MINUTES
1. CONVENE CITY COUNCIL REGULAR MEETING
Mayor Labadie called the meeting to order at 7:00 P.M.
A. Roll Call
Present. Mayor Labadie; Councilmembers Johnson, Siakel, and Gorham; City Attorney
Keane; City Administrator Lerud; City Clerk/HR Director Thone; Planning Director
Darling; Director of Public Works Brown; and, City Engineer Budde

B. Review Agenda
Mayor Labadie noted that she would like to remove item 2. G. from the agenda.
Johnson moved, Gorham seconded, approving the agenda as amended. All in favor,
motion passed.
2. CONSENT AGENDA
Mayor Labadie reviewed the items on the Consent Agenda.
Councilmember Johnson stated that he wanted to clarify that item 2.E. does not contain and
additional sign ordinance language.
Planning Director Darling explained that Ordinance 581 on the agenda, is simply approving a
codification of previously adopted ordinances. This is done every year.
Johnson moved, Gorham seconded, Approving the Motions Contained on the Consent
Agenda and Adopting the Resolutions Therein.

Ann Straka-Leland, 5825 Strawberry Lane, stated that she is presenting on behalf of Patricia
Hauser and read aloud the statement entitled, Space and Grace in Shorewood, that addressed
some of the recent challenges in the City.

A. Report by Commissioner Gallivan on August 10, 2021 Park Commission Meeting
Planning Director Darling noted that Commissioner Gallivan had a conflict and could not attend
tonight’s meeting. She gave a brief overview of the August 10, 2021 Park Commission meeting
as outlined in the minutes.
City Engineer Budde explained that he had attended this meeting seeking feedback on the
proposed future trail corridor and ways to engage with residents.
Councilmember Siakel stated that she thinks it is important for residents to understand the
process for approving public improvements, such as adding trails or water to a project, and realize
that these decisions are made over a period of years and months, and not something that is just
made up as things go along.
7. PLANNING
A. Report by Commissioner Gault on August 3, 2021 Planning Commission Meeting
Commissioner Gault gave a brief overview of the August 3, 2021 Planning Commission meeting.

B. Variance to Rear Setback
Applicant: Revision, LLC
Location: 28115 Boulder Bridge Drive
Planning Director Darling explained the request for a variance to rear setback to allow an addition
to be constructed about 37 feet from the rear property line where 50 feet is required. She
explained that the existing home was constructed in 1983 at about 30 feet from the rear lot line
where 50 feet was required. The Planning Commission recommended approval.
Johnson moved, Gorham seconded, Adopting RESOLUTION NO. 21-093, “A Resolution
Approving a Variance to the Rear Yard Setback for Property Located at 28115 Boulder
Bridge Drive.” All in favor, motion passed.
8. ENGINEERING/PUBLIC WORKS
A. Approve Quote for 2021 Catch Basin and Culvert Repairs, City Project 21-03
City Engineer Budde gave an overview of the 2021 catch basin and culvert repair project areas.
He explained that the low quote was submitted by Minger Construction Companies and the work
should be completed by October 29, 2021. Staff recommends approval of the project.
Siakel moved, Johnson seconded, Adopting RESOLUTION NO. 21-094, “A Resolution to
Award Contract for the 2021 Catch Basin and Culvert Repair Project, City Project 21-03.”
All in favor, motion passed.
B. Accept Bids and Award Contract for Covington Watermain Repair, City Project 21-
07
City Engineer Budde explained that five bids were opened on August 17, 2021 with the low bidder
being GM Contracting, Inc. He gave an overview of the option to bid for both the method of pipe
bursting or directional drilling and noted that the low bid was for pipe bursting.
Siakel moved, Johnson seconded, Adopting RESOLUTION NO. 21-095, “A Resolution
Accepting Bids and Awarding Contract for the Covington Road Watermain Improvements,
21-07.” All in favor, motion passed.
C. Approve Quote for Lake Linden Drive Culvert Repair
City Engineer Budde stated that the Lake Linden Drive culvert is in need of repair which would
use a method called Cast in Place Pipe (CIPP). He stated that using this method will avoid a
detour and the need for open cut construction. The City solicited seven bidders and received two
back with the low bidder being Veit Construction.
Siakel moved, Johnson seconded, Adopting RESOLUTION NO. 21-096, “A Resolution to
Award Contract for the Lake Linden Culvert Repair Project, City Project 21-03.” All in favor,
motion passed.

