The City of Shorewood Municipal Code states "No urban farm animal may be kept in the City of Shorewood until a permit to do so has been approved by the Zoning Administrator and issued by the office of the Building Official. ". Enclosed is a copy of Shorewood's Animal Regulations Code, Chapter 704: Farm and Other Animals, and a Urban Farm Animal Permit application form. Please complete the permit application and return it with the required fee of $50.00 as soon as possible. Your check or money order should be made payable to the City of Shorewood. After submitting your application,. the premises must be inspected. You will be responsible to contact the City at 952-960-7900 to schedule an appointment for the necessary inspection. A permit cannot be issued until the application and inspection process is complete. The attached second draft includes those suggestions, with two exceptions. First, a question was raised as to why include a section on Wild Animals, when there have been no apparent issues. This probably comes under the heading "while we are at it - no harm in having it", however, if the Commission agrees that those provisions need not be included, they are easily deleted. Secondly, a question was raised as to why dogs are not included in this section. Dogs are addressed in their own section (Chapter 701) of the Animal Regulations. While this (primarily licensing) was discussed at a previous meeting, if the Commission wishes to reconsider those rules in light of the ordinance under discuusion, we can revisit the dog regulations. Nor does this draft address "horses and ponies". The Shorewood Code addresses these animals seperately and, since there are still a few properties that keep horses, staff suggests that that ordinance be addressed seperately. In the process of revising the first draft, staff put the ordinance into the Shorewood City Code format, which we feel makes it more readable. Revisions to the first draft are shown in strikeouts(deletions) and in red lettering (additions). Please note that some minor capitalization and punctuation changes have not been highlighted. It should also be noted that, as of this writing, we have not come up with a good definition for "nuisance animal" or provisions that describe when an animal becomes a nuisance. There was some discussion at the last meeting about having some sort of relationship between lot size and type or number of animals that can be kept. Although there is a spacing requirement for shelters (no closer to the property line than it is to the principal dwelling of the animal owner) we have not included a lot size requirement. Since "rural farm animals" are not allowed, this may or may not be an issue. It is also worth mentioning that there is nothing magic about the maximum numbers of chickens, geese, gerbils, etc. included in the draft. Perhaps the presentation tonight will shed some light on that subject. Obviously since you are just receiving this material today, there will be no decisions made this evening. This item will be scheduled for further discussion at the November meeting(s). Hard copies of the material will be available for you at the meeting. If there are state regulations relative to animal clinics and maltreatment of animals, those should simply be included by reference in our code. Since, as always, enforcement is an issue, staff suggests that we solicit the input and comments of the South Lake Minnetonka Police Department before recommending adoption of the new regulations. -bjn- 1
