WHEREAS, Jack C. Cooper has been Mayor of the Village of
Shorewood for these past two years, and
WHEREAS, for six years prior thereto Jack has served this
village as a member of its Planning Commission,
NOW, THEREFORE, be it resolved by the Village Council of
the Village of Shorewood:
1. That the members of the Village Council of this
Shorewood Village do wish to express their thanks and
appreciation to Jack C. Cooper for his leadership and guidance
as well as the many, many hours of labor devoted to the in-
terests of our village during the years he served as its Mayor
and on its Planning Commission.
2. That during the two years Jack served as Mayor of
Shorewood this village successfully undertook projects which
will benefit each resident of the village for years to come.
3. That Jack's counsel and presence on this body will
be missed by all.

Councilman Cronin offered for adoption, seconded by Councilman Wurfin,
a resolution whereby funds in the amount of $1,500 presently held in
an escrow fund be transferred to the General Fund. Also that the
transfer be retroactive to December 81, 1971.

RESOLVED, that the Village of Shorewood does hereby
appoint the Minnetonka State Bank as the depository for
bond monies received from the sale of sanitary sewer bonds
in the original offering amount of $412,285.00 bearing
date December 1, 1971; that said funds be deposited in
that type of security with Minnetonka State Bank so as
to generate 4.5% interest and be available to make payment
to the contractor when bills are received.

Village of Shorewood, for the following purposes:

RESOLUTION NO. 1 �lt J P
WHEREAS, this Village has heretofore entered into a
contract with Robert J. McNulty Company for the development
of the area known as "Amesbury" property, which contract is
dated December 1, 1971, and
WHEREAS, said contract requires the developer to cons-
truct a water system to serve the project, locate underground
electrical conduits, construct required storm drainage sys-
tem, as well as to construct blacktop public roads serving
that area, all in accordance with the rules, regulations
and ordinances of the Village of Shorewood in the State of
Minnesota, and
WHEREAS, said water system before it is ready for use
will be turned over to this Village for operation and the
sanitary and storm sewer system will be municipally operated,
and it is in the interest of this Village that the same be
fully and completely constructed in accordance with the reg-
ulations of this Village, and
WHEREAS, in order to facilitate such construction as
quickly as possible and with the least amount of cost dup-
lication, the developer has requested this Village to permit
its Village Engineer, Orr - Schelen- Mayeron & Associates, Inc.,
acting through its agents and associates, to be employed by
the developer for the purpose of acting as the project
engineer.
NOW, THEREFORE, be it resolved that
1. It is in the best interests of the Village of
Shorewood that Orr - Schelen- Mayeron & Associates,
Inc., be allowed and permitted to accept employment
as the project engineer for the so- called "Amesbury"
project and continue to represent the interests of
the Village of Shorewood as Village Engineer.
2. The employment will occur only after full disclo-
sure to this Council of the request which has been
made by Robert J. McNulty Company and that the
employment, in the opinion of this Council, will
not result in a conflict of interest but will
provide this Village with public utilities in
accordance with Village ordinances and State
Statutes, as well as facilitate the project cons-
truction.
3. In the event any time in the future it is
determined that a conflict of interest might
arise, the Village Engineer, Orr - Schelen - Mayeron
& Associates, Inc., will be so notified so they
may make the necessary decision to terminate such
conflict.

RESOLVED, that the Honorable Thomas E. Holloran, Mayor of the
Village of Shorewood, be and hereby is designated as the official
representative of the Village of Shorewood in dealing with the
United States Department of Housing and Urban Development in
connection with Comprehensive Sewer Plan, and said Honorable
Thomas E. Holloran is authorized to sign all documents on behalf
of this Village and represent this Village in all official matters with
the said Federal agency.

