CITY OF SHOREWOOD RESOLUTION NO. 03- 096 A RESOLUTION RELATING TO THE ACQUISITION OF PROPERTY FOR LAKE LINDEN DRIVE RIGHT -OF - WAY WHEREAS, the City of Shorewood ("City") is a municipal corporation organized under the laws of the State of Minnesota; and WHEREAS, based upon public comment and testimony, the City has determined the need to further public safety, for a pedestrian trail separated from vehicular traffic along Lake Linden Drive; and WHEREAS, the City is the lead agency to assist with the acquisition of easements for the public trail improvements; and WHEREAS, the City has identified the property described in the attached Exhibit A (the "Subject Property") as necessary to complete said public trail improvements; and WHEREAS, the City has undertaken the preparation of an appraisal for property, and will present an agreement to the property owner impacted by the public trail improvements. NOW, THEREFORE, BE IT RESOLVED: 1. The City finds a public purpose in acquiring and improving the Subject Property for the benefit of the public; and 2. In order to ensure no delay in the acquisition of the Subject Property, the City Council of the City directs the City Administrator and City Attorney to undertake the acquisition of the Subject Property for right-of-way purposes attached hereto as Exhibit A in accordance with Minnesota Statutes ~ 117.
