REQUEST FOR SIMPLE DIVISION - Roger Lindholm
Approximately ten years ago, Mr. Donald Macklin sold one-thir~ of a three
acre parcel, located at 20025 Vine Street, to Mr. Roger Lindh 1m. Mr. Lind-
holm has recently had the property surveyed and discovered th t the lot was
smaller than an earlier survey had shown. Mr. Macklin has ag eed to give
Mr. Lindholm an additional 23 feet from his southerly parcel 0 make Lind-
holm's lot the size which was originally agreed upon. An 18 oot easement
along the east side of Lindholm's lot provides access to the outherly parcel.
Reese moved, seconded by Leslie, to recommend to the Council, approval of ther
request for a simple division .
Mr. Lindholm was directed to attend the Council meeting, Janu ry 23, 1984.
COVINGTON VINE RIDGE - COMPREHENSIVE PLAN AMENDMENT
The Public Hearing was closed at the December 6th meeting and recommendations
were tabled until further review.
Eric Canton and Richard Sathre were present for the request.
Mr. Canton stated they had made no changes since the last meeting but were
present to address the staff report received in the mail. I
Q. Had the developer considered making any changes based or the staff report?
A. Canton pointed out how the proposed houses fit on 65' atd 67' lots, with a
10' side yard on each side.

Q. How many lots were less than 10,000 feet? I

A. Possibly 10 lots in the core of block 1 area, (center ates) .
Q. Have you considered a secondary access?
A. Developer is willing to address. I

A. Trying to ascertain how to do that. Need direction fro the Council.
Considering cost and feasibility. Hookup to Minnetonka Water seems to be

A. A zero lot line tends to make the structures more similar to one another.
Allowing for variation in architectural design in a tradi ional single
family home people can afford, developing the lots with a normal 10' side
yard, allowing 20' between houses.

A. The Planner went through a number of items in his report, listing aspects
of the project which lend themselves to a Planned Unit De elopment.
Watten: Proposed that if approved, the minimum lot size shou d be 10,000 feet
(not establishing a precedent that can be used in ot er parts of the

would propose a new intersection further west. Vine Hill/Hwyt7 may be
partially or totally closed off in the future. He felt this ould not
hurt business, perhaps even benefit it.

Variance/Parking Lot
Planner Nielsen said there is about 300 feet between the sout line and the
two houses existing on Shady Hills Road, with a lot of vegetation in between.
He did talk to one property owner, Harry Feichtinger, who had no objections
to the variance.
Watten moved, seconded by Leslie, to recommend to Council to approve the variance
request and site plan with Planner Nielsen's recommendations, except that the
apartment shall be considered as a separate issue subject to a co ditional use
permit to be brought back to the Planning Commission for a public hearing.
Motion carried unanimously 5-0.

The four people present, reprepenting Shorewood Oaks, introduced themselves
to the Planning Commission. They were: John Shardlow - Planner; Geoff Martin -
Landscape Architect; Tim Phenpw - Civil Engineer; and Mr. David Johnson - owner.
They informed the Commission that the developers are members of the "Custom
One Builder's Association."

They are proposing 135 lots on, 44 acres of land, allowing 3.6 unilts per
net density. They gave a summary of the material covered in the ~ray
"Shorewood Oaks" booklet.

Mr. Hinkley explained to Commission that his building encroached on a neighbors
property. The neighbor agreed to sell him 15 feet, this will pr<vide the exist-

COMPREHENSIVE PLAN AMENDMENT - TRIVESCO

Mr. John Uban made a presentation for Trivesco. They are proPosifg, on 107 acres,
9 acres of Commercial property, 160 multiple housing units (buffe ing between
commercial and residential), and 93 single family residences on 6 acres, most
lots being over 20,000 square feet. l
On their plan they show a fully developed park. When they talked to the Park
Commission, the Dayton property to the south of Trivesco was disc ssed as a
park area. They are willing to cooperate with this idea. I
They plan a commercial area with a lot of variety,. highly landscated with park-
ing in the back. The idea is to make it look as nice as possible to enhance
the residential use to the south.

They will be working with the engineer on a traffic study, to be ~one by OSM,
in connection with the proposed intersection on State Highway #7.1 They will
try to get a straight answer form the Highway Department, as the ~ntersection
is a major development factor. I
Another major development factor is water. Their preference is
system fully assessed back to the properties served.

along the west edge of the property, then teeing into Covington Rf' ad. ~hey
would like to begin grading the road this fall.

