This letter is to transmit the Guidelines and advise you of some of the specific features of the 1980-81 grants program that you should be aware of. Under the 1 1 grant program, your community has been pre - allocated $3,789 to supplement the $3,909 already awarded to it in previous years under contract #7843. The 1980-81 allocation will result in a total of $7,698 in grant funds, which will provide 28% in funding to assist your community in preparing its comprehensive plan and official controls, as required by the Metropolitan Land Planning Act. The grant contract contains an Appendix A which was your community's planning work program and your total cost estimate of $27,500 to complete the required activities. Your community's 1980- 81 allocation is the result of a formula similar to that which has been used in prior years. A general description of the allocation method is provided in the Introduction to the Guidelines on pages 1 and 2. More detail is provided in Section VI, pages 11-14. County - Washington County A. -z- To apply for 1980-81 funds, your community must first complete all the activities contained in Appendix A of the grant agreement that your community has with the Council. This means that first, the plan is to be completed and submitted to the Council for review, if you have not already done so. After a "satisfactory" review (i.e., no changes are required) by the Council, the lanmust be adopted. If the work program contained in Appendix A inc ul des the cost of preparing and adopting official controls, then this work must be completed also and the official controls must be adopted. At the conclusion of all work program activities, the Final Progress Report is to be completed, as is already required by the existing grant contract. Finally, to apply for 1980-81 funds, your community should pass and submit the appropriate resolutions(s) (see Appendix 8 or 9) requesting the funds. If discretionary funds are being requested, the application form (Appendix 10) should be submitted also. This process is described in Section XI (pages 15-17). The disbursement process for 1980-81 funds was recommended to the Council by the Land ise Advisory Committee, a group of 18 citizens and elected officials who represent the interests of all parts of the Metropolitan Area. The final payment will be, in effect, a reimbursement. The program was set up in this manner to serve as an incentive for communities to complete and implement their plans. In addition to the reimbursement feature of the 1980-81 grant program, there are also a number of vetimportant eligibility criteria that each community must sati�in order to receive its funds. IX. ELIGIBILITY FOR 1980-81 GRANTS. Local units shall be eligible to receive 1980-81 entitlement and discretionary funds if all,of__the. /.following conditions are met: ...... RV The local unit meets the due date for submission of its 31-, comprehensive plan under the requirements of the Metropolitan Land Planning Act, which is three years from the date it received its systems statement, or as authorized by an extension of the due date by the Council for the local unit. B. The local unit's comprehensive plan is found to be adequate in content, the plan receives a satisfactory review, and the local unit adopts it within nine months of Council review. C. If after Council review the local unit is required by the Council to make changes to its plan, it makes the changes and adopts the plan within nine months of Council review. D. If the review of the local unit's plan is suspended due to inadequate content, the additional content is submitted and the review is recommenced within six months of suspension. E. If the local unit's Appendix A includes work for the preparation and adoption of official controls, such official controls shall not be in conflict with its comprehensive plan. F. 1980-81 entitlements for local units satisfying conditions A, B, C, D and E above shall be available until December 31, 1981. A local unit may request an extension of its eligibility as provided in Section XIII. If a community fails to satisfy any of the applicable criteria, its eligibility to receive 1980-81 funds will be forfeited, and any funds allocated to it will become part of the discretionary fund. The purpose of this letter is to remind you of some of the major features and provisions of the grant program. According to our records, your community has received $3,909, which is all of its total grant award from the Council. The contract specifies that these funds will be used toward the cost of preparing your official controls. The total estimated cost of these activities which your community indicated on its grant application was $27,500. The grant contract (Section 4) requires three types of progress reports: 1. Midpoint Report - A brief written notice to be sent to the Council indicating that the community is half way through the completion of Appendix B activities. 2. Funded Portion Completion Report - To be submitted when all the activities listed in Appendix B are complete. After the Council reviews this report, the remaining 10% of the grant funds are disbursed. 3. Final Progress Report - To be submitted when the entire comprehensive plan has been completed, satisfactorily reviewed by the Council, and the necessary ordinances have been prepared or updated. The cost of preparing and printing 1,500 copies of one color (black) layout on white or colored paper is $1,250. We have provided an example of a plan summary prepared for Mounds View which reflects this limited color approach. Addition of one additional color would increase the cost from $1,000 to $1,250. The reasoning for this major increase is that existing maps would have to be redone for each color run and the cost of printing setup due to ink wash, plus the number of runs would increase. Again, we have supplied an example of a two color (black and blue on white) which was prepared some time ago for the City of Blaine. Once you have hod a chance to review this information and the examples, please give me a call so that we can discuss further. Also please note that we would appreciate the return of the examples provided as we have only limited quantities to utilize in similar instances. Please