D. GENERAL/NEW BUSINESS
A. Approve Prosecutor Contract with Campbell Knutson
B. Approve Joint Powers Agreement with the MN Bureau of Criminal
Apprehension for City Prosecutor
City Administrator Lerud stated that on July 15 the Council selected the firm Campbell Knutson
to be the City’s new prosecuting firm. Staff has reviewed the contract and found it consistent with
the RFP and recommend approval. He stated that within the resolution is direction to provide
notice to the current prosecutor that the current contract will end on September 30, 2021. He
explained that there will also need to be a new Joint Powers Agreement executed with the MN
Bureau of Criminal Apprehension for the new City Prosecutor.
Councilmember Johnson asked about language under Section 3, Part B, related to DWI offenses,
and if the language should say “the attorney will receive…” rather than “we will receive…”.
City Administrator Lerud stated the Council could approve the document with a that change. He
stated that even though the word ‘we’ is used, he thinks it is clear that they are talking about the
firm.
City Attorney Keane stated that he thinks modifying that language is appropriate.
Johnson moved, Gorham seconded, Adopting RESOLUTION NO. 21-097, “A Resolution
Approving Contract with the Firm Campbell Knutson to Provide Prosecution Services to
the City, with a language change in Section 3, Part B, to replace both ‘we’ references with
‘the attorney’.” All in favor, motion passed.
Johnson moved, Gorham seconded, Adopting RESOLUTION NO. 21-098, “A Resolution
Approving State of Minnesota Joint powers Agreements with the City of Shorewood on
Behalf of its City Attorney.” All in favor, motion passed.
E. STAFF AND COUNCIL REPORTS
A. Administrator and Staff
City Engineer Budde stated that the Glen/Amlee/Manitou project was paved last Thursday and
they are working on the final turf restoration and noted that the final lift of bituminous will happen
next year. The mill and overlay project had its final day of milling today and if the weather holds
the final day of paving will be tomorrow. The Mary Lake outlet project is also near completion and
just has a bit of restoration work yet to finish.
Planning Director Darling stated that the new census figures for the City have been released and
the new population is 7,783 as of April 1, 2020 which is a 6.5% increase from 2010. She reminded
the Council that August 27, 2021 will be Movie in the Park where they will be showing The Lion
King. She stated that safety camp happened on August 11, 2021 with 42 kids grade 3 to grade
5.
City Attorney Keane stated that following up on the open meeting law and remote participation by
the public, the requirement of remote participation was applicable only during the pandemic

emergency. He stated that this information was provided by the Commissioner of Administration
at the State of Minnesota.
B. Mayor and City Council
Councilmember Siakel expressed her appreciation to City Engineer Budde and Public Works
Director Brown for the excellent job they have done on the Glen/Amlee/Manitou project. She
stated that the road looks great and she thinks it is a great improvement.
Councilmember Johnson noted that once construction began, the City received more
compliments than complaints.
Mayor Labadie noted that SLMPD Police Chief Mike Meehan has submitted his resignation. An
emergency meeting of the Board was called and an interim chief, Lieutenant Justin Balsrud was
selected. She stated that Chief Meehan will be missed. She stated that Representative Dean
Phillips held his quarterly mayors pancake breakfast and gave a summary of things that
Representative Phillips is working on at the federal level and explained that he would welcome
hearing from his constituents. She thanked the residents that have reached out to the Council
with positive words of encouragement.

