CITY OF SHOREWOOD RESOLUTION NO. 00-106 A RESOLUTION GRANTING A CONDITIONAL USE PERMIT FOR ADDITIONAL ACCESSORY SPACE TO STEVE POLSTON WHEREAS, Steve Polston (Applicant) is the owners of real property located at 28215 Boulder Circle, in the City of Shorewood, County of Hennepin, legally described as: "Tract C, Registered Land Survey No. 1337, Hennepin County, Minnesota"; and WHEREAS, the Applicant has applied to the City for a Conditional Use Permit for the construction of a dettached garage, the area of which, when added to the area of existing accessory space on the property, will bring the total area of accessory space on the property up to 1644 square feet; and WHEREAS, the Shorewood City Code requires a Conditional use Permit for the construction of accessory space exceeding 1200 square feet; and WHEREAS, the Applicant's request was reviewed by the City Planner, and his recommendations were duly set forth in a memorandum to the Planning Commission dated 1 October 2000, which memorandum is on file at City Hall; and WHEREAS, after required notice, a public hearing was held and the application was reviewed by the Planning Commission at their regular meeting on 3 October 2000, the minutes of which meeting are on file at City Hall; and WHEREAS, the Applicant's request was considered by the City Council at its regular meeting on 23 October 2000, at which time the Planner's memorandum and the minutes of the Planning Commission were reviewed and comments were heard by the Council from the City staff. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Shorewood as follows: FINDINGS OF FACT 1. That the subject property is located in a R-lA/S, Single-family Residential zoning district and contains approximately 81,631 square feet in area. 2. That existing accessory buildings located on the property include an attached garage and a utility shed. 3. That the total proposed accessory space (1644 square feet) does not exceed the floor area above grade of the principal structure (2964 square feet). 1. . . . 4. That the total area of accessory space does not exceed 10% of the minimum lot area for the R- 1 A/S zoning district in which it is located (4000 square feet). 5. That the design and materials of the proposed attached garage are consistent with the architectural character of the existing home. 6. That the proposed attached garage complies with all setback requirements for the R-IA/S zoning- district. 7. That the Applicant owns a separate parcel of land immediately east of his homestead parcel, which parcel is legally described as: "That part of Tract W, lying north of the north lot line of Tract N extended, Registered Land Survey No. 0008, Hennepin County, Minnesota." 8. That the existing amount of impervious surface on the subject property is approximately 34 percent. CONCLUSION A. That the application of Steve Polston for a Conditional Use Permit as set forth herein above be and hereby is granted. B. That this approval is subject to the following: 1 That the proposed garage will be used strictly for purposes of a residential nature. 2 . That the Applicant is hereby advised that the City Code provides specific regulations relative to home occupations and any future use of the garage for other than allowable residential purposes would have to comply with such regulations. 3. That the Applicant shall legally combine the two parcels of land referenced herein within 30 days of the date of this resolution. 4. That the Applicant shall perforate all existing plastic used in landscape beds located throughout the property prior to 15 November 2000. 5. That the Applicant shall submit a landscape plan, providing additional screening on the south and east sides of the proposed garage. The landscape plan shall be subject to review and approval by the Planning Director. If landscaping can not be completed during this growing season, the Applicant shall submit a letter of credit for one and one half times the amount of the estimated cost of the landscaping, as security to guarantee that the work will be done by 30 June 2001. -2- I. . . . ,. That the City Administrator/Clerk is hereby authorized and directed to provide the Applicants with a certified copy of this Resolution for filing with the Hennepin County Recorder or Registrar of Titles.
