A RESOLUTION APPROVING A SITE PLAN AMENDMENT FOR PROPERTY
LOCATED AT 19685 HIGHWAY 7
WHEREAS, ATS&R, (the "Applicant") proposes to alter the property to alter the existing building
for an educational use on property legally described as:
Lot 2, Block 1 Waterford 7th Addition, Hennepin County, Minnesota
WHEREAS, the Applicant has applied for a site plan amendment for various outside
improvements as shown on the plans submitted March 20, 22, and 29, 2021 and April 2, 2021;
and
WHEREAS, the Applicant's request was reviewed by the planning staff, whose recommendation
is included in a memorandum for the May 4, 2021 Planning Commission meeting, a copy of
which is on file at City Hall; and
WHEREAS, the Planning Commission held a public meeting on May 4, 2021 to review the
application, the minutes of the meeting are on file at City Hall; and
WHEREAS, the City Council considered the application at its regular meeting on
May 24, 2021, at which time the planning staff memorandum and the Planning Commission's
recommendations were reviewed and comments were heard by the City Council from the
Applicant, staff and public.
NOW THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF
SHOREWOOD, MINNESOTA FINDS AS FOLLOWS:
FINDINGS OF FACT
1. The subject property is located in the Waterford PUD and subject to Section 1201.03
Subd. 17 c., which requires projects to be reviewed by the Planning Commission and approved
by the City Council.
2. The applicant has proposed to: 1) mill and overlay the parking lot; 2) add a drop-off area
on the west side of the building by widening the sidewalk and altering the grades of the drive -
aisle for handicapped accessibility; and 3) adding surmountable curb to the south end of the
parking area to allow snow storage near the stormwater treatment pond.
3. The Applicant's proposal is identified on the application materials and plans submitted
on March 20, 22, and 29, 2021 and April 2, 2021.
CONCLUSIONS
A. The City Council specifically finds that the Applicant's request for a site plan amendment
is consistent with the standards listed in the zoning regulations except as specifically listed
below.
B. The Site Plan Amendment approval shall be subject to the following conditions:
1. Prior to beginning any construction at the property, the applicant shall acquire all
necessary permits.
2. Prior to issuance of a building permit for the project, the applicant shall alter the
plans as follows:
a. Include a note or detail that the doors to the garbage dumpster enclosure shall
be replaced in compliance with zoning regulations.
b. Revise the plans to include barrier curbs protecting greenspace and landscape
islands to be barrier curb (136/12) instead of surmountable, except on the south
end of the site.
C. The City Clerk is hereby authorized and directed to provide a certified copy of this
resolution for filing with the Hennepin County Recorder or Registrar of Titles.