be advised that no personal offense was intended and if this was the interpretation, I sincerely apologize. I should explain that both Brad and I were somewhat surprised by the meeting, as we both understood that there was agreement on the plan and only a few items yet required clarification and explanation. The points which were brought forth, however, appeared to put us back at the basics, ground zero. In view of the time and effort involved, this naturally generated a good deal of frustration on our behalf. With the Commission's vote on the plan last evening, we now can hopefully pro- ceed with the additional elements of the Planning Program which must yet be completed. We would hope that the remaining work can be approached in a positive light and our service and assistance to the community can be a positive contribution. The public hearing is required by the provisions in Minnesota Statutes, Section 462.355, to provide opportunity for public comment and testimony to be made on the proposed Comprehensive Plan prior to any action on the "Plan" by the Shorewood Planning Commission. The document which will be discussed at the hearing is Report Number Four - Policy Plan/Development Framework. This report presents issues, objectives, po icies and recommendations pertaining to various elements of the community's planning program. Maps and text relate to land uses for all lands throughout the entire community, plus transportation systems, natural resource preservation and community facilities deemed necessary to serve the community. (The memo is from the Council's attorney to the Executive nirector). There was no cover letter included and the envelope was hand stamped with no return address. Upon review of the memo and its contents, plus the manner in which it was received, it would appear that some- one Internally within the Metropolitan Council is attempting to undermine the organization's power. In view of Shorewood's pending referral of its comprehensive plan to the Metro- politan Council, plus past disputes over sewers and current concern over hawing, I would strongly urge that you review the memorandum in detail. In view of the work which lies ahead, a more active pace should be pursued once summer is over. Yet to be completed are the following items. In this regard, a schedule has been identified as to when work activities should occur. 1 . Comprehensive Plan - Policy Plan/Development Framework - It is understood that the Planning Commission and City Council have completed their "in-house" review of the preliminary document. It is therefore anticipated that a joint meeting of the Council and Commission with Midwest Planning staff in attendence will be held the last week in September. Once the plan is discussed, a summary of revisions will be prepared and a date for public hearing established before the Planning Commission. It is suggested that the public hearing be scheduled for mid -October. This timing will permit the mailing of a special newsletter which outlines the plan to community residents and property owners. Following the hearing and interim approval of the plan by the Commission and City Council, the document will be referred to surrounding cities, the LMCD, the School District, Watershed District and the County for their review and comment. These units have up to six months to respond. It is hoped, however, that their comments can be received much sooner. Following this referral, the plan is submitted to the Metropolitan Council for approval. They have up to four months to take action. 2. Parks Plan - The Park Plan is anticipated for submission to the Park Commission and City Council about mid -September. Following individual review, a pre- sentation of the plan to a joint meeting of the Commission and Council is suggested . If further study of the plan is seen necessary, it is recommended that a procedure be followed similar to that on the Policy Plan/Development Framework where "in-house" sessions are held. It is hoped, however, that the Park Plan could be finalized and approved by the end of October at the latest. 3. Housing Plan - A report submission which is required by the Metropolitan Council is a Community Housing Plan. In view of this fact and the time limitations which are imposed, a draft of the Housing Plan will be available for City Council review in mid -October. The plan is expected to be basic in format and therefore, it is not envisioned to require substantial review time. Finalization and approval is therefore projected for mid to late November. 4. Transportation Plan - A Transportation Plan detailing aspects of this specialized topic will be completed in conjunction with the traffic sign inventory. The plan which must go to the Metropolitan Council is not expected to be contro- versial and therefore require minimal review time. A preliminary report should be available by late October and should be approved by late November or early December. 5. Capital Improvements Program - Based upon preceding work, and in conjunction with the City Engineer and other City staff, a six year capital improvements program is required. This is again a required submission to the Metropolitan Council . A preliminary draft of the document will be ready about 1 December and it is hoped that the Council could have completed its review and approval by late December or early January. b. Ordinances - Implementation ordinances including zoning and subdivision are documents which the Metropolitan Council will not review. From this perspective there is a lower priority on addressing ordinances. As we believe, however, all would agree that there is a critical need to update regulations in order to more adequately address development requests which continue to confront the City. As a consequence, we are suggesting that the ordinances be pursued as soon as possible . a. Subdivision Ordinance - Of the various regulations, a subdivision ordinance tends to be the quickest and easiest ordinance to revise. This is because subdivision regulations are highly regulated by state statute and are primary technical engineering and planning matters. While policy issues are part of such regulations, they are considered minimal . By the end of next week (14 September), preliminary