2022 LAKE MINNETONKA COMMUNICATIONS COMMISSION BUDGET
WHEREAS, the City of Shorewood (“City”) is a member of the Lake Minnetonka
Communications Commission (“LMCC”); and
WHEREAS, the Joint Powers Agreement governing the LMCC requires that an
annual budget be proposed and that it shall be adopted unless rejected by a
majority of members within
45 days; and
WHEREAS, the City Council has reviewed the proposed 2022 LMCC Budget.

Background: The Truth-in-Taxation timing for property taxes payable in 2022 is similar to prior
years. In the past, the City of Shorewood has held its Truth-in-Taxation (TNT) meeting on the
first Monday in December. In 2021 that date is December 6. This meeting provides an
opportunity for residents and others to comment on the proposed 2022 property tax levy and
operating budget. The Council will then hold their regular meeting on December 13, at which
time the Council will approve a final 2022 property tax levy and budget.
Financial or Budget Considerations: This process allows residents an opportunity to provide
input or ask questions about the budget and proposed property tax levy.
Options: Holding the public meeting is mandatory, but the council can change the date on the
attached Resolution if it wishes.
Recommendation / Action Requested: Staff recommends holding the public meeting on
Monday, December 6, 2021, at 7:00 pm and passing the Resolution as presented.
Next Steps and Timeline: Staff will communicate the date and time of the Truth-in-Taxation
meeting to Hennepin County so it can be included on the Truth-in-Taxation notices mailed to
property owners.

SELECTION OF THE TRUTH-IN-TAXATION PUBLIC MEETING DATE
WHEREAS, Minnesota State law requires local governments to hold public meetings
on their proposed budgets and property tax levies; and
WHEREAS, the traditional date for the budget public meeting is the first Monday in
December; and
WHEREAS, it is in the spirit of full and open disclosure of the City’s financial condition
to provide as much information as necessary for the City Council, residents, and property
owners to evaluate the budget and property tax levy;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SHOREWOOD AS FOLLOWS:
1. The Truth-in-Taxation public meeting for property taxes levied in 2021, collectible
in 2022, is set for Monday, December 6, 2021 at 7:00 pm.
2. A continuation date if necessary is set for Monday, December 13, 2021 at
7:00 pm.
3. The Finance Director is hereby instructed to transmit the Truth-in-Taxation meeting
date information to Hennepin County for inclusion on the parcel specific notices to
be mailed in November.

Policy Consideration:
Minnesota cities with a population over 2,500 are required to annually conduct an audit of the City’s
financial statements.
Background:
The attached 2021, 2022, and 2023 proposed audit engagement letter from Abdo, Eick & Meyers LLP
(AEM) details the audit objective, audit procedures, and engagement-related administration, fees and
other.
The chart below details AEM base audit fees and Office of the State Auditor’s (OSA) reporting form fees
for the past several years. Overall increases of less than 2.0% per year have been proposed by AEM for
2021, 2022, and 2023.
Financial or Budget Considerations:
The proposed costs of the 2021, 2022, and 2023 financial statement audits, including the annual Office
of the State Auditor’s reporting form are $32,025, $32,550, and $33,175, respectively. Those fees do
not include potential additional services for review or single audit of Federal grants, or implementation
of additional government auditing standards. The City’s 2022 proposed General Fund budget includes
$34,000 for 2021 audit and related services.

