Shestatedthattheother variance thattheapplicant isasking forisrelated totherequired parking spaces. Sheexplained thattheZoningOrdinance required 10fullparking spaces butwitha fullyautomatic carwash withthepossibility of a maximum ofone staffmember beingonsiteatatime, they feelthat parking requirement maybe abitexcessive andhaveasked toprovide theoneparking spaceasproposed onthenorth end ofthebuilding. Staffrecommends approval ofthevariance toprovide onlyoneparkingstall, denialoftherequest forreduced stacking, andoverall approval oftheapplication. Commissioner Riedel asked foradditional clarification ontheproposed stacking. Planning Director Darling explained thestacking andnoted thatstaffisproposing thatthestacking linesbe painted going tothenorth sideofthebuilding soitisclearhowthestacking would function. She stated thattheCommission couldalsoaddacondition thattheyplace asignthat states nostacking ispermitted intothepublicstreet. Commissioner Huskins askedifthethrough-putting ofcarstookintoaccountthe vacuuming units thatoccurrightattheexit. Heaskediftherewillbearightturnonly signascarsdepart. Planning DirectorDarling statedthattheyhavefullaccess attheireastern entrance, soshedoes notthinktheCitycouldsaythatitwasright turnonly. Sheexplained thatthe applicant ismoving mostofthevacuuming stations fromthesite. Shestatedthatshedoesnotbelieve itwillbea problem withstacking butcouldblock exiting carsandsuggested thattheapplicant address this question. Commissioner Gaultasked whystaff wasrecommending thisbehooked uptoCitysewer and water. Planning Director Darling explained thereasoning behindthisrecommendation wasrelated to CityCode which requires hookupwithdevelopment ifwaterisavailable. Commissioner Gault stated thathewould liketoknow how theypropose todeactivate the automatic washes outside ofthebusiness hoursandasked iftheCitywasproposing thateven themanual stalls havelimitedoperating hours. Planning Director Darlingstatedthat sheassumed thatthemanualand automatic stalls would havethesamehours ofoperation. Farhad Hakim, owner oftheproperty, stated thathecananswer someofthequestions that were raised. Hestated thattheywould liketoaddress thedumpster issue. Sincehehasowned the property, thereareweeksthatthedumpster justsitsempty. Hestated thattheyareproposing to remove thedumpster andhave2rollerbinsontheinside ofthebuildingforpeople tousewhen emptying theircarsand2binsontheoutsideofthebuilding inasimilarlocation tothedumpster. Hestated thattheywouldjusthavethefourbinsemptied every week ratherthanhaving a dumpster onthesite. Heasked ifthetrashenclosure provision could goawayifthey dothatrather thandumpsters. Planning Director Darling statedthatthecoderequires thatalltrashreceptacles oncommercial properties tobescreened. Commissioner Riedel stated thatheisstillabituncomfortable withthepotential stacking issue andnoted thathethinkstheCommission should beplanning forthistobeaverysuccessful business, whichmeanscongestion. Hestated thatheunderstands theapplicant’sreluctance to closeoffoneoftheentrances andsupports thecondition that shouldstacking occur, thentheCity canrequire anentrance tobeclosed. Commissioner Eggenberger statedthathe agrees withCommissioner Riedel andwould alsolike tostipulate thatthevacuum betweentheautomatic baysisremoved. Commissioner Huskins stated thathelikestheideaofcontinuing thestripingsoitisclearly markedandavoid issues. Hestatedthatheisstillunsureabout theCitysewerandwater because ofthecostofthehookup. Commissioner Eggenberger askedifCommissioner Huskins feltthattheapplicant shouldhave theoption tokeepwellwaterifhewants. Commissioner Huskins stated that hejustwasn’tsure whattheCommission should recommend because hefeelsthere wouldbeadvantages tohooking upto City water, butunderstands that thecoststohook uparenotlow. Heasked what otherCommissioners feltaboutthe recommendation fromstaffregarding City water. Commissioner Gaultstated thathehadthesameconcern andnotedthat itwasphrased asa recommendation withinthestaffanalysisandnotarequirement. Hestatedthatifitisnotrequired withintheCode, helikestheideaofgiving theapplicant theoption ofmakingthatdecision. Commissioner Eggenberger askedwhat thereasoning wasbeingthestaffrecommendation for hooking uptoCitywater. Sheexplained thatthehomewasbuiltin1954andisconsideredalegalnon-conforming structure. Shestated thatthislothas28.8% impervious surface which ismorethanthe25% allowed inthe Shoreland District, butnotedthat theShoreland regulations were adopted in1987. TheCity received one e-mailfromtheneighbor at5490Howards Point Road, thatexpressed support for thisrequest. Staffrecommends approval ofthevariance request. Commissioner Riedel askedwhen theimpervious surface ontheproperty increased. Commissioner Huskinsstatedthathewouldlikeclarification from theapplicant onwhen thehome was builtandthe setback because therearediscrepancies between thestaff report andthe information theapplicant submitted. Mr. Graham statedthattheyhavelivedinthehomeforabout 50yearsandaftertheymoved in anoldergentleman hadwalked byandtoldhimthatheused tomilk cowsinthebasement oftheir housebecause thehome hadoriginally beenabarn. Mrs. Graham stated thatwhen theyfirstmoved initwasalittlebungalow whichiswherethe number fromthe1950s camefromwhen they builtitontopofthebarn. Mr. Graham statedthattheydonotknowexactly whentheoriginal house wasbuiltbecausethe foundation ofthehouse isdoublebrick wallwhichwasmostlikelytheoriginal barn. Hestated thattheyhaveaddedonto thehome severaltimesover theyears. Planning Technician Notermann statedthatshe thinksthediscrepancy regarding thesetback is thedifference between themeasurement totheedge oftheroadversus measuring thesetback fromtheproperty line. TheMinnetonka School District recently purchased the property andisproposing toremodel thebuilding andsitetoaccommodate aschooluseforolder, special needsstudents tohelpthemacquirejobandlifeskills totransition intoamoreindependent life. Sheexplained thatthemajorityofthechanges areinterior tothebuildingbutnoted thatthere areafewsitechanges beingproposed. Werespectfully request avariance tothe hardcover allowance on ourproperty for 1.84% or 395.5square feet - ourproposed rain- water runoff mitigation/infiltration system reduces oureffective hardcover to 7.09%, significantly lower than therequisite 25%, asshown onthesupporting documents. After lookingatseveral homesforsaleweconcluded wewouldliketobuildratherthanbuyan existinghomeandthatShorewood'sexpansive lakeviewsandallthecityofferedwereour preferred choice. Inshort, wedecidedtobuildourdream and ultimately "toetag" home in Shorewood onLakeMinnetonka. WeenteredcontracttobuythepropertyinDecember 2020 and became owners inFebruary 2021. Welookforwardtogatherings withfriends, butmostly, with our family.