drafts of the ordinance will be submitted for staff review. Completion of the staff's evaluation of the regulations is scheduled for mid -October. Revisions as necessary will be made and the subdivision ordinance will then be given to the Planning Commission. It is hoped that the Commission could complete their review by 1 December and forward it on to the City Council for enactment by 1 January. b. Zoning Ordinance - The zoning ordinance will be a relatively complicated regulation requiring lengthy review time and considerable discussion. A draft, approved by the staff, should be available about 1 January. The Commission and Council review is suggested to be conducted jointly to minimize the time requirement. Completion of study sessions as well as public hearings are suggested by April or May 1980. From the preceding discussion, it can be seen that there remains a considerable effort on the part of the city's officials. This fact is presented more vividly by the attached work schedule diagram. PURPOSE OF AMENDMENT The 1978-79 grants in most cases are being awarded by amending the original grant agreement for 1976-77 funds. The original agreement contained both an Appendix A, which was the community's original grant application for 1976-77 funds, and an Appendix B, which contained the community's selection of the activities which were to be funded by the 1976-77 grant. In order to complete the amendment for 1978-79 funds, Appendix A must be updated or amended, as necessary, and Appendix B will have to be updated to list the additional activities which are to be completed with the additional 1978-79 grant funds. II. HOW TO COMPLETE AMENDMENT Four steps are needed to complete the amendment: A. Ammend Appendices A and B Appendices A and B must be amended as described below. Examples of amendments are attached. 1. Appendix A The original grant application Appendix should be re-evaluated and updated as appropriate. I A, t is conceivable that in some cases no changes rwillabe necessary. However, it is believed that many communities and counties may now have a better idea of the costs involved in preparing their plan than they did a year ago when they submitted the application, and these changes to the cost estimates should be made on Appendix A. Furthermore, the face of the application should also be evaluated and any changes in the local contact person, completion date, other financial assistance (state or federal grant funds to be used toward the comprehensive plan work program) should be shown. 2. _Appendix B On the amended Appendix B, the grant amount has been changed to reflect the additional 1978-79 award. The community or county must list additional activities on Appendix B so that the total "Remaining Cost of Funded Tasks and Activities" is equal to or greater than the new total grant award indicated at the top of the page. For those communities which are receiving funds from other grant Programs such as CETA, HUD 701, CDBG, Critical Areas or FmHA, the portion of this other financial assistance to be used toward the activities listed on Appendix B must be shown Opposite "Less Other Financial Assistance," and subtracted from the "Total Cost of Funded Activities" to get the "Remaining Cost of Tasks and Activities Funded by Local Planning Assistance Grant." (Note that some of these titles have been changed from the old Appendix B to be more descriptive). Finally, the estimated completion date should be revised, if appropriate, to reflect the date that all of the Appendix B activities will be complete. This will provide the Council with an idea of when to expect the funded portion completion report. B. Pass Resolution. After the appendices are revised as necessary, the agreement amendment should be presented to the governing body (city council, town board or county board). The governing • - 2 - • 1,. body must pass a resolution requesting the 1978-79 entitlement , and autho izing a specific local official to execute the amendment. A sample :esolution which could be used is contained in Appendix 4 of the 19 8-79 grant guidelines. 1 v1 C. Execution The local official specified in the above resolution must exec to (sign) the five copies of the agreement amendment under "Gr ntee." Do not date the agreements. The date will be added whe the council executes the amendment. D. Submissio . All five signed (but not dated) copies of the agreement amendment must be returned to the Council within 60 days afte the community or county receives them. If for some reason th time limit cannot be met, the governing body may by resolutioi request a time extension of not more than 60 days. WHEREAS, the Council is required by Minnesota Statutes, Section 473.851, at seq., to administer the Metropolitan Land Planning Act, hereinafter referred to as the "Act," which requires local governmental units within the Metropolitan Area to prepare comprehensive plans; and WHEREAS, the Minnesota Legislature by Laws 1976, Chapter 167, has made available and required the Council to administer a fund to be utilized to assist local governments in the carrying out of required planning in the form of Planning Assistance Grants; and WHEREAS the Council desires to assist the Grantee in carrying out required comprehensive planning in accordance with the Act. NOW THEREFORE, the Council and Grantee agree as follows: 1. A. The Council .shall pay to the Grantee, in accor- dance with the schedule set forth below, a total grant amount of $ 1.857.00 Grant funds ' shall be made available to the Grantee as follows: �9 $ ;.857.00 , immediately upon execution of U I this agreement. $ 0 , upon satisfactory evaluation by the Council of the Funded Portion Completion Report submitted by the Grantee pursuant to Paragraph 4B of this agreement. B. The Grantee agrees that no more than 75% of the total cost of carrying out the work program set forth in Grantee's application for grant assistance, Appendix A, attached hereto and made a part hereof; shall be financed by grant funds. C. The Grantee shall utilize the grant funds to carry out the activities specified in the funded portion of the work program set forth in Appendix B, attached hereto and made a part hereof. D. The Grantee agrees to comply with all provisiof:s of the Metropolitan Council Application Award and Disbursement Guidelines for the Administration of Planning Assistance Grants, hereinafter referred to as the "Guidelines," dated April, 1977, which is hereby incorporated by reference into this agreement and made a part hereof. 