the Shorewood Village Planning Oommission met at 8;00 P.M. in the Men's
Lounge of the Mlnnewashta school with t.he following members present;
H. G. Aldritt, D. N. Borgen, Mrs. R. J. Good~n, R. D. Handy, J. B. Janyrin,
Geo. L.s.t.terner, P. A. Skjenold. the lHeting was oalled to order by our
teaporarychairma.n, Donald N. Borgen, who opened the meeting by stating
three itelDs of business to be oonsidered.
1. Select tlme and place for meetings
2. Slect permanent. officers
}. Discuss zoning of Lots 10, 11, 12, l}, 14, 15 and part
of Lot "'+ of' t.he Oak Hill Addition being considered for
a Phillips 66 service station and a restaurant.
Joseph B. Janvrin was elect.ed chairman and Mrs. Roger Goodman secret.ary.
It wa.s decided that all recotYllnendations of the Shorewoodvi11age Planning
001lllll1ss10n be presented to the Shorewood Village Council showing a yote
count with the comments of the affirmative and negat.ive stdes accompanying.
Mr. Latterner said he had been asked to submit an absentee vote against
commercial zoning of the proposed Phillips sight for Mr. Haralson.
t4r. Aldritt opened the discussion regarding re-zoning of the property
described above by outlining the lot lines on an aerial phot.o. He also
sketched the proposed changes for us. tir. Aldritt said he felt this
property was valueless unless zoned colllltlercial. Mr. Handy agreed and
moved that the planning commission recommend to the village council that
this property be zoned commercial. I-fra. Goodman seconded..
A discussion and question period followed. Mr. tatterner said he worked
at the same place aa Mr. Stark, whose property immediately adjoins the
proposed commercial sight, and that i"r. Stark is not in favor of the re-
zoning. Mr. Stark's property is in Excelsior village. 'The other pro?erty
surrounding the area includes Dr. Ostergren's dental office and residence,
Dr. 3eifert's clinio and a servic€'lstation whlch is across Water st. All
in Exoelsior village. ltrs. Goodman said that the corner 18 a natural
extension of the Excelsior business distriot and that the Minnesota State
Highway Department, rather than Shorewood village, deoreed the change trom
desirable residential to commercial type property when the new Highway 7
was routed. Mr. Aldritt said that he felt Mr. Stark could profit more
trom commercial zoning of his property t.han as residential and inasmuch as
the Excelsior business distriot has been steadily moving south along Water
St. towards Highway 7 it is only a matter of time until his property 18
also zoned commercial.
Mr. Skjervold raised the following questions. W~ couldn't a house ba built
on the Shorewood property in question~ other homes have been buH 1. on
Highway 7. Is t.here any real need for any cOll\lIerclal properly in Shorewoodt
Mr. Latterner felt that some commeroialization would be desirable for

Goodman mentioned the upcoming population growth as a oompelling force
to determine a planned oommercial area in our village.
Kr. Skjervold said that the population. growth was t.he c01'llpe1l1n.g reasOll
tor his ohjection to any oom:nercialization. exoept in isolated eases, thus
protecting present and future residents tram changes in the status of t.heir
property.
Mr. Borgen said that he felt th18 instance was an isolated case which
demanded commercial zoning. Set.h Mr. Borgen and Mr. Skjervold said that
the increase in village inceme from the taxes would be so minute that it
wouldn't be not10eaole. Mr. Borgen mentioned t.hat no amount of commercial-
izat.ion in our village could noticeably reduce residential taxes with the
exc.eption of an industry comparable to t'ifinn$apo1ie Moline in HO!lkins.
Mr. Janvrin rEularked that we build a 4 lane highway to accomrlodate a lot
of traffic moving fast. Then each side of the highway becc1'les eommerclaHzec
and speed limits are reduced to allow for ears entering and turning oft.
Soon the highway i8 not serving its purpose and more land must be acquired
through condemna.tion proceedings to construct. a treeway. So we proeeec in
an increasingly expend ve spiral.
Mr. Janvrin asked for a.ny further comments and t.hen called for a vote on
Mr. Handy's motion. The motion was carried five to two.
Mr. Skjenold moved that the Shorewood Village Planning Commission meet the
first. Monday night of each month at Minnewashta school. Mr. Borgen seconded
and the mot.ion was passed unanimously. Mr. Janvrin advised us all to attend
the pub 1 1c hearing March 19 at rUnnewashta seheel on the Phil lips question
and to meet at the school at 8:00 P.M. April 1 unless he advised us otherwise.
Mr. Borgen moved that we.rite down our ideas regarding the Shorewood zoning
of property along Highway 7 eo that a general statement could be co.Dlposed
by asub-collllllittee to be pres.ented. to the village council within two months.
Mr. Skjervold seconded and the motion passed unanimously.
Mrs. Goodman mentioned that the question of parks and playgrounds should be
discussed at our next meeting.
Mr. Skjervoldmoved that we adjourn and Mr. Janvrin adjourned the meeting.

