providing them with
a dumping ground for the fill from the road?
Administrator Vogt explained that the contractor would have hauled
the fill to his farm in Chanhassen and that he was not sure that the
City benefited financially at all by the way things were done.
Those present discussed, with Public Works Director Zdrazil, what
had happened with the proposal to have Volk Excavating dig out the
road and push in the blacktop:..fill ' for `a price of $600. Zdrazil
said he tried several times to get an answer from Volk and could not
get a commitment. Schmid and Lindstrom said the Park Commission would
not quibble over a $1,000. expenditure on the road.
After much discussion Administrator Vogt reviewed the Public Work's
Maintenance Department Budget and felt that the expense involved in
digging out a 24' road and pushing in the blacktop fill could come
out of this fund. Everyone felt this was a good way to resolve the
issue.
Zdrazil said the blacktop fill could be broken down to appropriate
size before being used as fill.
Zdrazil will try 'to obtain quotes to do the work on the road as well
as grading the fill in the berm area. When the prices are received,
the Park Commission will be asked to review and make a recommendation
to the City Council.
