RESOLUTION NO. 02-067
A RESOLUTION GRANTING SETBACK AND HARDCOVER VARIANCES
TO MARLOW PETERSON
WHEREAS, Marlow Peterson (Applicant) is the owner of real property located at
4985 St. Alban's Bay Road, City of Shorewood, legally described as:
"Lot 14, Block 10, Minnetonka Manor, Hennepin County, Minnesota"; and
WHEREAS, the Applicant has an existing single-family dwelling, which dwelling is
located approximately 43 feet from the rear lot line of the property and one foot from the side
property line; and
WHEREAS, the Applicant has applied for a setback variance to build an attached garage
and extend an addition approximately seven feet into the rear yard setback and eight feet into the
side yard setback; and
WHEREAS, the property is nonconforming with respect to the amount of impervious
surface and the Applicant has requested a variance to increase the hardcover to 39.6 percent; and
WHEREAS, the Applicant's request was reviewed by the City Planner, whose
recommendations are included in a memorandum, dated 10 July 2002, a copy of which is on file at
City Hall; and
WHEREAS, after required notice a public hearing was held and the application reviewed
by the Planning Commission at a regular meeting held on 16 July 2002, the minutes of which
meeting are on file at City Hall; and
WHEREAS, the City Council considered the application at its regular meeting on 22 July
2002, at which time the Planner's memorandum and the Planning Commission's recommendations
were reviewed and comments were heard by the Council from the Applicant and from the City
staff; and
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Shorewood as follows:
FINDINGS OF FACT
1. The subject property is located in an R-1D/S, Single -Family Residential/S zoning
district, which requires a 35-foot setback from the rear lot line and a 10-foot setback from the side
lot line.
2. The subject property is substandard in lot area, having only 8012 square feet of
area where 10,000 square feet is required.
3. The Applicant proposes to construct an attached garage 28 feet from the rear lot
line, requiring a variance of seven feet, and two feet from the side lot line, requiring a variance of
eight feet.
4. The Applicant proposes to build a front porch and deck that would increase the
amount of hardcover on the site to 39.6 percent.
5. The two properties adjoining the Applicant's to the north and east are very near to the
rear lot line of those respective properties.
6. Significant vegetation exists between the Applicant's rear yard and the rear yards of
the two adjoining lots.
CONCLUSIONS
1. The Applicant has satisfied the criteria for the grant of a variance under the
Shorewood City Code and has established an undue hardship as defined by Minnesota Statutes.
2. That based upon the foregoing, the City Council hereby grants to the Applicant
• setback and hardcover variances to build an attached garage behind the existing garage, subject to
the following conditions:
a. Any work done on the front of the house shall be limited to the size of the stoop
and sidewalk that already exist.
3. That the City Administrator/Clerk is hereby authorized and directed to provide a
certified copy of this resolution for filing with the Hennepin County Recorder or Registrar of
Titles.