A RESOLUTION APPROVING CHANGE ORDERS 1 AND 2 AND ACCEPTING
EASEMENT AGREEMENTS FOR THE GLEN ROAD, AMLEE ROAD, AND MANITOU
LANE STREET & UTILITY IMPROVEMENTS, CITY PROJECT 18-08
WHEREAS, the City has entered into an agreement with WM Mueller & Sons, Inc. for
the Glen Road, Amlee Road, and Manitou Lane Street Improvements Project on
February 8, 2021 in the amount of $2,065,840.75 for the Base Bid and $481,347.50 for
the Watermain Alternate for a total bid of $2,547,188.25; and
WHEREAS, the streets that residents used to access their homes became difficult to
navigate during construction due to the poor soil conditions under the existing road
coupled with construction activities, and construction traffic; and
WHEREAS, the Engineer and city staff agreed to have the Contractor bring temporary
rock to stabilize the roads and improve accessibility for the residents to their homes;
and
WHEREAS, the Contractor agreed to bring in temporary rock to the site and stabilize
the road at $30/ton and required 441 tons; and
WHEREAS, during the preliminary design, an existing storm sewer line that runs from
24375 Glen Road across to 24710 Glen Road and outlets at 24705 Amlee Road was
identified to be a private line and was to remain in place; and
WHEREAS, during final design and discussion with city staff it was determined that the
line should be replaced with the project and that the city would take over maintenance
of the line; and
WHEREAS, multiple methods were reviewed in replacing the line and it was determined
that the line should be replaced using directionally drilling; and
WHEREAS, easements for the work were needed and could not be acquired prior to the
award of the project. City staff worked with the property owners, acquired the needed
easements, and obtained pricing for the work from Wm. Mueller and Sons; and
WHEREAS, the contractor priced the improvements for change order #2 at $53,968.00;
NOW THEREFORE, IT RESOLVED: by the City Council of the City of Shorewood
hereby approve Change Order No. 1 & 2, authorize payment in the amount of
$13,230.00 for Change Order No. 1 and $53,968.00 for Change Order No. 2 to WM
Mueller & Sons, Inc., and accept the signed easement agreements to be recorded
against the properties.

Background: The City is completing improvements to the Silverwood Park playground
and has already approved quotes for delivery of the playground equipment for this fall.
In coordination for the removal of the old equipment and installation of the new
equipment there are several site related improvements that are planned to occur. Staff
requested quotes from four contractorsfor the site work. Only one quote was received
by Parkstone Contracting, LLC from Cottage Grove, Minnesota in the amount of
$107,540.00. This amount was over the engineers estimate of $63,000 by $45,000.
Staff reviewed the quote with the contractor and others that did not submit. The main
factors for the higher price or lack of quotes was the short turnaround time requested by
the city. Many contractors were not able to commit to the timeframe, due to their
current workload.
To ensure the playground equipment can get installed this year, staff negotiated with
the only contractor that submitted a bid to price the minimum amount required to allow
the playground equipment to be installed this fall. The intent would be to rebid the
remaining site items this winter allowing a longer lead time and hopefully a more
competitive bid climate. The negotiation results in a quote of $15,400 for this year’s
efforts to complete removals of the asphalt, pea gravel, poured in place surfacing, and
other miscellaneous items.
Work for these items and installation of playground equipment is scheduled to be
completed this fall. Exact dates will be coordinated with Parkstone Contracting, LLC
and Minnesota Wisconsin Playgrounds, once the contract has been awarded.
Financial or Budget Considerations: The city has budgeted $70,000 for site related
improvements and is to be funded from the Park Fund.
Recommendation/Action Requested: Staff recommends award, in the amount of
$15,400.00 to the low quote, Parkstone Contracting, LLC and rebidding the remaining
work this winter.