2. Authorized use of grant proceeds. It is understood and agreed that the following costs and expenses shall be the only such costs and expenses paid for out of grant proceeds. Costs and expenses to be reimbursed, shall additionally be in substantial accord with specifications contained in the grantee's grant application and other provisions contained herein, but in no event shall the Council reimburse the Grantee for costs and expenses incurred in excess of the total grant amount. The following costs specifically incurred in carrying out the planning activities required by the Act and specified in the funded portion of the work program shall be payable from grant proceeds: A. Compensation of existing staff. B. Compensation of newly hired staff. C. Employment of a qualified consultants) D. Payment of other costs such as overhead, rental of space and equipment, purchase of supplies, printing and publishing. E. Payment of costs incurred in eligible inventory activities undertaken since the date of passage of the Act. Accounting. A. The grantee agrees to establish and maintain accurate and complete accounts and records relating to the receipt and expenditure of any and all grant funds including, but not limited to documentation and information relating to the selection and payment of consultants. B. The above accounts and records of the grantee shall be audited in the same manner as all other accounts and records of the grantee are audited, and may be audited and/or inspected on grantee's premises or otherwise by individuals or organizations designated and authorized by the Council at any time following reasonable notification during the grant period and for a period of three years following final grant payment. 4. Reports. A. Midpoint Report. Grantee shall prepare and deliver a midpoint report by letter notifying the Council that the activities undertaken in connection with grant assistance are half completed. The report shall contain a short description of the utilization of grant funds, remaining funds in the grant'account and projected future planning expenses, and expected% completion dates. • -3- B. Funded Portion Completion Report. Upon completion of the funded portion of the work program, the Grantee shall submit to the Council a funded portion completion report. The Council shall evaluate the report to determine that performance was satisfactory, in that the major tasks to be funded by the grant proceeds were completed. The report shall be of sufficient content and detail to enable the Council to adequately make said evaluation. C. Final Progress Report. The Grantee agrees that upon completion of the total work program, the Grantee will submit to UeCouncil a final progress report which shall be evaluated by the Council to determine that: 1) the planning costs funded by this grant did not exceed 75% of the total cost of the work program; 2) the scope of work was completed; 3) The terms of this agreement were met. 5. General Conditions. A. Duration. The period of grant award specified herein shall commence on the execution of this agreement and remain in force and effect until July 1, 1980. At that date, all allocated grant funds which have not been expended or otherwise com- mited by contract, or are not reasonably expected to be paid out in connection with expenses incurred before that date, shall revert to and become a part of the Council's local government assistance fund, and may be reallocated or expended by the Council for planning assistance to other local governmental units in accordance with the Guidelines. B. Rights Reserved. In the event that the Council finds that there has been a failure to comply with the provisions of this agreement, the Council reserves. the right to take any and all such action as it deems necessary or appropriate to protect the council's interest. C. Changes. The terms of this agreement may be changed or modified by mutual agreement by the parties hereto. Such changes or modifications shall be effective only upon the execution of written amendments signed by authorized representatives of the Council and Grantee. D. The Grantee agrees to comply with all applicable laws relating to non-discrimination, affirmative action, and public purchase, amtractong, and employment. 0 -4- In particular, Grantee agrees not to discriminate against any employee or applicant for employment because of race, -color, religion, sex, or national origin, and to take affirmative action that applicants and employees are treated equally with respect to the following: employment, upgrading, demotion, transfer, recruitment, lay-off, termination, rates of pay, and other forms of compensation, and selection for training. I would like to emphasize to you that we very definitely want staff review. The time situation is, however, getting to be a major factor in terms of our operation. The plan was submitted initially for staff review about the 24th of February, with the hopes that vie would get the document to the Planning Commission by their study meeting towards the end of March. We are now at the end of April, and I am fearful that by the time we go further, it will be the end of May before the document is ready for Commission review. Systems Statement The overall program has been delayed in recent weeks due to disagreements between the City and the Metropolitan Council on the contents of the Shorewood Systems Statement. Resolution on most items has now been achieved. The remaining points of difference, sewage discharge and population counts and estimates, are now being discussed with the Metropolitan Council and progress is apparently being made. We would hope to have this matter concluded in two to three weeks. Following conclusion of this matter, the City can file for its planning grant funding from the Metropolitan Council. 2. Tactics Study As a consequence of the time devoted to the systems statement, the Tactics Study has been briefly delayed. Four interviews remain to be conducted.
