WHEREAS, the OWNERSdesire to connectto the municipal watersupply; and, WHEREAS, the present WaterAccess Charge is $10,000 AGREEMENT NOW THEREFORE, pursuant to the mutual agreements provided herein, it is agreed by and between the CITY and the OWNERS as follows: 1. The OWNERS represent and warrant that they are the OWNERS of the PROPERTY and that they have full legal authority toencumberthe PROPERTY and that as of the date of the execution of this agreement, the OWNERS have fee title to the Property subject only to the liens, interests or encumbrances of record. 2. The OWNERS understand and request to levy the Water Access Charge assessed againstthe PROPERTY in the amount of $10,000. 3. The OWNERS understand and agree that SHOREWOOD will provide that the assessment is payable in five (5) annual installments and will bear an interest rate of five (5.0) percent per annum. Said assessments shall begin with taxes paid in 2021 and collected with the ad valorem taxes at the times due as determined by Hennepin County. 4. The OWNERS agree that the covenants, waivers and agreements contained in this Agreement shall bind the successors and assigns of the OWNERS and shall encumberthe PROPERTY in accordance with the agreements described herein. 5. The OWNERS hereby waive notice of public hearing and waive the public hearing required by Minnesota Statutes§429.031 with respecttothe assessment 6. The OWNERS waive their rights in all respects, pursuant to Minnesota Statutes §429.081, to appeal to district court, the levy of the water assessment charge described herein. 7. The parties agree that this Agreement shall be recorded with the Hennepin County Recorder. The Water Access Charge (WAC) of $10,000. This is normally paid as a lump sum, but at their August 24 meeting, the city council approved allowing the WAC to be paid through a special assessment. The assessment term shall not be longer than five years and at a five percent interest rate. An assessment agreement is required to be signed by all property owners if you want to pay it by assessment. If you have questions about this or would like pursue the assessment option, please contact Greg Lerud, City Administrator at 952-960-7905. 2. The property owner is responsible for the cost to bring water from the curb stop, also called the shut off valve, to the home. Property owner can select any company they chose to do the work. The city maintains a list of contractors who have done this type of work in the City. The list can be provided upon request. The property owner, or contractor, contacts the city for a Water Connection permit. The cost is $60. Contact the city at least 24 hours in advance to schedule an inspection of the service line connection to the curb stop. 3. Property owner needs to purchase a water meter and meter horn (518" meter is typical in Shorewood, but 1" meter is also available). City staff will be reviewing the map and developing a recommended size of meter based on distance from the watermain, and the presence of an irrigation system or swimming pool. In addition, per City Code: Section 903.04 Water Service Connections, subd (3): If the lot is served by the Southeast Area or Boulder Bridge water systems and is below an elevation of 975 feet, a pressure reducing valve (PRV) shall be purchased from the city at the time the permit is applied for if a new connection or upon notice by the city if an existing connection. Water meters, meter horns and Pressure Reducing Valves are available at city hall. Call 952- 960-7900 for the cost of meter and permit. The plumber will then install the meter, and the property owner or contractor contacts the city and requests a final water meter inspection from the building official at least 24 hours in advance. The city does not do inspections on Fridays. Cost of that inspection is included in the cost of the water meter purchase. 4. Please note: Homeowners can retain their well for irrigation or outside purposes if they choose to. If they chose to, a plumber must re -pipe the outside hose connections so that the well system and the public water system are not interconnected. If the property owner wishes to abandon their well, the procedure is governed by the State of Minnesota and a well driller can assist you with that process.
