RESOLUTION 24-018
A RESOLUTION AUTHORIZING AN AMENDMENT TO THE DEVELOPMENT AGREEMENT FOR
EXCELSIOR WOODS LOCATED AT 20325 EXCELSIOR BOULEVARD
WHEREAS, in 2021, the City of Shorewood approved a final plat and development agreement
for Excelsior Woods (the "Project"), located at 20325 Excelsior Boulevard, on property legally
described as:
Lot 37, Auditor's Subdivision No. 141, Hennepin County, Minnesota; and
WHEREAS, the Project is subject to a Development Agreement (the "Agreement"), dated
October 12, 2021 which outlines obligations for construction of improvements and the dates
when such improvements would be required to be completed; and
WHEREAS, Excelsior Woods, LLC. (the "Applicant") has requested an amendment to the
deadline as it expired in 2022 and they only recently purchased the development from a
previous developer and had no ability to construct the improvement prior to the included
deadlines.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Shorewood has
approved the First Amendment of the Development Agreement, as follows:
1. The Applicant's request for approval of this First Amendment to the Development
Agreement (Exhibit A) allowing amendments to Paragraph 9 is hereby approved, subject to the
following:
2. Prior to the any activity on the site, the Applicant must record the First Amendment to
Development Agreement with the Hennepin County Recorder and fulfill the remainder of the
conditions of approval.
3. This Resolution authorizes the Mayor and City Clerk to execute the First Amendment to
Development Agreement.
