In Accordance with Minnesota Statutes 117.19, notice is
hereby given that on the 23rd day of February, 1981, the Council of
the City of Shorewood, Hennepin County, Minnesota, did by resolution
upon public hearing of that same date after published notice in
accordance with Minnesota Statutes 412.851, vacate a portion of
certain public streets in said City described as follows:

All that part of Garden Road and East Lane as platted in the plat
of "HOLTMERE, LAKE MINNETONKA, MINN.", which lies Southerly and
Southeasterly of a line 50 feet Southerly and Southeasterly of,
measured at a right angle to and parallel with the Southerly and
Southeasterly line of Lot 6, "HOLTMERE, LAKE MINNETONKA, MINN."
DESCRIPTION OF PORTION OF EAST LANE PROPOSED TO BE VACATED
All that part of East Lane as platted in the plat of "HOLTMERE,
LAKE MINNETONKA, MINN.", which lies Southerly of the Easterly
extension of a line 7 feet Southerly of, measured at a right angle
to and parallel with the Northerly line of Lot 1, "HOLTMERE, LAKE
MINNETONKA, MINN.", and Northerly and Easterly of a line drawn
Southeasterly, radial to the Southeasterly line of Lot 1, "HOLT-
MERE, LAKE MINNETONKA, MINN", from the most Southerly corner of
said Lot 1.
DESCRIPTION OF PORTION OF SUNSET LANE PROPOSED TO BE VACATED
The East 350 feet of LAKE WILLIAM ROAD, now known as Sunset Lane,
as platted in the plat of "HOLTMERE, LAKE MINNEIONKA, MINN."
All that part of Sunset lane as platted in Minnetonka Manor which
lies Easterly of a line drawn Northerly from the most Easterly
corner of Lot 2, Minnetonka Manor, said line being at a right
angle to the Southerly line of Sunset Lane.

OF 10 FOOT WIDE STRIP OF GARDEN ROAD
A 10 foot strip of Garden Road as platter' in "HOLTMERE, LAKE
MINNETONKA, MINN.", lying Southeasterly of the Northeasterly
extension of the Northwesterly line of Lot 15, "HOLTMERE, LAKE

WHEREAS, Notice of Hearing on the vacation of a portion of
Garden Road, East Lane and Sunset Lane in the City of Shorewood,
Hennepin County, Minnesota was,published in the Sun Newspaper, Lake
Minnetonka Edition, a legal newspaper in Hennepin County, on the 4th
and llth days of February, 1981; and
TXiEREAS, the Council of the City of Shorewood heard all
interested persons on the question of the vacation at a public
hearing on the 23rd day of February, 1981 at 8:00 o'clock P.M. in the
Council Chambers in the City Hall.
NOW. THEREFORE in accordance -7ith Minnesota Statutes
412.851 be it hereby reso'ivFc by the City Council of the City of
Shorewood that a portion of Garden Road, East Lane and Sunset Lane in
the City hereinafter described is hereby vacated.

PUBLIC HEARING - :00 P.
Haugen explained the vacation as being that part of Garden Road that goes into the
property, Sunset Lane which is the end of the road, and then a road called East Lane
which has never been built.
She then opened the hearing at 8:00 P.M. Eileen Saleme, 4865 Suburban Drive, confirmed
the portion to be closed. Park Commissioner Don Goettelman stated it represented no
problem for the parks. The hearing was closed.
Shaw moved, Leonardo seconded, that the resolution be passed vacating the property.
Motion carried unanimously.
"MEADOW CAY" - INFORMAL DISCUSSION:
— 54 Acres on Smithtown Road, REgistered Land Survey No. 1064, Tract A.
of the 54 acres, 26 acres is buildable and 28 acres is wetlands.
Joe Gorecki presented an outline of the property. He requested advice on installation
of well/water costs. He asked the question: Is the Council going to hold with the
present R-1 Zoning (40,000 square feet) on the development and would they be required
to install a central well system if the development consists of 10 or more homes. He
indicated that he would need a higher density factor to make the project economically
feasible. He asked for further guidance in regards to numbers. Haugen replied that
according to the present policy,if the land will hold over 10 or more homes, then a
central water system must be provided.
The matter was tabled until Mayor Baird could be present.

A report was made by Jack Hendricks of Bergerson-Caswell Company as to the progress of
the Badger Well. Review was made of past problems and an update to current status.
Hendricks indicated that at present the drilling was going as should be to 90' (of
30" pipe and they would be replacing the 30" with 2,V at approximately lw'). They
did not anticipate any further problems. They did not feel they would be able to meet
the March 23rd completion date; they felt April 1 would be the new completion date.
Council suggest they make a request to extend the completion date to April 1st.
Norton indicated that the City is maintaining a daily log as to the progress of the
well.
Concerns were again heard from city resident, Jay Venero, in regards to the workmanship
in certain areas of well construction.

Shaw moved, Rascop seconded, approval of the amended ordinance as written except that
in Paragraph B, 18 years of age is to replace 21 years of age. Upon vote, Leonardo -nay,
Rascop-aye, Haugen-aye, Shaw -aye, Baird -absent, motion carried.
