RESOLUTION 24-044
A RESOLUTION APPROVING A PUD DEVELOPMENT AMENDMENT FOR "WATERFORD PUD" ON
THE PROPERTY LOCATED AT 19765 HIGHWAY 7
WHEREAS, MM Capital Shorewood, LLC. (Applicant), has submitted a request for a PUD
Amendment for the Waterford PUD to allow marine sales and service with outdoor boat
storage and display (the "Request") for the property legally described as:
Lot 1, Block 1, Waterford 7t1 Addition, Hennepin County, Minnesota (the "Property");
and,
WHEREAS, the Request has been submitted in the manner required for the development of
land under the Shorewood City Code and under Chapter 462 of Minnesota Statutes, and all
proceedings have been duly consistent thereunder; and,
WHEREAS, the Request was reviewed by the Planning Commission at a public hearing on May
7, 2024 where public testimony was considered; and,
WHEREAS, the Request was reviewed by the City Council at a second public hearing on May 28,
2024, where the recommendation of the Planning Commission, City staff and the public were
considered; and,
WHEREAS, the Request was reviewed by the City Council at a public meeting on June 10, 2024,
where the recommendations of the Planning Commission, City staff and the public were
considered; and
WHEREAS, said Request is consistent with the regulations and requirements of the laws of the
State of Minnesota and the City Code of the City of Shorewood for the approval of such a
request.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SHOREWOOD,
MINNESOTA, AS FOLLOWS:
1. The Request for a PUD amendment is hereby approved according to the plans and materials
submitted March 19, 2024, April 19, 26, and 30, 2024 and May 19, 2024, (the "Plans")
subject to the contingency and conditions listed below.
2. The PUD is approved with the following flexibility:
a. Marine sales and service, including outdoor storage and display of boats and trailers, is
allowed on the property consistent with the Plans.
b. A reduction in required parking from 79 spaces to 43, as long as the site is used for
marine sales and service.
c. Only service with hand tools and handwashing is permitted outside of the building (no
power equipment).
d. The applicant shall remove the display spaces between the front curbs and the north
property line and restore the required three-foot undulating berms.
e. The amendments to the site plan to remove landscape islands is permitted, but barrier
curb shall be installed along the north edge of the parking area and the south edge of
the parking area to protect the landscaping areas and around the sidewalk for the
building, except that on accessway to the display space directly in front of the building is
permitted.
3. Prior to issuance of any building permit, this applicant shall provide the following
consistent with this amendment and City Code:
a. An executed development agreement and the related financial guarantees for all on -
site improvements.
b. An executed partial release of the covenants that prohibit outdoor storage.
c. An executed stormwater agreement for the private stormwater maintenance
agreement.
d. Either written permission from the adjacent properties allowing alteration of their
property or revised plans that show no disturbance on the adjacent properties.
e. Copies of all recorded documents including this resolution, the development
agreement, the covenants, and any other recorded document related to the
Request.
f. A conforming tree inventory, tree preservation plan and landscaping plan with the
required restitution, but not less than the number and location of trees shown on
the plans.
g. A conforming lighting plan.
h. Revised plans indicating the fagade and gate materials for the trash enclosure.
i. Revise the plans consistent with the engineering memo and the fire inspector's
direction and exhibits including but not limited to the fire lane.
j. Revise the landscaping plan as indicated on the sketch submitted June 5, 2024.
k. Revise the plans to include a painted line in front of the display spaces on the south
side of the property so that it is clear how the boats/trailers/vehicles may be
parked/displayed without encroaching on the southerly drive -aisle.
4. The interior lights in the south side of the showroom and in the service bays shall be turned
off at the close of business.
5. All the vehicles/trailers/boats waiting for service shall be stored in the display spaces on the
south side of the building. No vehicles/trailers/boats waiting for service may be stored on
the property for greater than 48 hours.
6. The Applicant shall not allow boats, trailers or other vehicles to block or encroach upon
either the fire lane on the north side of the building or the drive -aisles on the south side of
the building.
7. Signs shall be consistent with the Waterford PUD requirements.
8. No parking, storage or loading of boats may occur on the public right-of-way.
9. The approval for the PUD Amendment shall expire in one year if the applicant has not
commenced the project, except that the applicant may request an extension to the
approval subject to the requirements of Section 1201.25 Subd. 6. d. (4).
