Apparently the misunderstanding years ago of Mary Lake and Linden Lake being connected is part of the problem. Linden Lake, being smaller that 2.5 acres, does not meet the DNR size criteria and this is why they do not associate any shoreland classification to Linden Lake. After our last phone conversation, it is my understanding you will be requesting the city to administratively eliminate Linden Lake from the current shoreland zoning controls. Since this never came up at the last planning meeting with Cub and the city, I assume it is not an issue on sites like either of ours. I never brought it up, as I am left with the understanding you believe that it is not a concern for either Cub or myself, and this will be corrected very soon to comply with the 10 acre guideline of Shorewood you are now resubmitting for. My bottom line assumption is that since the shoreland classification/zoning controls apparently do not affect the proposed Cub project, that it certainly will not apply to my project as well. I look forward to working with you and the city with my project and we'll be in touch as soon as we finish our preliminary design with the land use requirements we've discussed. It looks like this will be about the 50% structure and parking we discussed. If there is anything I have misunderstood, let me know as soon as possible— and thanks for the help, Brad. Shorewood, MN 55331 RE: 27-899W-Mary Lake, City of Shorewood, Hennepin County Dear Mr. Nielson: As we discussed in a recent telephone conversation, our data indicates that basin 27-143 was identified as Linden Lake with an alternative name of Mary, 10 acres in size with a lake classification of recreational development as defined in a 1968 publication"An Inventory of Minnesota Lakes Bulletin No. 25". Since that publication, a mandatory statewide inventory was completed for public review and adoption. This Public Water Inventory(PWI) entailed some on-site inspection reports from DNR field personnel and at times basins would be renumbered due to inaccuracies. The PWI for Hennepin County was conducted in1983. At that time basin 27-143 was renumbered to 27-899W and identified as Mary Lake 27-899W, 7 acres in size with no shoreland classification. Linden Lake is just south of Yellowstone Trail and does not meet our PWI size criteria of 2.5 acres or greater in incorporated areas. At one time it may have been assumed that the two basins were connected. Regardless, the City of Shorewood can continue to administer and enforce shoreland management controls on development within 1000 feet of Linden Lake. However, the basin is not within our jurisdiction and thus no technical or legal assistance will be provided. The City could also administratively eliminate Linden Lake from the current shoreland zoning controls. In any case, I would suggest that the numeric notation of 27-143 be removed from your ordinance. Shoreland Classification: The surface waters affected by this Section and which require controlled development of their shoreland (shoreland district) are shown on the map designated as the official "Zoning Districts Map of the City of Shorewood" which is properly approved and made a part of the Ordinance and filed with the Zoning Administrator. Surface waters generally greater than ten (10) acres and given an identification number by the State of Minnesota are defined in Section 1201.02 of this Ordinance and listed in Table 1 of this Section. Other surface waters affected by this Ordinance, generally having less than ten (10) acres, are classified as wetlands and thus regulated under the provisions of Shorewood Ordinance No. 70 (Chapter 1102 of the City Code).