Planning Commission:
Please note that our next regular meeting will be held at 8:00 P.M" Tuesd~,
April 2nd at the Minnewashta School. It was not possible to arrange for access to
the school building on Monday evening.
The Village Council has requested that we review the enclosed letter and
attachments relative to the proposed Hennepin County park system. There are
two questions which are briefly summarized below:
(1) Should the Shorewood Council adopt resolution A which indicates
support for proposed action by the State Legislature reducing the
regulatory power of county park boards over lakes?
(2) Should the Shorewood Council adopt resolution B urging the Hennepin
County Board to take action to create a. county park district?
In order to expedite c0nsideration of these matters, please study the enclosures
and come to the meeting prepared to discuss them and formulate our views on the
proposals.
Mr. Lloyd Graham, Ivihg in the second house on the east side of old highway 41
south of highway 7, has requested the Village Council to grant him a special use
permit to conduct a repair shop for power lawnmowers and similar equipment on his
residential premises, or, alternatively, to re-zone his property as Commercial.
Will you familiarize yourself with the exact location of Mr. Graham's property
and the surrounding properties and come to the April 2nd meeting prepared to dis-
cuss this matter and reach a conclusion.
Members of the Village Council will attend our April 2nd meeting for the pur-
pose of discussing our recent recommendation regarding the property at the northeast
corner of highway 7 and old highway 41.
While the above items represent quite an agenda, I hope you will each bring to
the meeting at least a rough outline of your proposed plan for the orderly develop-
ment of the properties adjoining highway 7. We should keep in mind that the
Council expects us to recommend a plan of development for the entire Village as
soon as we can reasonably do so.

As you know there bas been discussion over the ~st two year.
of activating a Hennepin County park system under a law J>>.ssed
by the 1955 legislature. There 'i.s general recognition of the need
for setting land aside for eventual development as parks but there
r~ve been some questions as to whether this is the time and the war
to go ahead.
The Lake Minnetonka communities were disturbed about the power
which the county park board would have under th.e 1955 law to regulate
the use of lakes which were not locally regulated. They have organized
the League Qf M.innetonka Munic:i~liti6s to provide local :regulation
of the lake and the League is doing a good job. To eliminate this
questi.on as to the county parkboard1 s power to regulate lake use,
a bill is being sponeored in t,he present legislature by Senator
Archie t:iller and Representatives AIf Bergerud and Leonard Lindquist
which cuts the park boarcis regulatory power over lakes down to lakes
lying wholly wi thin a county ps.rk or to the lakeshore and waterfront
out for not more than 300 feet of park property. This amendment
has the approval of the League of' Hennepin Towns &nd Municipalities,
the League of :rinnetonka Huniclpalities, the Giti:uJns League and the
following village and city councils and town boards.