REVIEW PROPOSED ZONING MAP
for a
Planner Nielsen presented a new zoning map for the new zoning ord'nance showing
12 changes. All the changes, except the elimination of the C-2 D strict at
Smithtown Road and Eureka, reflect existing development. Elimina ion of the
C-2 District is based on the Comprehensive Plan which states that the commercial
use in that location is inappropriate and should be phased out.
Jim Heiland of "Heiland's Automotive", 25575 Smithtown Road, requ sted that his
property remain zoned C-2, instead of being changed to R-1A, as p oposed on the
new zoning map. He felt that the change would depreciate hi& pro erty to a
$15,000/$30,000 loss.
Commission discussed the issue at length.
Shaw moved, Watten seconded, to recommend to Council to leave the property at
25575 Smithtown Road zoned Commercial, and to revise the Comprehe sive plan.
Motion carried by RollCall Vote. Shaw, Boyd, Benson, Watten and Leslie - aye,
Reese and Spellman - nay.
Reese moved, seconded by Leslie, to recommend to Council that The R-1D District
allowing 10,000 square foot lots should be incorporated into the ew ordinance.
Motion carried unanimously.
Leslie moved, Boyd seconded, to recommend to Council to accept
map as revised. Motion carried unanimously.

Pla~ner Nielsen explained to the Cq..mmis~ion that he was giving the,' two propose~
ord~nance amendments, to change the zon~ng to C-1 or C-2. He sugg sted C-1 as ~t
would allow less intense commercial activity.

Mr. Peter Boyer asked about the cult-rent zoning (R-4) and what eXistl's across the
street. I
Mr. Bob Pierson, who owns the prop~rty to the north and west, said Ihe would hate
to have it ..turnedinto a storage ar........ea. He is considering bUilding,ffiultiPle units
on his property some time in the future and was concerned about ho it might
affect his project.
Mr. Janicke said they now have onel33' unit that is rented from JuJe 30th through
August 17th. They plan on 3 unitslin 1984, 5 units in 1985, 7uni:s in 1986, with
a maximum of 8 units. He showed th.e Commission the plan for the p rking pads
(all in front) and raising the garage roof.
Commissioner Reese asked Planner Nielsen if they could be held to ~heir plan. The
reply was "yes, under a C.U.P.". I

Reese moved, seconded by Leslie, to recommend to Council that Ordirance No. 77,
Section 23, Subdivision 3, be amended to include open or outdoor sale or rental
as a principal or accessory use under a Conditional Use Permit as shown in the

believed the taxpayers would end up payipg for it. j
Les Anderson of Shady Hills said that prlvate schools usually end p saving the

Signage was discussed. The current sign~ge consists of 2 permanenl signs and one
temporary sign, which exceed the ordinan~e. The current Residenti,l Zoning allows
one illuminated or non-illuminated sign ~ot to exceed 20 square feEt. Reverend
Steuernagel feels that there are three s parate functions within Ole: church,
nursery school, and the elementary schoo,l. It was suggested that 1 his be discussed
in relation to the new Zoning ordinance.1

of lanid are involved, 9 acres of commercial development along Highwjay 7, 160 multiple
family units on 21,8 acres south of the commercial area (to act as la buffer between
the cbmmerc..ial area and the residential area), and 91 single famil~ residential units
on 63.6 acres to the south. The Developer has proposed to develop !the project
throu~h planned unit development zoning. His control of the three ~arcels also gives
him co'....ntrol.as to how the commercial andmultiple hO.U sing will be ~evelo.ped'.SO they
will ~e compatible to his single family homes. They are proposing a new collector
street to t~ke the load off of Vine Hill Road, this would involve new intersection
on Highway 7 in the approximate vicinity of "Brom's Market". The ity of Shorewood
and the developer are working on a traffic study concerning the pr~lposed intersection
at this time. They also propose to aid the residents in Shady Hills by helping to
improve the Shady Hills Road/Vine Hill Road intersection, thus pre enting.the present
flow d..f tra.ffic from Stratford Woods APar.. tments. They wish to wor~ with the residents
of Shady Hills and be as cooperative as possible. They plan on holding more .
neighborhood meetings as they progress. They would prefer to go with a municipal
City water system but no decision has yet been reached.

Mr. Skjervold said "Now weihave the unseemly spectacle of under the guise of
allowing a routine boundary line change they pick up 17 feet. Q ite frankly my
people won't accept that ktnd of thing. I don't know why they s~ould".
Acting Chairman Watten stated that because of the controversy, h~ felt this is a
matter for the City Attorn~y to become involved in. I
Commissioner Leslie asked if there was not a "FOR SALE" sign on ~ract C.
They said it was because t~ey didn't think there would be any pr blem, they would
take it down.