January 10, 1972, for the construction
of a new bridge to be located so as to connect

rejected.
R E S O L U T I O N
RESOLVED: That the plans and specifications prepared
by the village engineer for repair of the
presently existing bridge located between Enchanted
and Shady Islands be and hereby are approved.
RESOLVED FURTHER That the village clerk together with
the aid and assistance of the village
engineer prepare and cause to be inserted in the official
newspaper and in the construction bulletin an advertise-
ment for bids upon the making of such improvement under
such approved plans and specifications. The advertise-
ment shall be published in the official newspaper and
three times in the construction bulletin and shall
specify the work to be done; shall state that bids
will by received by the clerk until it A.M. on
0 -7 (q , at which time they will be
publically'opened in the Village Clerk's office in the
Village Hall by the village clerk and engineer, will
then be tabulated and will be considered by the council
at its regular meeting on March 27, 1972, or as soon
thereafter as the council can act on the same, and that
no bids will be considered unless sealed and filed
with the clerk and accompanied by a cashier's check
or a bid bond payable to the clerk for 5% of the amount
of the bid.

RESOLUTION NO. IL
RESOLVED, that the Village of Shorewood does desire
to continue the office of local Village Assessor by means
of continued participation in the joint powers agreement
in which the following villages are signators: Shorewood,
Excelsior, Greenwood and Deephaven;
That the aforesaid municipalities having a combined
population of more than 10,000 residents, have employed a
joint village assessor, to -wit: James Russell Carroll,
who has previously been certified as a qualified assessor
by the Hennepin County Assessor's Office;
That the Village of Shorewood, together with the other
municipalities forming the joint assessing group have agreed
and do assume the costs of training the assessor in required
courses and providing all of the necessary equipment and
assistance needed in order to comply with the laws of the
State of Minnesota applicable to assessment of real property.
That this resolution is adopted in conformity with
the requirements set forth in Chapter 31 of the Extra Ses-
sion Laws of 1971.

RESOLUTION NO. 262
WHEREAS, the owner of Lot 2, Timber Lane, has requested a
variance on the side lot requirements and has submitted a
sketch of the location of the structure to be built, together
with a letter signed by a neighbor of Lot 3, stating that
the neighbor agrees the building may encroach upon the side
yard minimum area, provided it is not closer than 65 inches
to the lot line.
RESOLVED, that Kent Nielsen, owner of Lot 2, be granted
his variance to build a building as located upon the sketch
submitted provided the same is not closer than 65 inches
to the side yard line.
RESOLUTION NO. 263
RESOLVED That the barrier eliminating right hand
turns onto Christmas Lake Road from
Hennepin County Highway #82, and left hand turns
from Christmas Lake Road onto Hennepin County
Highway #82 shall be hereby continued indefinitely
and appropriate signs indicating restrictions
maintained as presently located.

FOR BIDS FOR SANITARY LATERAL SEWER
SPECIAL IMPROVEMENT PROJECT
69 -LS -1 (69- LS -1B, 69- LS - 69- LS -1D)
WHEREAS, pursuant to a resolution passed by the council of
the Village of Shorewood on November 24, 1969, the Village En-
gineers, Orr- Schelen- Mayeron & Associates, Inc., have prepared
plans and specifications for the construction of a sanitary
sewer system serving the Village of Shorewood and have presented
such plans and specifications to the council for approval, and
WHEREAS, for engineering reasons and for economic reasons,
the Village Council by terms of said resolution hereinbefore
referred to passed on November 24, 1969, designated and stated
that it was in the best interest of the Village to construct
said lateral sewer system in several stages, and in accordance

with said resolution has heretofore approved as part o f Project
No. 69 -LS -1, a first stage designated as 69 -LS -1 (lst stage),
and a subsequent stage designated as 69- LS -lA, and
WHEREAS, the balance of the project has been designated
for construction purposes under the title of 69- LS -1B, 69- LS -1C,
and 69- LS -1D, and that all of said plans and specifications

RESOLVED that the sanitary sewer line located on the border
between the Village of Shorewood and the Village of Greenwood
serving both the Village of Shorewood and the Village of Green-
wood be constructed by the Village of Shorewood as shown upon

representatives continue to negotiate with representatives
from Greenwood to determine what portion should be paid by
the Village of Greenwood and at the same time to request the
aid of the Metropolitan Council to mediate any problems which

