MINUTES CALL TO ORDER Chair Schmitt called the meeting to order at 7:00 P.M. ROLLCALL Present: Chair Schmitt; Commissioners Gagne, Geng, Gniftke, Hutchins, Meyer, and Ruoff; Planning Director Nielsen, and Council Liaison Turgeon Absent: None APPROVAL OF MINUTES · 3 April 2007 Gagne moved, Hutchins seconded, Approving the Planning Commission Meeting Minutes of 3 April 2007. Motion passed 7/0. 1. 7:00 P.M. PUBLIC HEARING - C.U.P. AMENDMENT FOR DETACHED GARAGE Applicant: Our Savior Lutheran Church Location: 23290 Highway 7 Chair Schmitt opened the Public Hearing at 7:01 P.M., noting the procedures utilized in a Public Hearing. He explained items recommended for approval that evening would be placed on a May 29,2007, Regular City Council Meeting Agenda for further review and consideration. Director Nielsen stated that Our Savior Lutheran Church was located at 23290 State Highway 7. In late 2000 representatives of the Church were granted a conditional use permit to construct an addition on the east end of the building to be used as a community room and gymnasium. The plans also included a proposed storage building (garage) to be located at the northeast comer of the easterly parking lot. Although the community room addition was built following approval of the C.D.P., the storage building was not. Because conditional use permits expire if they are not used within one year, Church representatives must renew their application. Nielsen then explained the property was zoned R-IC, Single-Family Residential and contained approximately 6.7 acres ofland. The proposed storage building meas~red 32 feet x 36 feet, which was somewhat larger than the original plan which was 24 feet x 32 feet. With regard to the analysis of the case, Nielsen stated the proposed building still complied with the 20- foot side yard setback requirement. He explained that although the larger garage would result in the loss of one parking space, the Church had nine more spaces than what was required by the Zoning Code; 167 spaces were required, the Church had 176. Nielsen stated that the plan the Commission had received had not complied with the maximum height restriction of 15 feet - the building height depicted on the plan was 17 feet. The applicant had submitted a CITY OF SHOREWOOD PLANNING COMMISSION MEETING 1 May 2007 Page 2 of3 . revised plan which depicted a building height of less than 15 feet. Nielsen distributed a copy of the revised plan. Based on compliance of the maximum height restriction, Staff recommended approval of the renewed condition use permit. He noted Church representatives were present to answer any questions the Commission may have. A Church representative stated that the plan depicting a building height of 17 feet was an error. He stated the drawing had been changed to reflect the new building measurement but not the scale. He also stated the increase in the new garage size was to accommodate a larger bus than the Church had in 2000. Seeing no one present wishing to speak on this matter, Chair Schmitt opened and closed the Public Testimony portion of the Public Hearing at 7:05 P.M. In response to a question from Commissioner Gagne, Director Nielsen explained that over the last few years the City had received complaints regarding noise from the Church's HV AC system and lighting issues. He stated all the lighting issues had been corrected. With regard to the HV AC noise issue, Nielsen explained initially the Church was in violation of the evening PCA standard. The Church had agreed to only operate the HV AC outside of the evening hours. The Church had also done some sound attenuation that did not quite satisfy the PCA standard. The City had received a complaint last summer, which was the result of a power outage which inadvertently reset the hours of the HV AC operation; the system had been reprogrammed so that would not happen again. The new application stated the applicant would consider installing a fence and landscaping to help mitigate the noise. The Church representative stated that a fence helped mitigate noise in a short distance, but made little difference at longer distances. . In response to another question, Director Nielsen stated the residents had been notified of the public hearing for the C.D.P. In response to a question from Commissioner Hutchins, the applicant representative stated the tree line would be preserved with the expanded garage. In response to another question, another representative stated no lighting would be placed on the exterior of the garage. In response to a third question, the representative stated the old fence would be removed from the property. Gniffke moved, Gagne seconded, Recommending Approval of a Condition Use Permit for a Detached Garage for Our Savior of Lutheran Church, 23290 Highway 7. Motion passed 7/0. Chair Schmitt closed the Public Hearing at 7: 17 P.M. 2. 7:10 P.M. PUBLIC HEARING - C.U.P AMENDMENT FOR SHED Applicant: Excelsior Covenant Church Location: 19955 Excelsior Boulevard This item was rescheduled to a future meeting. 3. DRAFT NEXT MEETING AGENDA Director Nielsen stated the property owners in Planning District 6 would be invited to the 15 May 2007 Planning Commission meeting to comment on the future of the District. He also stated there may be two C.U.P.s for consideration which had structures on the properties which could be considered for preservation as historic structures. He noted that Park Commissioner Hensley, Planning Commissioner Meyer, and Councilmember Woodruff were selected as members to the special ad hoc committee. 5. REPORTS . Liaison to Council Chair Schmitt reported on matters considered and actions taken at an April 23, 2007, Regular City Council Meeting (as detailed in the minutes of that meeting). Councilmember Turgeon further elaborated on the meeting. Councilmember Turgeon stated she had heard from residents that the Shorewood Yacht Club dock that was installed to dock the Excelsior Fire District boat was being used to fish off of. . SLUC Commissioner Gniftke reported on a SLUC session he had attended on 27 April 2007 regarding storm water management. Director Nielsen commented that it was very good session. . Other None. 6.
