03-036• CITY OF SHOREWOOD RESOLUTION NO. 03-036 A RESOLUTION APPROVING A COMPREHENSIVE PLAN AMENDMENT FOR THE REDEVELOPMENT OF THE CARMICHIEL AUTO SALVAGE PROPERTY WHEREAS, Capestone Builders (Applicant) has an interest in the property (Subject Property) located at 20755 and 20775 Manor Road and, legally described as: "Lot 77 and 78 of Auditor's Subdivision Number 141, Hennepin County, Minnesota and that part of Government Lot 5 lying east of Manor Road"; and WHEREAS, the Applicant proposes to remove an existing nonconforming auto salvage yard and redevelop the property into 12 two-family dwellings (24 units) and one single-family dwelling; and WHEREAS, the Applicant has applied to the City for a Comprehensive Plan amendment, increasing the proposed density on the property from "Minimum Density Residential (0-1 unit per acre)" to "Medium Density Residential (3-6 units per acre)"; and WHEREAS, the Applicant's application was reviewed by the Shorewood Planning Director, whose recommendations have been set forth in memoranda to the Planning Commission, Mayor and City Council, dated 30 January 2003 and 27 February 2003, both of which are on file at the Shorewood City Hall; and WHEREAS, the Applicant's application was reviewed by the Shorewood City Engineer, whose recommendations have been set forth in a memorandum to the Planning Commission, Mayor and City Council, dated 30 January 2003, which memorandum is on file at the Shorewood City Hall; and WHEREAS, a public hearing was held and the Applicant's application was reviewed by the Planning Commission on 4 February 2003, the minutes of which meeting are on file at the Shorewood City Hall; WHEREAS, the Applicant's application was considered by the City Council at its 24 March 2003 meeting at which time the Council reviewed memoranda prepared by City staff, the record of the public hearing and the recommendations of the Planning Commission. The minutes of the meeting are on file at the Shorewood City Hall; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Shorewood, Minnesota as follows: 1. The Shorewood Comprehensive Plan - Proposed Land Use Plan is hereby amended to designate the Subject Property "Low to Medium Density Residential (2-3 units per • acre)". • 2. Paragraph 4 of the Area Plan for Planning District 12 is hereby amended to read: "The auto salvage yard is highlighted as an area of further study, from a land use as well as environmental perspective. Environmental studies of this site have begun, indicating that soils have been contaminated to some degree. Cleanup of this property must be accomplished in accordance with Minnesota Pollution Control Agency standards and monitored by the MNPCA. The "Low to Medium Density Residential" land use designation for this site is dependent upon city services (i.e. municipal water) being extended to the property."