RESOLUTION NO. 273
RESOLVED that this council express its sincere appreciation
to our Senators Hubert Humphrey and Walter Mondale, and our
representatives, Ancher Nelson and Bill Frenzel, for all of
the efforts that each have put forth in assisting this village
in processing our request for a HUD Grant to help finance sewer
construction in the Village of Shorewood.
The Village Council wishes to thank the members of the
Metropolitan Sewer Board and the Metropolitan Council and their
staff, as well as the staff of the HUD offices in Chicago and
St. Paul, for their help and assistance and their complete
cooperation during this lengthy period necessary in order
to complete the project.
A RESOLUTION PROVIDING FOR THE ISSUANCE
AND SALE OF $2,300,000 SEWER IMPROVEMENT
BONDS, SERIES 1972 -A. RESOLUTION NO. 274
BE IT RESOLVED By the Village Council of the Village of
Shorewood, Minnesota, as follows:
1. It is hereby determined that contracts will be let
for 1971 Sewer Improvement and that the work will be
done at a total estimated cost of $2,300,000 and that the village
will assess 100% of the cost against benefited property, in accor-
dance with the preliminary report of the engineer and the council
is authorized to issue bonds without an election pursuant to
Minnesota Statutes, Section 429.091.
2. It is hereby determined that the amount of $2,255,000 is
deemed necessary to defray the expenses incurred and to be
incurred in making said improvement and that the higher rate of
interest required in the present bond market shall be represented
in part by issuance of additional bonds in the amount of $45,000 as
authorized by Minnesota Statutes, Section 475.56. From bond proceeds
$2,255,000 shall be credited to the construction account and any
amount received by the village in excess of $2,255,000 shall be
credited to the bond sinking fund to pay interest. Bidders may
bid not less than $2,255,000 for bonds in amount of $2,300,000.
3. In anticipation of collections of such special assessments
and ad valorem taxes for the general village share of the
cost, the village shall issue and sell $2,300,000 Sewer Improvement
Bonds, Series 1972 -A, bearing date ;June 1,1972, bearing interest at
the rate or rates designated by the successful bidder, payable June
1, 1973, and semi - annually thereafter on December 1 and June 1 in
each year and which bonds mature serially on June 1 in the years
and amounts as follows: $125,000 in 1975 to 1982 inclusive; and
$130,000 in 1983 to 1992 inclusive, all bonds maturing after June
1, 1982, being subject to redemption on said date and any interest
payment date thereafter, in inverse numbrzcal order, at par and
accrued interest and a premium of 12 %.
4. The Village Council shall meet at the Council Chambers at
Minnewashta School, in the Village of Shorewood on Monday,
the 22nd day of May, 1972, at 8 o'clock p.m. for the purpose of
receiving and considering sealed bids for the purchase of said
bonds and the clerk shall cause notice of sale to be given by
publication at least ten days in advance of the date of sale in
the official newspaper of the village and in Commercial West, a
financial paper published in Minneapolis, Minnesota.

WHEREAS, there is not at the present time an outlet for
sewage which might be collected on Shady or Enchanted Islands, and
WHEREAS, the HUD Grant is available only for the contracts
which are ready to be let, which are the contracts for the main-
land of Shorewood, being 69 LS B, C and D, and
WHEREAS, the Village will continue to study the method
of sewering Shady and Enchanted Islands.
NOW THEREFORE, BE IT RESOLVED that the Village of Shore-
wood will not at this time, that is, in 1972 be constructing
sanitary sewer on Enchanted and Shady Islands, and will continue
to look to a method by which the islands will be sewered some-
time in the future.

itself to levy ad valorem taxes, if required for any deficiency,
which taxes may be levied on all of the taxable property in the

All bonds of this issue maturing after June 1, 1982,

4. The bonds shall be prepared under the direction of the
village clerk and shall be executed on behalf of the
village by the signatures of the mayor and the village clerk and
a printed facsimile of the corporate seal of the village shall be
affixed to each thereof, and the interest coupons shall be executed
and authenticated by the printed facsimile signatures of said mayor
and clerk. When the bonds have been so executed and authenticated,
they shall be delivered by the treasurer to the purchaser upon
receipt of the purchase price.

