24-099 Authorizing an Amendment to the Development Agreement and Extension of Plat Approval for Excelsior Woods on Property Located at 20325 Excelsior BoulevardCITY OF SHOREWOOD COUNTY OF HENNEPIN STATE OF MINNESOTA RESOLUTION 24-099 A RESOLUTION AUTHORIZING AN AMENDMENT TO THE DEVELOPMENT AGREEMENT AND EXTENSION OF PLAT APPROVAL FOR EXCELSIOR WOODS ON PROPERTY LOCATED AT 20325 EXCELSIOR BOULEVARD WHEREAS, in 2021, the City of Shorewood approved a final plat and development agreement for Excelsior Woods (the "Project"), located at 20325 Excelsior Boulevard, on property legally described as: Lot 37, Auditor's Subdivision No. 141, Hennepin County, Minnesota; and WHEREAS, the Project is subject to a Development Agreement (the "Agreement"), dated October 12, 2021 and the First Amendment to Development Agreement approved March 11, 2024 which outlines obligations for construction of improvements and the dates when such improvements would be required to be completed; and WHEREAS, Excelsior Woods, LLC. (the "Applicant") has requested an extension of the plat approvals and an amendment to the deadline as it expired in October of 2024 and they only recently secured financing for the project and had no ability to record the plat or construct the improvements prior to the included deadlines. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Shorewood has approved the Second Amendment of the Development Agreement, as follows: 1. The Applicant's request for approval of this Second Amendment to the Development Agreement (Exhibit A) allowing amendments to Paragraphs 9 and 31 is hereby approved, subject to the following: a. Prior to the any activity on the site, the Applicant must record the First and Second Amendments to Development Agreement with the Hennepin County Recorder and fulfill the remainder of the conditions of approval. The plat approval shall be extended for a new expiration date of April 29, 2025, unless the plat is recorded with the Hennepin County Recorder or another extension request is received. All applicable conditions of approval shall be satisfied prior to recording the plat and no activity may begin on the site until the plat and all related documents are recorded. 4. This Resolution authorizes the Mayor and City Clerk to execute the Second Amendment to Development Agreement. Adopted 6vthe City Council ofthe City ofShorewood this 9mday ufDecember, 2024.
