RESOLUTION 24-041
RESOLUTION APPROVING THE PARTIAL VACATION OF A
DRAINAGE AND UTILITY EASEMENT FOR 24880 BENTGRASS WAY
WHEREAS, Kelly and Matthew Pedersen submitted a petition to vacate a portion of their rear -
yard (the "Request") drainage and utility easement to accommodate a pool and patio on
property addressed as 24880 Bentgrass Way and legally described as:
Lot 17, Block 5, Minnetonka Country Club 2nd Addition, Hennepin County, Minnesota
(the "Property"); and,
WHEREAS, Notice of Public Hearing on the proposed vacation of a portion of drainage and
utility easement within the City of Shorewood, Hennepin County, Minnesota, was published in
the SUN -SAILOR NEWSPAPER on May 9 and 16, 2024; and
WHEREAS, said Notice of Public Hearing was posted in on the public notice board in the City of
Shorewood City Hall and on the city's website and mailed to the adjacent homeowners; and
WHEREAS, the Council of the City of Shorewood heard all interested parties on the question of
vacation at a Public Hearing on May 28, 2024 and June 10, 2024, in the Council Chambers at the
City Hall.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Shorewood, Minnesota,
that the portion of drainage and utility easement, legally described in Exhibit A, attached hereto
and made a part hereof, be and hereby is vacated.
BE IT FURTHER RESOLVED, that with the construction of the pool and patio, the applicant shall
re -grade the property consistent with the plan submitted April 10, 2024 (the "Plans").
BE IT FURTHER RESOLVED, that the City Clerk is directed to notify the County Offices in
accordance with Minnesota Statutes.
ADOPTED BY THE CITY COUNCIL OF SHOREWOOD, MINNESOTA this loth day of June, 2024.