5. The bonds issued hereunder shall be payable from 1971
Sewer Improvement Fund, from the proceeds of special
assessments heretofore levied for said improvement. If any pay-
ment of principal of or interest on said bonds shall become due
when there is not sufficient money in said fund to pay the same,
the treasurer shall pay such principal or interest from the general
fund of the village and such fund shall be reimbursed for such
advances out of proceeds of assessments for said improvement.
6. It is hereby determined that the 'estimated collection
of special assessments will produce at least 5% in
excess of the amount required to pay when due all principal of
and interest on the bonds and no ad valorem tax levy is presently
required.
7. The village clerk shall deliver a copy of this resolu-
tion to the Director of Finance of Hennepin County and
obtain his certificate in accordance with Section 475.63, Minnesota
Statutes,
8. It is hereby determined that the improvement to be financed
by the issuance of bonds hereunder will benefit the entire
village and the village hereby covenants with the holders from time
to time of said bonds as follows:
(a) The village will cause the assessments for
said improvement to be promptly levied so that an
installment will be collectible during 1973 and will
take all steps necessary to assure prompt collection.
(b) The village will keep complete and accurate
books and records showing all receipts and disbuse-
ments in connection with such improvement, the assess-
ments levied therefor and other funds appropriated for
their payment and all collections thereof and disburse-
ments therefrom, moneys on hand and balance of unpaid
assessments.
(c) The village will cause its said books and
records to be audited at least annually by qualified
public accountants and will furnish copies of such
audit reports to any interested person upon request.
9. The Director of Finance of Hennepin County and the officers
of the village.are hereby authorized and directed to
prepare and furnish to the purchaser of said bonds and to the at-
torneys approving same, certified copies of all proceedings and
records of the village relating to said bonds and to the financial
condition and affairs of the village, and such other certificates,
affidavits and transcripts as may be required to show the facts
within their knowledge or as shown by the books and records in
their custody and control, relating to the validity and market-
ability of said bonds, and such instruments., including any hereto-
fore furnished, shall be deemed representations of the village as
to the facts therein stated.

WHEREAS, the Village of Shorewood and United States of
America, Secretary of Housing and Urban Development, have
entered into a Grant Agreement to make a grant to the
Village of Shorewood in the amount not to exceed $1,000,000.00
or 50% of the eligible project cost as determined by the
Government, whichever is lesser, in order to aid in the
financing of a sanitary sewer collection system to serve
the Village of Shorewood and which projects have been designatec
by the Village of Shorewood as Project 69- LS -1B; 69- LS -1C;
and 69- LS -1D, and which project has been designated by HUD
as Project No. WS- MINN -111; the contract hereinbefore re-
ferred to is Contract No. H (502) - 8023, and
WHEREAS, bids for said project have been advertised,
bids accepted, and contracts awarded as follows:
for project 69 -LS -1B $934,477.00
for project 69 -LS -1C $1,426,925.25
for project 69 -LS -1D $1,511,830.00
Total Bid Cost $3,873,232.25

WHEREAS, the Village of Shorewood has advertised for bids
for sale of its bonds, has received bids, and awarded bonds in
the amount of $2,300,000.00 for the purpose of providing part
of the required village financing of said proj6ct,r,.and
WHEREAS, the Village of Shorewood stands ready within the
next 120 days to call for bids on sufficient bonds to finance
the balance of said referred to project.
NOW THEREFORE BE IT RESOLVED:
1. That the receipts from the said $2,300,000.00 bond
sale be and hereby are allocated to and designated for the
sole purpose of applying toward paying for the cost estimate
of the above project.
2. The Village of Shorewood will within the next 120 days
request bids on its bonds in sufficient sum to finance and
pay for the balance of the project and the amount of additional
funds will equal at least $1,575,000.00 and said proceeds will
be allocated solely for the purpose of financing the above
referred to project. That the funds will be available for

the Village of Excelsior and borders upon the property of the
Village of Shorewood, and
WHEREAS, the owners of said property can be serviced with
sanitary sewer by hooking on to a Shorewood line, and
WHEREAS, it is to the benefit of the Village of Shorewood
to cooperate in sewering the property located on Lake Minnetonka,
NOW THEREFORE, BE IT RESOLVED, that Lot 20, Auditor's Sub-
division 313, be and hereby is authorized to hook on to the
Shorewood sewer line provided the owner pay as a hookup charge
the unit assessment this village would levy upon said property
if the same was located in the Village of Shorewood, plus any
other fees and charges levied by other authorized boards or
municipalities.