Shorewood Oaks. As a result of the April 3rd meeting, they are ~ow proposing

trail easements to Freeman Park, 2 entrances - State Highway 7 aqd Strawberry
Lane, and a dedication of an additional 17 foot r.o.w. for the f~ture upgrading
of Strawberry Lane. Streets will have a 50 foot r.o.w. and a 30j' foot tarred
surface. The density is 3.03 per acre. a 6' to 8' berm will be located along
the east property line as a buffer between Shorewood Oaks and Fr eman Park.

VARIANCE REQUEST - LAKE SHORE SEI'BACK
Pamela Kizer - 21115 Christmas Lane
Pamela Kizer was present to request a setback variance to build a !Oathouse with-
in the 50 foot setback on Christmas lake. She said the present st rage shed has
been there many years. They would like to replace it because ther is a steep
bank down to the lake, which would involve several difficult tripsleverytime they
want to use the lake, and they would like to keep their possession$ down by the
lake, in a locked building, to prevent theft.
Commissioner Boyd asked if there was any way the building could be set back
farther into the hill. Mrs. Kizer didn't see any problem with that' she just
said the building size would have to be different. They had been ~scussing a
size of 13' x 8' - 10', in order to store a sailboard. I
Mrs. Robert Nevin said she didn't realize it would be so high. I'
Planner Nielsen mentioned that the DNR allows buildings next to th water. Years
ago the City choose to be more restrictive, and passed an ordinanc to that
effect.

Shorewood Subdivision Ordinance.
Prior to the City, signing the development agreement and releasfng the Council
resolution approving the SUb,di, . vision,easem, ents for drainage ~d utilities should
be required around all lot lines. The applicant must also pay $1,000 ($500 per
lot) in park dedication fees. Credit is given for the lot wit the existing
home on it. I

recorded with the subdivision. This should be incorporated into a
development agreement between the applicant and the City as a guide-
line for future development. The development agreement sho d also
stipulate that any future subdivision of the 3.7 acres will be platted
in accordance with the shorewood Subdivision Ordinance. I

Planner Nielsen began by telling the audience of concerned ci tiz ns that,
according to the attorney, these "fire lanes" are all City of Sh rewood street
rights-of-way (R.O.W.). He said that this hearing is not being ~ld to make a
decision, but only the first stage of a study process to gather' ormation:
requests for use, complaints ~ general and specific comments, his ory of "fire
lanes", etc. The information will then be studied and will be u ed in the
formation of a policy.

Reports on "fire lanes" visited.
#1 - Enchanted Island
A gravel road that looks like a driveway leads to the end. Th~ Upper Lake
Minnetonka Yacht Club borders one side, and there is a questio on the
boundary on that side. Planner Nielsen suggested that the Yac t Club survey
be examined to determine the exact property line. The beach i quite sandy
and flat. It is felt that there may not be a need on the isla d for a beach
as everyone already has lakeshore, and a parking problem would be created by
outside use.

#2 - Shady Island I
This is approximately 15' wide with a lift station on the lake~end. It was
used as a beach at one time. The residents have taken care of it. Similar
to #1, the residents already have lakeshore, and outside use w uld create a
parking problem.
#3 - Grant Lorenz
This had a blacktopped surface at one time and boats could be ~railered in
one at a time. This area is wooded. A neighbor indicates tha~ he can
document that the width is 25'. The beach has a pebbly sandy ~ottom. There
appears to have been some erosion, and the neighbor has done s me landscap-
ing to prevent his yard from eroding into the "fire lane". :
The Commission discussed the fact that there is a definite pro
lane. A neighboring house is only 18' from the "fire lane".

This is approximately 25' in width, with a gradual slope betwelen 2 buildings
(east one is seasonal). There is a gravel driveway leading dOfn toward the
lake. It has a fairly decent looking bottom. .

Planner Nielsen stated that none of the "fire lanes" offer any plarking except
on the street and he feels that this should be considered in th: decision.
Park Commissioner Mary Kooi mentioned that this "lane" is use for cross
country skiing.

