CITY OF SHOREWOOD RESOLUTION NO. 00- 120 A RESOLUTION GRANTING A CONDITIONAL USE PERMIT FOR ADDITIONAL ACCESSORY SPACE TO SCOTT YOUNG AND VICKI CALLAHAN WHEREAS, Scott Young and Vicki Callahan (Applicants) are the owners of real property located at 26865 Edgewood Road, in the City of Shorewood, County of Hennepin, legally described as: "Lot 9, Block 1, HERITAGE, Hennepin County, Minnesota"; and WHEREAS, the Applicants have applied to the City for a Conditional Use Permit for the construction of an attached garage, the area of which, when added to the area of existing accessory space on the property, will bring the total area of accessory space on the property up to 1838 square feet; and WHEREAS, the Shorewood City Code requires a Conditional use Permit for the construction of accessory space exceeding 1200 square feet; and WHEREAS, the Applicant's request was reviewed by the City Planner, and his recommendations were duly set forth in a memorandum to the Planning Commission, dated 29 November 2000, which memorandum is on file at City Hall; and WHEREAS, after required notice, a public hearing was held and the application was reviewed by the Planning Commission at their regular meeting on 5 December 2000, the minutes of which meeting are on file at City Hall; and WHEREAS, the Applicant's request was considered by the City Council at their regular meeting on 11 December 2000, at which time the Planner's memorandum and the minutes of the Planning Commission were reviewed and comments were heard by the Council from the City staff. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Shorewood as follows: FINDINGS OF FACT 1. That the subject property is located in a R-1A/S, Single-family Residential/Shoreland zoning district and contains approximately 92,789 square feet of area. 2. That existing accessory buildings located on the property include a detached garage, and three sheds. . . . 3 That the total proposed accessory space (1838 square feet) does not exceed the floor area above grade of the principal structure (3326 square feet). 4. That the total area of accessory space does not exceed 10% of the minimum lot area for the R- 1 A/S zoning district in which it is located (4000 square feet). 5 That the design and materials of the proposed attached garage are consistent with the architectural character of the existing home. 6. That the proposed attached garage complies with all setback requirements for the R-IA/S zoning- district. 7. That the proposed garage will bring the total amount of impervious surface on the site to only 14 percent of the total lot area, whereas the R- lA/S district allows up to 25 percent impervious surface. CONCLUSION A. That the application of Scott Young and Vicki Callahan for a Conditional Use Permit as set forth herein above be and hereby is granted. B. That this approval is subject to the following: 1 That the proposed garage will be used strictly for purposes of a residential nature. 2. That the Applicants are hereby advised that the City Code provides specific regulations relative to home occupations and any future use of the garage for other than allowable residential purposes would have to comply with such regulations. 3. That the Applicants shall make improvements to the existing accessory buildings on the property as described in Exhibit A, attached hereto and made a part hereof. 4. That the Applicants shall, at the time a building permit is issued for the attached garage, submit a letter of credit or cash escrow to guarantee that the improvements described in Exhibit B will be completed within one year of the issuance of said building permit. C. That the Acting City Administrator/Clerk is hereby authorized and directed to provide the Applicants with a certified copy of this Resolution for filing with the Hennepin County Recorder or Registrar of Titles. -2- . . . Scott Young Vicki Callahan 26865 Edgewood Road Shorewood, MN. 55331 12/3/00 In agreement with the recommendations specified by Mr. Brad Nielson, in the 11/29/00 memorandum to the City of Shorewood's Planning Commission, Mayor and City Council, we have attached an estimate for refinishing the outbuildings that are detailed in the "Conditional Use Permit, "File number 405 (00.33). It is our intention to refinish the said outbuildings ourselves. At this time, we anticipate applying for our building permit for the attached garage and home remodeling project mid-January, 2001, for a late winter or early spring construction date, providing building crews can be secured for these dates. Our plan is to enhance the exterior of the outbuildings to be cosmetically consistent with the appearance of the new attached garage and remodeled main house. The outbuilding remodeling will ~onsist of installing residential quality windows in one shed, painting the new or existing siding and re-roofing each building with architectural asphalt shingle roofing materials consistent with the those of the new attached garage and remodeled main house. While the exact stone and siding material has not been chosen at this time, we know the style and quality of the materials that will be used. The estimate below reflects the materials we anticipate using. Structure #1 (10' X 10') This outbuilding is frame constructed with vertically grooved ex1:erior plywood siding and a semi-flat pitched roof. The entry door slides on a tract across the front of the shed from left to right. Since the shed is dedicated to storage and is tightly surrounded by tall arborvitae trees, it is our intention to re-shingle the roof with roll roofing, repaint the existing siding and trim with a paint color that compliments the main remodeled house and not install any windows. . Two Anderson windows will be removed from the main house during remodeimg and installed on each side of this utility outbuilding.
