RESOLUTION NO. 04-091
A RESOLUTION GRANTING A SETBACK VARIANCE
FOR CARL AND ALl ZINN
WHEREAS, Carl and Ali Zinn (Applicants) are the owners of real property
located at 5820 Ridge Road, City of Shore wood, County of Hennepin, State of Minnesota,
legally described in Exhibit A, attached hereto and made a part hereof; and
WHEREAS, the Applicants have applied for a variance to construct a three-car attached
garage on the fron,t of their existing home; and
WHEREAS, the Applicant's request was reviewed by the City Planner, whose
recommendations are included in a memorandum, dated 30 September 2004, a copy of which is
on file at City Hall; and
WHEREAS, after required notice a public hearing was held and the application reviewed
by the Planning Commission at a regular meeting held on 5 October 2004, the minutes of which
meeting are on file at City Hall; and

WHEREAS, the City Council considered the application at its regular meeting on 25
October 2004, at which time the Planner's memorandum and the Planning Commission's
recommendations were reviewed and comments were heard by the Council from the Applicants
and from the City staff; and
NOW, THEREFORE, BE IT RESOLVED by the City Council ofthe City of
Shorewood as follows:
FINDINGS OF FACT
1. The Applicants' property is located in an R-IA/S, Single-Family ResidentiallShoreland
zoning district, which requires a 50-foot setback from a private road and a 75-foot setback from
Christmas Lake.
2. The property contains 62,339 square feet of area and is occupied by the Applicants'
existing home and attached two-car garage.
3. The Applicants propose to convert the existing garage into living area and build a new
attached garage on the front of the house. The new garage would contain 877 square feet of area.
4. The subject property is bounded on its east side by Ridge Road (a private road) and also
. served by a second private road that cuts through the east end of the lot.

5. The property is characterized by dramatic changes is topography, dropping off
significantly to the west, north and east.
6. The property is subject to bluff setback requirements, restricting the buildable area of the
lot.
7. The proposed garage will be 25 feet from the private road
CONCLUSIONS
a. The Applicants have satisfied the criteria for the grant of a variance under the Shorewood
City Code and have established an undue hardship as defined by Minnesota Statutes.
b. Based upon the foregoing, the City Council hereby grants to the Applicants a setback
variance to construct the three-car garage as close as 25 feet from the private road.
c. That the City Administrator/Clerk is hereby authorized and directed to provide a certified
copy of this resolution for filing with the Hennepin County Recorder or Registrar of Titles.