RESOLVED that a five year street lighting contract with
Northern States Power be and hereby is approved and adopted by this
Village and officers are authorized to execute the same.

WHEREAS, it is necessary and advisable and in the public
interest that the Village of Shorewood, Hennepin County,
Minnesota, establish a sanitary sewer system within the
Village limits of the Village of Shorewood, and
WHEREAS, in order to accomplish such purpose, it is
necessary to acquire the land shown and described in Projects
69- LS -1B, 69- LS -1C, and 69- LS -1D, said projects being located
in the Village offices, being made a part hereof by reference
and hereinafter referred to as Projects B, C, and D, and
WHEREAS, the Village of Shorewood has been advised and
believes the most feasible location for such sanitary sewer
facility is as shown on Projects B, C, and D; and in order to
accomplish the same, it is necessary to obtain Temporary and
Permanent Easements as shown on said Projects B, C and D,
NOW, THEREFORE, be it resolved by the Village Council of
the Village of Shorewood, Minnesota:
That the Village of Shorewood, Minnesota, proceed to acquire
and procure title interests be they temporary or permanent
easements to the land shown in Projects B, C, and D under
its rights of eminent domain and that the village attorneys,
Kelly, Odell & Penberthy, Excelsior, Minnesota, be and hereby
are, instructed and directed to file the necessary petition
and /or petitions therefor and serve the necessary notices there-
for, and to prosecute such action or proceedings to a successful
conclusion or until it is abandoned, dismissed, or terminated
by the Village or by the Court; and that the village attorneys,
the mayor, and the clerk of the village do all things necessary
to be done in connection with the prosecution and successful
conclusion and /or termination of such eminent domain proceedings,
it being understood that, if the village attorneys can obtain
and procure said easements to said lands, or part, thereof:, in
writing by negotiation prior to the commencement of said
proceedings, the lands conveyed by such writings and so obtained
shall not be included in said proceedings.

Councilman Cronin moved adoption: of a resolution, seconded by
Councilman Reutiman, authorizing transfer of $5,000 from Liquor
Fund to Special Assessment and Improvement Fund and $5,000 from
Certificates of Deposit as , .a temporary- transfer from the Liquor
Fund to the General Fund with reimbursement to the Liquor Fund
from the General Fund at a later date.

R E S O L U T I O N
WHEREAS, the Minnesota Pollution Control Agency has issued
regulations for the purpose of implementing the wishes of the
Legislature as set forth in Minnesota Statutes, and
WHEREAS, it is in the interest of the citizens of this State
that the Pollution Control Agency continue its effective work
of controlling and eliminating sources of pollution wherever
possible, and
WHEREAS, in the opinion of this Village Council effective
control and regulation of pollution require the tempering of
the rules in certain instances so as not to create a pollution
problem in another area.
NOW, THEREFORE, BE IT RESOLVED by the Village Council of
the Village of Sh
1. Due to extreme and ever increasing pressure of the
necessity to remove from this village organic matter such as
trees, branches, leaves and the like and with the unavailability
of any economically feasible method of disposing of such enormous,
piles of such debris, the Village Council of the Village of
Shorewood requests the Minnesota Pollution Control
Agency to grant a variance to the present no burning regulations
which will permit the open burning under prescribed regulations
within this village of such organic matter two times per year --
one week in the fall and one week in the spring.
2. The exception to the regulation is urgent and necessary
in order to preserve the intent and to fulfill the purposes of
the present Pollution Control Agency regulations. Failure to
relax the regulations will result in a pollution problem which
this village and its citizens are not prepared to cope with --
that is an absolute mound of undisposable brush, branches,
leaves, trees and other burnable organic matter.
3. This Village Council respectively requests the Minnesota
Pollution Control Agency to consider the problems of local
government and the opposite effect too stringent regulations
might have in the control of pollution.

RESOLVED, that two stop signs be located on Smithtown Road at its
intersection with Eureka so as to require traffic traveling east
and west on Smithtown Road to come to a stop before proceeding
on Smithtown or turning on to Eureka.
RESOLVED FURTHER, that a stop sign be located at the intersection
of Eureka and Smithtown Road so as to require traffic traveling
south on Eureka to come to a, stop before proceeding east and west
on Smithtown Road.
RESOLVED FURTHER, that said stop signs be of the legal height
and of the legal color and placed appropriate distances prior to
the intersection.