On the question of activating a Hennep1.n County Park System,
the League of Hennepin Towns and Municipalities studied the question
and concluded that on the a5f3umption that tbe la}(e regulatory problem
w"ill be straight,ened at t.his legislative session, a Hennepin

board. It then appoints the 1irst park b08rti, all in this case from

1. Hennepin County neediS to acquirf: large tracts of land now which are

Chapter 806 laws of Minnesota
The law is of the enabling type au-chorizing the voters 01'
their relected representativea to establish a Park D1strlot
when and if they want to and with such boundaries as the7
want except that each district MUst include parts of several
oounties or OD6 whole oounty, excluding Minneapolis and
Ramsey County in either ease..
Park Districts may be single county (coterminous w1th a
county except for Hennepin where Minneapolis is exoluded)
or multi-county (con-caining parts of more than one coun~).
Counties eligible to form distriots under the law arel
Hennepin, Wright, Carver, Scott, Anoka, Dakota and
Washington.. The establishment of a distriot is ini-clated
by petitions to the oounty board. or boards from 1% ot the
voters or a majority of the oity and village oouncils witb1a
the proposed distriot. The distriot is established by
resolution, single or joint, of the county board or boards,
with or without a referendum and a1'ter publio hearing. The
board or boards may ohoose to submit the question to a
referendum and must do so if 1% of the voters petition ter
t t.. If a refe rendum i8 he ld the board or boards must campl,..
with the outcome.
In single oounty distriots a seven-man park board, appointed
in the first instanoe by the oounty board and eleoted there-
a1'ter, governs the distriot. The oounty is divided into
tour distriots of equal size and one oommissioner 1s
appointed and SUbsequently eleoted from each of the four
distriots. Three oommissioners are appointed and Bubaequcat17
elected at large..
In the multi-oounty distriots the size and make-up ot thfJ
park board is determined by joint resolution but they are
elected, too tatter their first appointment. All oOllDll1saiou-
ere serve tour year staggered terms t are not pa1d and cannot
hold other publio office..
The primary duty of tile boards 1s stated to be ~ot the
es-cablishment of parks and playgrounds of a looal or
neighborhood oharaoter but rather the acquisition, devel~p-
me:nt and maintenance of large parks, torest and other
reservations and wlld lite sanctuaries, and ot means for-
public acoess to historic sites and to lakes, riyerl and
streams and to natural phenomena It.

At the April 16 meeting of the planning commission, several recommendations
for the village oouncil were adopted unaniaously by the nine members present.
As a result of the indefinite information available regarding the Brom's
property, we were unable to reach any conclusive recommend.ation on zoning,
but the following resolution was adopted as a preoedent for all future
zoning cases.
Resolved. That the Shorewood Village Planning Commission refuse consideration
of a zoning request until speoific plans for the development of
the property have been subaitted to the village.
The other recommendations follow.
1. That the village counoil take immediate action on the removal of four
trailers located in the Minnetonka Manor area (violation Ordinance No. 10);
that a general notice be circulated to residences stating that the
constable will impose penalties for improper disposal of garbage and
refuse (violation Section 1 & 2, Ordinance No.6); and that 25 septic
tanks be subjected to corrective work (Mr. Aldritt will give the list
of these 25 to the village clerk).
2. That the village council adopt Resolution A on the parks issue which
would direct the state legislature to reduce the regulatory power of
county park boards over lakes.
;. That the village council reject Resolution B on the parks issue which
urges the Hennepin County board to take action to create a county park
district.
4. That the village council examine the possibility of obtaining lake shore
property for the purpose of establishing a swimming beach.
The first recommendation was the result of a report on routine building
inspection. The second and third evolved from a discussion of the data
released by the Citizens League. Resolution A limits county jurisdiction
to an area in close proximity to the actual park property on a lake shore.
Resolution B would set up an advisory county park commission at considerable
cost with no tangible benefits to our village. The fourth recommendation
was based on Deephaven's request that we find a beach for the use of our
children for swimming instruction.
