RESOLUTION 23-103
A RESOLUTION APPROVING FOUR AGREEMENTS RELATED TO THE DEVELOPMENT OF
LAKE PARK VILLAS WITH THE CITY OF TONKA BAY AND THE DEVELOPMENT
FOR PROPERTIES AT 24250 AND 24320 SMITHTOWN LANE.
WHEREAS, the Cities of Shorewood and Tonika Bay ("the Cities") are Minnesota municipal
corporation operating as statutory cities under the laws of the State of Minnesota; and
WHEREAS, TSML Properties, LLC, the "Applicant" propose a development to be called Lake Park
Villas located at 24250 and 24320 Smithtown Road (the "Property"); and
WHEREAS, the Property straddles the municipal boundary of the Cities; and
WHEREAS, the Cities require four agreements before the Applicant may proceed with
development, including: 1) a Development and PUD Agreement; 2) a Joint Utility, Trash and
Recycling Service Agreement; 3) a Stormwater Maintenance Agreement; and 4) Private Street
Maintenance and Encroachment Agreement.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SHOREWOOD,
MINNESOTA AS FOLLOWS:
1. The City Council hereby approves the Agreements with the City of Tonka Bay and the
Applicant related to the Lake Park Villas development.
2. Authorizes the Mayer and City Clerk, on behalf of the city, to sign the agreements and
execute any other necessary documentation to validate the agreement.