WHEREAS, the Village of Shorewood commenced a
proceedings subsequent to a torrens action claiming an interest
in property owned by Albert T. Ridinger and Virginia S.
Ridinger, and
WHEREAS Albert T. Ridinger and Virginia S. Ridinger
have offered to pay Five Thousand ($5,000.00) Dollars to
the Village of Shorewood in full and complete settlement
of said action, and
WHEREAS, in the opinion of the Village Counsel it
is in the best interest of the Village of Shorewood that said
action be settled.
NOVI THEREFORE, be it resolved that the Village of
Shorewood does hereby accept the offer of payment of Five

Resolution approving Joint and
Cooperative Agreement relating
to the Employment of Police
Chief and Police Officers so as
to Provide Full Time Police
Protection for the Villages of
Shorewood, Tonka Bay and Greenwood
WHEREAS, the Village Council has the responsibility for
providing law enforcement within the Village of Shorewood
to enforce the ordinances of the village and laws of the
State of Minnesota, and
WHEREAS, M.S.A. 471.59 provides that villages may enter
into joint and cooperative agreements, and
WHEREAS, the Villages of Greenwood and Tonka Bay would
like to enter into a joint and cooperative agreement for the
creation of a joint police force.
NOW, THEREFORE, BE IT RESOLVED by the Village of
Shorewood:
1. That the Village of Shorewood enter into the joint
and cooperative agreement which is attached hereto and made
a part hereof as Exhibit A.
2. That the Village of Shorewood shall disband its
police force effective the date that the joint police force
referred to above becomes effective, which date is suggested
to be January 1, 1973.
3. That the Mayor and Clerk be instructed to sign all
documents and do all acts necessary to effectuate this
resolution.

WHEREAS, the Village of Shorewood is in the process of
construction of a sanitary sewer to serve the Shorewood Village,
and
WHEREAS, contracts were entered between Shorewood and the
Department of Housing and Urban Development for'the purpose of
assisting and financing the construction in sufficient time to
comply with the regulations of HUD and still allow construction
and assessment to be completed in 1972 within the time schedule
set out in Minnesota Statutes, and
WHEREAS, the Village of Shorewood did pursuant to the
agreement with HUD enter into contracts for the construction of
the sanitary sewer, which contracts anticipated sufficient work
to be completed so as to permit assessment of the project in the
fall of 1972, and
WHEREAS, construction of the sanitary sewer was delayed by
more than thirty (30) days as a result of a construction workers'
strike so as to make it not possible to secure a determination of
costs for the entire project and to prepare an assessment roll in
accordance with the requirements of Minnesota Statutes within the
year 1972,
NOW, THEREFORE, be it resolved by the Village Council that
the Hennepin County Finance Director be requested to grant to the
Village of Shorewood an extension of six (6) weeks'time from
October 10, 1972 to file with the Hennepin County Finance Director
an assessment roll for the Assessment Project No. 5495; that the
additional time is requested because of the delay incurred as a
result of the above mentioned strike and to permit the Village of
Shorewood to comply with the regulations of the Department of Housing
and Urban Development.

