The Village Council of the Vil- lage of Shorewood, Minnesota, does ordain as follows: SECTION 6. Careless Driving off Highways. Any person who drives any ve- hicle in such a manner on any public or private grounds or park- ing lot or on the frozen surface of any body of water within the limits or the harbor limits of or adjacent to the limits of the Vil- lage, so as to indicate a disregard for the safety of persons or prop- erty, shall be guilty of careless driving and such careless driving is a misdemeanor. SECTION 7. Penalty. Any violation of the provisions hereof or of the statutes adopted by reference in Section 1 is a vio- lation of this ordinance when it occurs within the Village of Shorewood. Any person thus vio- lating any provision of this ordi- nance shall be guilty of a misde- meanor and shall be punished by a fine of not to exceed $100.00, or by imprisonment in the County Jail not to exceed 90 days; but, if a minimum fine or imprisonment is prescribed by the State High- way Traffic Act for an offense, such penalty shall apply to a per- son convicted of the same offense under this ordinance. SECTION 8. Repeal. Ordinance No. 38 of the Village of Shorewood is hereby repealed. SECTION 9. Effect. This ordinance shall take effect from and after its passage and publication by law. The Village Council of the Vil- lage of Shorewood does ordain: ARTICLE I INTENT Section 101. It is the intent of / this ordinance to supplement the Laws of the State of Minnesota, Chapters 168 through 171, Minne- sota Statutes. with respect to the operation of certain motor ve- hicles commonly called ~nowmo- biles. ARTICLE II . DEFINITIONS The following words and phrases when used in this ordinance have the meaning as set out herein. Section 201. "Operate." Operate means to ride in or on and control the operation ot a snowmobile. Section 202. "Owner:' Owner means a person other than a lien holder, havin~ the property in or title to a snowrno- hile entitled to the use or posses- 'sion thereof. Section 203. "Operator:' Operator means every pE'rson who operates or is in actual phy- sical control of a snowmobile. Section 204. "Roadway:' Roadway means that portion of a highway improved. designed or ordinarily used for vehicular traf- fic. Section 205. Publi4 Village Streets and Public Property. No person shall operate a snow- mobile upon public property or frozen surface of lakes within the Village of Shorewood except as provided in this ordinance. The Village Council may by resolu- tion, prohibit the operation of snowmobiles on the roadway of Village streets in the Village of Shorewood when in the opinion of the Village Council public safety and welfare so requires. Section 302. Direct Crossings. A sno\\ 1111,blle may be operated upon any village street in an emergency during the period of time when and at locations where snow upon the roadway renders travel by automobile impractical. Section 304. Highway ~dIc Act. All provisions of the Hlpway Traffic Regulation Act, Chapter 169 of Minnesota Statutes, shall apply to the operation of .now- mobiles upon streets and high- ways. except for those relating to required equipment, and ex- cept those which by their nature have no application. Section 30&. Snowmobile Reg- istration. No snowmobile shall be oper- ated on public streets or public land or frozen surface of lakes within the Village of Shorewood without having such a snowmo- bile registered as provided for in Section 168.842, Minnesota Stat- utes. Section 308. Operator'. on....'s License. No snowmobile shall be oper- ated on public streets of the Vil- lage of Shorewood unless the op-' erator shall have a valid motor vehicle driver's license issued to him by the State of Minnesota, or shall be accompanied by a li- censed driver who is actually oc- cupying a seat in the vehicle. ARTICLE IV. OPERA TIONS GENERALLY Section 401. Operations Gen- erally It shall be unlawful for any person to drive or operate any snowmobile in the following un- safe or harassing ways: (1) At a rate of speed greater than reasonable or proper under all the surrounding circum- stances; (2) In a careless, reckless and negligent manner so as to en- danger the person or property of another or to cause injury or damage thereto: . . . (3) While under the influence of intoxicating liquor or narcotics or habit. forming drugs; (4) Without a lighted head and tail light when required for safety; (5) In any planting or tree nursery in a manner which dam- ages or destroys growing stock. The Village Council of the Vil- lage of Shorewood does ordain: Section 1. That Section 1 of Ordinance No. 44 is hereby amended to read as follows: "Section 1. Building Regula- tions. The Uniform Building Code Short Form 1967 Addi- tion, three copies of which are on file in the office of the Vil- lage Clerk, is hereby adopted as the Building Code for the Village for the purpose of reg- ulating the construction, alter- ation, moving, demolition, or repair, and use of any build- ing or structure within the Vil- lage. Every provision contained in this Code is hereby adopted and made a part of this Ordi- nance as if fully set forth here- in; except, however, that the minimum building permit fee for construction or work for which a permit is required shall be $6.00."
