03-078• CITY OF SHOREWOOD RESOLUTION NO. 03-078 A RESOLUTION APPROVING THE CONCEPT PLAN FOR ALDENWOOD WHEREAS, Kawell Mooney and Sawyer, Architects and Builders (the "Applicant") has an interest in real property located in the City of Shorewood, County of Hennepin, legally described as: "Lot 2 and 3, Holtmere Lake Minnetonka, Hennepin County, Minnesota." and WHEREAS, the Applicant has applied to the City for approval of a Concept Plan, attached hereto as Exhibit A, for the construction of a residential planned unit development known as Aldenwood, containing four single-family residential dwelling units on approximately 4.3 acres of land; and WHEREAS, the Applicant's request has been considered by the City Planner, and his recommendations are contained within a staff report, dated 27 August 2003, a copy of which is on file at the Shorewood City Offices; and WHEREAS, after required notice, a public hearing was held and the application was reviewed by the Planning Commission at its regular meeting on 2 September 2003, the minutes of which meeting are on file at City Hall; and • WHEREAS, the Applicant's request for a conditional use permit was considered by the City Council at its regular meeting on 8 September 2003, at which time the Planner's memorandum and the minutes of the Planning Commission were reviewed and comments were heard by the Council from the City Staff; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Shorewood as follows: FINDINGS OF FACT 1. The Property is located at 20585 and 20675 Minnetonka Boulevard. 2. The property consists of two parcels containing a total land area of approximately 4.3 acres. 3. Land use and zoning surrounding the property is as follows: West: single-family residential; zoned R-lA North: single-family residential (in Deephaven); zoned residential East: twinhomes and townhomes; zoned P.U.D. South: single-family residential; zoned R-lA 4. The Applicant proposes to construct four single-family residential dwelling units • as conceptually illustrated on Exhibit A. 5. Required building setbacks at the periphery of the property are 50 feet. • 6. City sewer is available to the property from Minnetonka Boulevard. CONCLUSIONS A. The Applicant's request for approval of a Concept Plan for the Aldenwood P.U.D. is subject to the conditions of approval as set forth below: 1. Straighten the lot line between Lots 2 and 3 and shift it 10 feet to the north. 2. Provide a 50-foot setback around the entire periphery of the Property. The driveway for Lot 1 must be moved at least 40 feet from the right-of-way of Minnetonka Boulevard. 4. The Applicant must incorporate a statement into a declaration of protective covenants, that the road will remain private and the City of Shorewood will not be responsible for its maintenance and upkeep. 5. Grading, drainage, and erosion control are subject to the review and approval of the City Engineer and the Minnehaha Creek Watershed District. 6. Plans for construction of utilities are subject to the review and approval of the City Engineer. • 7. The Applicant shall submit a tree preservation and reforestation plan as part of the development stage plan for the P.U.D. B. City Council approval of the Concept Plan is subject to all applicable standards, regulations, and requirements of the Shorewood City Code, including, but not limited to the following: 1. Section 1201.04, Subd. 1, regarding the procedures for review and approval of conditional use permits; 2, Section 1201.06, Subd. 3, regarding special procedures for the establishment of a P.U.D. by conditional use permit; 3. Section 1201.25, Subd. 6(b)(1), regarding the purpose of concept plan approval. C. Approval of the Concept Plan is not intended, nor does it act to grant approval of a Development Stage Plan or Final Stage Plan which are required pursuant to Section 1201.25, Subd, 5(c) and (d). The application of Kawell Mooney Sawyer for approval of the Concept Plan for the Aldenwood P.U.D. as set forth above is hereby approved. n U • ADOPTED by the City Council of the City of Shorewood this 8th day of September, 2003.