#5 - Eureka i
This is the widest "lane" at 66'. There is a very steep droPiith an existing
dock. The residents say they had Council approval for the do k but nothing
can be found in the minutes. Residents say restrictions were placed on use.
Permission was given to upgrade a stairway on the very west silde of the
property. Judy Marshall said that they had wanted to ran the.1,stairway aP
the center but Engineer Mittelsteadt said it had to remain wh re it was.
The wooden stairway is approximately 10 years old and the sto e stairway
dates from the early 1900's. .
This is the most controversial "fire lane", without adequate oom for parking.

Mr. and Mrs. Steven Turner were present to request a 10' front y~rd setback
variance to build a third attached garage onto the two existing garages. Mr.
Turner wants a third garage to store snowmobiles and boat trailers. He said
there is no other way to place a third garage, that he would havpto cut down
a 100 year old sugar maple. He said the house was put on the lot wrong 25
years ago, it would be very difficult to build a detached garage because of
the steep hilly banks. One corner of the garage would be 44 feet from the
road. The expense would be a lot greater on a separate garage, he would keep
the same lines as the other two garages so it would blend in.

effect of opening Glenn Road. The road is not designed to carry more traffic,

recognizes the valid concern over the length of the road regarding emergency

Mr. James Woog, a chiropractor and physical therapist, and Mr. JOE Gorecki
were present to seek direction from the Commission regarding a pre posed office
building and clinic to be located next to the Sullivan Center. M~. Woog said
the building will have approximately 5,000 square feet on each Of~two floors
and he expects to use half of it for his own practice. He is con idering
small offices for the remainder. He also said one of their conce ns is that
they would like to line up the parking lot with the parking lot 0 the Sullivan

PUBLIC HEARING - PRELIMINARY PLAT - SHOREWOOD OAKS
Mr. Geoff Martin, Planner; Mr. Tim Phenow, Project Engineer; and Mr. Dan
Reiland of Reiland and Johnson Construction, property owner wer~ present.
Mr. Geoff Martin explained that, having had their previous P.U.Q. turned down
by the Council, they are proposing an alternative plan with?3 Uots on their
44 acres. The lots will have a 20,000 square foot minimum lot iize with an
average of 22,335 square feet, averaging out at 1.79 units per cre. There
will be two trail accesses into Freeman Park. The road will run through the
project with entrances on Strawberry Lane and State Highway 7, and two cul-
de-sacs to the north and a loop to the south. Shorewood Oaks will request
vacation of the r.o.w. along the southerly border of the site. Sanitary sewer
will run off Strawberry Lane. A 33 foot r.o.w. will be provide to bring
Strawberry Lane up to code. Each individual lot will have its 0 n well.
The storm water system will flow to the north into the proposed ond shown
on the Comprehensive Plan. Mr. Martin said they will work with the Council,
Planning Commission and the Park Commission on the design of the pond.

Commissioner Leslie asked what specific changes had been made Sir', ce the last

Commissioner Schultz asked about drainage. Mr. Martin said that+ they have a
storm water sewer plan prepared by Strgar-Roscoe. The overall road system
will have drain tile beneath the surface and there will also be Idrain tiles
in the lots.

Commissioner Boyd asked what the average home cost will be. Mr.; Martin said
it would depend on the individual builder and what he chose to ~uild on the lot.
Commissloner Reese asked about the lot priices and was told it w uld be somewhere
in the mid twenties.
Commission asked Planner Nielsen if the Park Commission would g
drainage plan. He said he felt the Park Commission wanted an a

1. All lots should be adjusted in the final plat to conform to ,the width re-
quirements of the R-2 District.
2. The final plat should include 10' drainage and utility ease~ents along all
rear and side lot lines.
3. Grading, drainage and utilities should be subject to the comments of the
City Engineer. Plans for the inundation area in Freeman Park should be
subject to review and approval by the Park Commission and the City Engineer.
4. The entry to Highway 7 must be constructed in conformance to the require-
ments of MnDOT.
Motion carried unanimously.
Planner Nielsen said that the storm drainage line that is now on~ShoreWOOd Oaks
Drive should be extended over to Strawberry Lane. He said that h will recommend
to Council that when Shorewood Oaks cuts Strawberry Lane to put the sewer in,
the City should lay a piece of pipe across the street and put in! a catch basin
to help solve the drainage problem in that area.

Acting Chairman Reese asked that it be recorded in the minutes that a letter
had been received from Carol Dartt, the owner of property at 615p Strawberry
Lane, stating she is in favor of the project. She mentioned gasl lines, saying
she hoped the area could be rid of the gas tanks.
Geoff Martin said they plan on running gas lines into Shorewood baks.
