During the process it was discovered that the Department of Natural Resources (DNR) is required to be notified when the right-of-way abuts a wetland or other type of public water. The DNR notification includes a period of up to 60-days for review, during which time the City may not make their final decision. I have now heard back from the DNR and they will be waiving their right to a full review. I will put the vacation request back on the City Council agenda for the August 14, 2017 meeting. While this proposed street is near Lake Minnetonka and a wetland, it does not merit the need for a full department review. Please encourage the landowners on either side of the vacated road to adopt shoreline best management practices to protect wetland habitat and improve water quality. I did a quick review and I do not think this city street vacation needs to be reviewed under the "terminates at, abuts upon, or is adjacent to any public water" section of the statute. While it is near Lake Minnetonka it does not touch Minnetonka. The ones that touch the waterbodies are the ones we are concerned about. I can give Marie Darling a call — if they have already had the hearing I believe they are fine to process. I do not believe there would be any objections to this vacation even if we had a full review (which is not needed ) and it does not appear to touch any state lands in which case we do not need to be notified at all. I talked to him today to try to track down what had become of this notification. He told me that he had received the notification by certified mail (scan attached), but had not forwarded it on to anyone. He later brought the hard -copy notification to me. Before I went on annual leave for a week the first -second weeks of July, I had advised the city planner Marie Darling of the statutory notification period of 60 days (she had previously notified us four days prior to the hearing), and told her the public hearing would have to be re-established 60 days after the commissioner is notified. However, it looks like the commissioner was never formally notified. The notification went to the hydrologist. Please advise the city what the city now needs to do in order to be in compliance. Marie Darling was wondering whether the 60-day notification period needs to be re -started. I did not know. I am still new at this part of my job, so please let me know also. Thank you.