BE IT RESOLVED By the Village Council of the Village of
Shorewood, Minnesota, as follows:
1. It is hereby determined that additional contracts have been
let for 1971 sewer improvement and that the cost of work
contracted will result in a total estimated cost of $ . 5A90,90t? q0 °'- and
that the village will assess more than twenty percent of the cost
against benefited property, in accordance with the preliminary report
of the engineer and the council is authorized to issue bonds without
an election pursuant to Minnesota'Statutes, Section 429.091.
2. It is hereby determined that the amount of $1,570,000 is
deemed necessary to defray the additional expenses incurred
and to be incurred in making said improvement and that the higher
rate of interest required in the present bond market shall be
represented in part by issuance of additional bonds in the amount
of $30,000 as authorized by Minnesota Statutes, Section 475.56. From
bond proceeds $1,570,000 shall be credited to the construction account
and any amount received by the village in excess of $1,570,000 shall
ibe credited to the bond sinking fund to pay interest. Bidders may
bid not less than $1,570,0.00 for bonds in amount of $1,600,000.
3. In anticipation of collections of special assessments and
ad valorem taxes for the general village share of the cost,
the village shall issue and sell $1,600,000 Sewer Improvement Bonds
Series 1972 B bearing date November 1, 1972, bearing interest at the
rate or rates designated by the successful bidder, payable November 1,
1973,.and semiannually thereafter on ,lay 1 and November 1 in each
year and which bonds mature serially on November 1 in the years and
amounts as follows: $85,000 in 1975 to 1978, both inclusive; and
$90,000 in 1979 to 1992, both inclusive, all bonds maturing after
November 1, 1982 being subject to redemption on said date and any
interest payment dat thereafter, in inverse numerical order, at par
4. The Village Council shall meet at the Village tbmkk Council Chamber
in the Village of Shorewood on Tuesday, the 24th day
of October, 1972, at �? o'clock P.M. for the purpose of receiving
and considering sealed bids for the purchase of said bonds and the
clerk shall cause notice of sale to be given by publication at
least ten days in advance of the date of sale in the official
newspaper of the village and in Commercial West, a financial paper
published in Minneapolis, Minnesota.

such nursing district and to provide it with adequate funds for its
proper operation

RESOLUTION DECLARING COST TO BE ASSESSED
AND ORDERING PREPARATION OF PROPOSED ASSESSMENT
WHEREAS, contracts have been let for the construction of a
sanitary sewer system to serve the entire Village of Shorewood
with the exception of Spray Island, Shady Island, Enchanted
Island, and other islands within the confines of the Village,
and that said improvement has been designated as Sanitary Sewer
Improvement Project No. 1969LS -1, and which for contract pur-
poses has been broken down as No. 1969LS -1, No. 1969LS -1A,
No. 1969LS -1B, No. 1969LS -1C, and No. 1969LS -D, and includes
the construction of sanitary sewer laterals, lift stations and
appurtenant work, and
WHEREAS, the contract prices and ancillary costs of the
project are available or can be readily determined and the
Village Council has considered means and methods by which
costs of the improvement shall be paid,
NOW, THEREFORE, be it resolved by the Village Council of
the Village of Shorewood:
1. The cost of said improvement is hereby determined to
be $5,890,000.00.
2. The cost of this improvement to be specifically
assessed is hereby declared to be Uc;cc' -- ' to be
spread by the Village Clerk over a period of 20 years at 7%
interest in accordance with the formula developed and approved
by this Village Council and set forth in Appendix "A ", which is
attached hereto and made a part of this resolution.

calculate the proper amount to be specifically assessed for such
improvement against every assessable lot, piece or parcel of

4. The clerk shall upon completion of such proposed
assessment notify the Council thereof.

ordinarily would be passed on to the party desiring to connect
to the sanitary sewer, and
WHEREAS, it is the policy of the Village of Shorewood to
encourage home owners to hook up to the sanitary sewer as soon
as possible so as to alleviate sources of potential pollution,
and
WHEREAS, in order to accomplish the same, cash outlay to
the home owner should be kept to a minimum.
NOW, THEREFORE, BE IT RESOLVED, that SAC charges payable
in 1973 be included as a cost of Sanitary Sewer Project No.
1969 -1, and that as many persons as possible be encouraged to
hook up to the line during said year, and all charges for such
hook -ups levied as SAC charges in 1973 be absorbed by the
Village as part of the cost of said sewer project. Charges
to be absorbed by the Village shall not include those levied
for new construction.
RESOLVED further that said charges for the year 1974 may be absorbed

ASSESSMENT
WHEREAS, By a resolution passed by the Village Council on
October 10, 1972, the Village clerk was directed to prepare
proposed assessment of the cost of the improvement designated
as Sanitary Sewer Improvement Project No. 1969 -1, and assigned
Assessment No. 5495 of the Hennepin County Finance office which
includes construction of sanitary sewer, laterals, lift stations
trunk, and pertinent work, and,
WHEREAS, the Village Clerk has notified the council that
such proposed assessment has been completed and filed in her
office for public inspection.
NOW, THEREFORE, BE IT RESOLVED, by the Village Council of
Shorewood, Minnesota:
1. A hearing shall be held on the third day of November,
1972,•in the Village Council Chambers in the Minnewashta Grade
School in the Village of Shorewood at 7:30 P.M. to pass upon
such proposed assessment, and at such time and place all persons
owning property affected by such improvement shall be given an
opportunity to be heard with reference to such assessment.
2. The Village Clerk is hereby directed to cause a notice
of hearing on the proposed assessment to be published once in
the official newspaper at least two weeks prior to the hearing,
and she shall state in the notice the total cost of the improve-
ment. She shall also cause mailed notice to be given to the
owner of each parcel described in the assessment roll.

