A RESOLUTION GRANTING A CONDITIONAL USE PERMIT
FOR A SPECIAL HOME OCCUPATION
TO EILLEEN HICKEY
WHEREAS, Eilleen Hickey (Applicant) is the owner of certain real property located at
5320 Shady Hills Circle in the City of Shorewood, County of Hennepin, State of Minnesota,
legally described as:
"Lot 2, Block 3, Shady Hills, Hennepin County, Minnesota"; and
WHEREAS, the Applicant proposes to conduct a group music lessons business in the
lower level of the existing home on the property; and
WHEREAS, the Applicant will teach music to groups ranging in number from three to
eight students on the premises at a given time; and
WHEREAS, the Shorewood Zoning Code requires a conditional use permit for a home
. occupation that serves more than one client or student at a time; and
WHEREAS, the Applicant's request was reviewed by the City Planner, and his
recommendations were duly set forth in a memorandum to the Planning Commission dated 3
August 2003, which memorandum is on file at City Hall; and
WHEREAS, after required notice, a public hearing was held and the application was
reviewed by the Planning Commission at its regular meeting on 5 August 2003, the minutes of
which meeting are on file at City Hall; and
WHEREAS, the Applicant's request for a conditional use permit was considered by the
City Council at its regular meeting on 25 August 2003, at which time the Planner's memorandum
and the minutes of the Planning Commission were reviewed and comments were heard by the
Council from the City Staff.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Shorewood as follows:
FINDINGS OF FACT
1. That the Subject Property is located in an R-1C, Single -Family Residential zoning
• district and contains approximately 19,250 square feet in area.
2. That the proposed home occupation will be conducted within the existing
dwelling.

• 3. That existing parking area on the site will adequately serve the Applicant's clients
visiting the property.

CONCLUSIONS
1.That based upon the foregoing, the City Council hereby grants the Applicant's request
for a conditional use permit for a Special Home Occupation
2. That this approval is subject to the following conditions:
a. That hours of business for the music lessons shall be limited to between 9:30
A.M. and 3:00 P.M., Monday through Friday.
b. There shall be no display of signage related to the group music lessons business.
C. Classes will be scheduled with half-hour intervals in between.
d. That this permit shall be subject to review by the City Council upon receipt by the
City of a substantiated complaint regarding the music lesson business.
In the event the property is sold, any continuation of the music lessons business
are subject to the stipulations included herein.
f. All parking associated with the business shall take place within the existing
driveway on the property. The number of cars in the driveway during business
hours shall be limited to six.
3. That the City Administrator/Clerk is hereby authorized and directed to provide a certified
copy of this Resolution for filing with the Hennepin County Recorder or Registrar of Titles.