Background:
In May, the City received a complaint regarding the property at 6185 Cardinal Drive.
According to the complainant, the property had a large accumulation of junk and discarded
materials on the rear yard of the property.
Property Inspections
In June, staff inspected the complainants’ concerns. At that time, staff observed a large
amount of discarded materials in the rear yard of the subject property. The items included
discarded trash, lumber, household construction materials and various other items stored
outside on the property. Additionally, staff observed a detached accessory structure that
would not meet the standards in City Code. The inspection photos are attached.
Enforcement Action
On August 4, 2021, staff sent out a notice of violation to the property owner regarding the
violation. The notice informed the property owner that they violated City Code 501.05 subd. 1
and City Code 501.05, subd. 9 by dumping and storing discarded items on their property and
City Code 1201.03, subd. 7.b.1 by having an accessory structure that does not meet code.
The property owner was given until August 16, 2021 to correct the violation. Since then, staff
has received a request from the property owner for an extension to correct the violation.
Section 104.03 subd. 2 a. of City Code allows property owners the ability to request an
extension of 30 days from the City Council if the property owner is unable to correct or abate
the code offense within the prescribed time. The applicant has requested a time extension to
complete the work necessary to resolve the violation. In keeping with previous practice for
code enforcement deadline extensions, staff would propose an extension of 30 days from
today to October 13, 2021.

Recommendation / Action Requested: Staff recommends allowing the extension because

Next Steps and Timelines: Once staff has direction from the City Council on the additional
time, the next steps include:
1. Informing the property owner of their updated deadline
2. Inspecting the property after the deadline to ensure compliance

Dear Property Owner,
Our office has received a complaint regarding nuisance dumping and storage of discarded items on your property. Upon
inspection, staff confirmed multiple violations are present.
City Code 501.05 Subd. 1 declares the following as public nuisances: Fallen trees, fallen tree limbs… and City Code 501.05,
subd. 9 declares the following as public nuisances: Any abandoned, discarded or unused objects or equipment such as …
furniture, … lumber, trash, debris, junk containers, machinery, implements, or equipment that is no longer safely usable for
the purpose for which it was manufactured. Staff identified a discarded trash, lumber, household construction materials
and various other items stored outside on the property (see photos on the reverse page.) All these items stored outside
must be removed or stored within the home/garage.
Additionally, City Code 1201.03, subd. 7.b.1 states that all detached accessory buildings in excess of 150 square feet in
floor area that are accessory to residential dwelling units shall be constructed with materials and a design compatible with
the general character of the principal structure on the lot. No accessory buildings shall be covered in canvas or vinyl fabric.
No accessory building in excess of 150 square feet in floor area shall be constructed of sheet or corrugated steel,
aluminum, asbestos or fiberglass. Except for approved wood foundations, no accessory building shall be constructed
where wood poles are the primary support for the roof system and form the foundation structure. As it stands, the
outbuildings in your rear yard would not meet the standards of our code. The structure will either need to be taken down,
or you can submit a permit application and plans to our office showing how the structure will be brought up to code.
The violations must be corrected immediately. Your property will be re-inspected for compliance on or after August 16,
2021. Any violations found after this date would be subject to administrative enforcement, pursuant to Chapter 104 of the
Shorewood City Code (enclosed). Other code sections quoted above are available on the City’s website.

WHEREAS, the City of Shorewood sent a violation notice to Konrad M Wurm Sr
(Property Owner) regarding an accumulation of discarded items and debris and an
accessory structure in violation of City Code on his property addressed as 6185
Cardinal Drive; and,
WHEREAS, the Property Owner has requested more time to correct the violation as
allowed by Section 104.03 subd. 2 a. of the City Code; and,
WHEREAS, the City Council considered the appeal for additional time to correct the
violation at its regular meeting on September 13, 2021, at which time the Planning
Technician’s memorandum was reviewed and comments were heard by the City
Council from the Property Owner, staff and the public.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
SHOREWOOD, MINNESOTA FINDS AS FOLLOWS:

Background: On August 24, 2020,the Shorewood City Council authorized the
preparation of the Final Plans and Specifications for the Glen Road, Amlee Road,
Manitou Lane Street and Utility Improvements project. The final plans and specifications
were developed to be consistent with the feasibility study that was prepared and
approved in the fall of 2019. This includes narrower streets than the city standard at 22’
back to back of curb on Glen Road west, and 24’ back to back of curb on Glen Road
East, Manitou Lane, and Amlee Road. The standard city street section is 28’ back-to-
back of curb. The project will also include a new cul-de-sac at the west end of Glen

Typical sections of the roadway cross sections are included to help visualize this
scenario. A resolution is required to make no parking enforceable.