VILLAGE OF SHOREWOOD
RESOLUTION ADOPTING ASSESSMENT
WHEREAS, pursuant to proper notice duly given as required
by law, the Village Council has met and heard and passed
upon all objections to the proposed assessment for the
improvement designated as Sanitary Sewer Improvement Project
No. 1969 -1, and has amended such proposed assessment as it
deems just.
NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL
OF THE VILLAGE OF SHOREWOOD, MINNESOTA:
1. Such proposed assessment, as amended, a copy of which
is attached hereto and made a part hereof, is hereby
accepted and shall constitute the special assessment
against the lands named therein, and each tract of
land therein included is hereby found to be benefited
by the proposed improvement in the amount of the
assessment levied against it.
2. Such assessment shall be payable in equal annual in-
stallments extending over a period of twenty (20)
years, the first of the installments to be payable
on or before the first Monday in January, 1973 and
shall bear interest at the rate of G per annum from
the date of the adoption of this assessment resolu-
tion until December 31, 1972. To each subsequent
installment when due shall be added interest for one
year on all unpaid installments.
3. The owner of any property so assessed may, at any time
prior to certification of the assessment to the county
auditor, pay the whole of the assessment on such pro -
perty, with interest accrued to the date of payment,
to the Village treasurer, except that no interest
shall be charged if the entire assessment is paid
prior to November 15, 1972; and he may, at any
thereafter, pay to the Village treasurer the entire
amount of the assessment remaining unpaid, with
e interest accrued to December 31 of the year in which
such payment is made. Such payment must be made
before November 15 or interest will be charged through
December 31 of the next succeeding year.
4._.The clerk shall forthwith transmit a certified
duplicate of this assessment to the county auditor
to be extended on the proper tax lists of the county,
and such assessments shall be collected and paid over
in the same manner as other municipal taxes.
5. Such assessment has been assigned assessment No. 5495
by the Hennepin County Finance office.
Adopted by the Village Council of the Village of Shorewood
this day of November, 1972.

Re: Sanitary Sewer Assessment Information
The sanitary sewer for the Village should be completed not
later than July 15, 1973• As portions of it are ready to accept
service, you may hook up.
The total estimated project cost is $5,900,000.00. Shorewood
in 1972 was one of only three municipalities in the State of Minne-
sota to receive a grant from the United States through the Department
of Housing and Urban Development. This grant is in the amount of
$1,000,000.00 leaving the Village with a net cost of $4,900,000.00.
The Village is in the process of selling additional bonds to
totally fund the project. The bonds sold (which is a method of
borrowing funds) are interest bearing and must be repaid over the
next twenty years.
Repayment will be achieved by adding a special assessment to
your annual tax statement. This assessment bears interest and is
paid along with your annual real estate taxes. This special assess-
ment will commence with your 1973 taxes and may be prepaid at any
time and without interest if paid prior to January, 1973• Prepay-
ment relieves one from the payment of further interest.
The unpleasant task of proposing a formula for payment is upon
us. Your village council proposes the following formula:
Trunk System. That all property owners in the village be
assessed at a rate of one cent per square foot exclusive of roads,
islands, and marsh land. This charge is in payment of the larger
collecting lines, lift stations and force mains which have been
designed to serve the village for years to come. (See Exhibit A)
We estimate that there is within the village approximately
100,000,000 square feet to which the one cent per square foot
would pertain.

reduction in this interest rate if we receive a sufficiently favor-
able rate of interest on our pending bond sale.

November 3, 1972, to further explain the formula and to receive your
views and comments. This meeting will be held at 7:30 P.M. at
Minnewashta School.

Village the cash difference between the value of the units assigned
and the full C value of the same units plus 7% interest prior to
