22-098 Approving a Preliminary and Final Plat for High Pointe Estates 2nd Addition for Roy Lecy for Property Located at the Southerly Extent of Charleston CircleRESOLUTION 22-098 CITY OF SHOREWOOD COUNTY OF HENNEPIN STATE OF MINNESOTA A RESOLUTION APPROVING A PRELIMINARY AND FINAL PLAT FOR HIGH POINTE ESTATES 2ND ADDITION FOR ROY LECY FOR PROPERTY LOCATED AT THE SOUTHERLY EXTENT OF CHARLESTON CIRCLE WHEREAS, Roy Lecy (the "Applicant"), has submitted a request for a Preliminary and Final Plat to change the legal description of the parcel legally described as: Outlot D, High Point Estates, Hennepin County, Minnesota; and, WHEREAS, the applicant submitted the request for the preliminary and final plat in the manner required for the review of such applications under the Shorewood City Code and under Chapter 462 of Minnesota Statutes, and all proceedings have been duly consistent thereunder; and, WHEREAS, the preliminary and final is consistent with the Shorewood Comprehensive Plan and the intent of the regulations and requirements of the laws of the State of Minnesota and the City Code of the City of Shorewood. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Shorewood that the RLS and variances are hereby approved, subject to the following conditions: 1. The lot line adjustment is hereby approved, in accordance with the plans submitted on August 2 and 31, 2022 (the "Plans") and subject to the conditions listed below. 2. Prior to recording the plat, the applicant shall complete the following: a. Any changes to the wetland delineation required by the MCWD shall be incorporated into the Plans and the legal descriptions for the conservation easement for the wetland and wetland buffer. b. Submit the following: 1) a revised final plat with drainage and utility easements over the wetland and wetland buffers; 2) a separate legal description and exhibit for an access easement over the southwesterly tip of the parcel to provide access to the city's property to the south; and 3) revised plans and permits consistent with the engineering memo dated September 14, 2022. c. Submit executed conservation easements over the wetland and wetland buffers and an executed access easement. d. Pay required utility connection fees and park dedication for one additional lot. 3. Prior to construction of a home on the new lot, provide the following: a. Proof of recording for the plat, easements, and other recorded documents. b. A stormwater management plan consistent with the City and watershed district requirements. c. A revised tree preservation inventory with the size, species, condition, and status of the trees on the site. d. A landscaping plan showing the required tree replacements consistent with City Code and the tree preservation policy. 4. The approval for the plat request shall expire in 180 days if the Applicant has not recorded the plat with Hennepin County. The Applicant may request an extension to the approval subject to the requirements of Section 1202.03 Subd. 3.c.