Resolution that designates no parking on the inbound lanes of Glen Road, Amlee Road

A RESOLUTION TO PROHIBIT PARKING ON INBOUND SIDE OF GLEN ROAD,
AMLEE ROAD, AND MANITOU LANE; CITY PROJECT 18-08
WHEREAS, the City has reconstructed Glen Road, Amlee Road, and Manitou Lane as
an urban roadway with curb & gutter with west Glen Road at 22 feet back to back of
curb and east Glen Road, Amlee Road, and Manitou Lane at 24 feet back to back of
curb; and
WHEREAS, the city standard for street width is 28 feet wide and the narrower streets
widths do not allow for parking on both sides of the roadway; and
WHEREAS, the inbound lanes of the roadways should be kept clear to allow for quick
response by emergency vehicles; and
WHEREAS, the project includes two cul-de-sacs which shall be signed as no parking to
allow for maximum use for larger turning vehicles;
NOW THEREFORE, IT RESOLVED: by the City Council of the City of Shorewood
hereby approve the resolution to sign and enforce no parking along the north side of
Glen Road, the south side of Amlee Road, the east side of Manitou Lane, and the cul-
de-sacs of all of said roadways.

ADOPTING THE PRELIMINARY 2022 GENERAL FUND
OPERATING BUDGET AND PROPERTY TAX LEVY
WHEREAS, City staff have presented the preliminary 2022 budget and property tax
levy at a work session in August 2021; and
WHEREAS, the City Council has reviewed the budget and property tax levy and
made modifications to each that reflect desired community service levels; and
WHEREAS, the City Council is required to approve and certify the proposed 2022
preliminary property tax levy to the Hennepin County Auditor by September 30, 2021;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SHOREWOOD AS FOLLOWS:
1. The 2022 Preliminary General Fund Budget is hereby set at $5,932,098.
2. $6,173,291 is to be levied for 2021 ad valorem property taxes, collectible in

ackground: On July 27, 2021, staff presented information to the city council for the
Strawberry Lane project, whichincluded information on the proposed sidewalk/trail and
an alternate roadway alignment. The alternate roadway alignment on the south end
shifted the roadway approximately 6 feet west to avoid impacts to the front yards or
residents on the east, and therefore require easement acquisition from four additional
property owners on the west side and south of the Lake Minnetonka Regional Trail.
Prior to and during the council meeting residents voiced their concerns related to the
impacts to adjacent residents, the number of trees impacted for the project, safety along
the corridor, amongothers. Based on the feedback, the council directed staff to
develop alternatives that would consider different roadway alignments and widths.
Staff has taken the feedback received by the residents and council and began gathering
information and developing multiple street alternatives. The process involves creating
geometric layouts for each option and determining preliminary construction limits. Then
using these limits to evaluate impacts to trees and also provide more detailed context as
to the overall safety throughout the corridor. The evaluation will also include updated
project cost information, easement needs, and other performance-based design
characteristics such as quality of service, reliability, accessibility, infrastructure integrity,
ease of use, visual quality, and fit of context and community.
Staff has been working through this process, but in order to be able to meet the timeline
for bidding the project in the spring, the deadline to begin preparation of those final
plans and specifications is quickly approaching. Due to this additional process at this
stage of design, it is recommended to shift the proposed construction to the summer of
2023 instead of 2022 as currently proposed. This will allow for further input and
discussion between residents and the city, as well as proper coordination timelines with
other involved parties such as private utilities and permitting agencies. Moving the
project to 2023 will not impact the city’s capital improvement plan.

e anticipate the above information will be prepared by October 15, 2021. When the
information is ready, the city will share the information with the residents and council
and host an open house and explain the details of each alternative.
