RESOLUTION 24-043
A RESOLUTION APPROVING A PRELIMINARY AND FINAL PLAT FOR
THE RAY HELGESEN ADDITION FOR PROPERTY
LOCATED AT 6120 STRAWBERRY LANE
WHEREAS, Patti and Paul Helgesen (the "Applicant"), has submitted a request for Preliminary
and Final Plat to subdivide the property at 6120 Strawberry Lane and legally described as:
The north 250 feet of Lot 35, Minnewashta and Lots 36 and 37, Minnewashta, except the
south 225 feet of said Lots 36 and 37, Hennepin County, Minnesota; and,
WHEREAS, the applicant submitted the request for the preliminary and final plat to subdivide
the property into four lots in the manner required for the review of such applications under the
Shorewood City Code and under Chapter 462 of Minnesota Statutes, and all proceedings have
been duly consistent thereunder; and,
WHEREAS, the preliminary and final plat is consistent with the Shorewood Comprehensive Plan
and the intent of the regulations and requirements of the laws of the State of Minnesota and
the City Code of the City of Shorewood.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Shorewood that the
preliminary and final plat are hereby approved, subject to the following conditions:
1. The preliminary and final plat is hereby approved, in accordance with the plans submitted
on March 1, 7, 13, and 19, 2024 and April 19 and 25, 2024 (the "Plans") and subject to the
conditions listed below.
The approval of this subdivision is contingent upon the approval of the vacation of Maple
Avenue.
3. Prior to recording the plat, the applicant shall complete the following:
a. Submit the following: 1) revised plans to conform with the engineer's memo dated April
25, 2024; 2) a revised grading plan to indicate the swale relocated to the location shown
on the preliminary plat.
b. Submit executed private driveway easements over the shared driveway that shall
indicate: 1) the alteration of the driveway on Lot 2 when a separate driveway is
provided for Lot 1; 2) the assignment of maintenance for the shared driveway; 3) a
statement that neither property owner may block access to the other lot; and 4) a
procedure for dispute resolution.
c. Submit an executed storm water maintenance agreement for the rain garden proposed
on Lot 2.
d. Pay the required water and sewer connection fees and park dedication for one
additional lot. Future subdividing will require additional fees for the future lots.
e. Acquire all permits from other applicable jurisdictions as identified in the engineer's
memo dated April 25, 2024.
4. Prior to construction of a home on either lot, provide the following:
a. Proof of recording for the plat, easement, agreement, and any other recorded
documents.
b. A stormwater management plan consistent with the City and watershed district
requirements.
c. A revised tree preservation plan to indicate all trees to be removed and provide a
conforming landscaping plan with the proposed trees proposed for restitution
consistent with the tree preservation policy.
5. The revised swale and the improvements proposed to the Maple Avenue vacation shall be
constructed with the first home.
6. An encroachment agreement is required prior to the construction/installation of any new
driveway accessing Maple Avenue.
7. The shared driveway between lots 1 and 2 shall be removed a conforming driveway shall be
installed on both lots when a new home is constructed on Lot 1 or Lot 1 is further
subdivided, whichever occurs first.
8. The Applicant shall provide a conforming stormwater drainage plan for the remaining lots
shown with any future plat and all other requirements of City Code at that time.
9. The approval for the plat request shall expire in 180 days if the Applicant has not recorded
the plat with Hennepin County. The Applicant may request an extension to the approval
subject to the requirements of Section 1202.03 Subd. 3.c.
10. Applicant shall restore vacated portion of the Maple Avenue ROW to turf.
11. Applicant to provide for snow removal and road maintenance of the remaining western
portion of the Maple Avenue ROW by agreement to be recorded against the two parcels
accessing Maple Avenue.
12. Applicant to provide a curb cut and grading to City standards to access the remaining
western portion of the Maple Avenue ROW from Church Road.
