Resolved: that the Village Clerk- Treasurer be authorized to transfer
after January 6, 1969, the amount of $12,600 to the General Fund.
Further, be it resolved, that as:..-of December 31, 1968, the Park Fund and
Welfare Fund (balance) be transferred to the General Fund to close out
the funds as indicated in the budget adopted September 23, 1968. All
receipts and expenditures for 1969 will then be carried as accounts in
the General Fund. (This will comply with the form prescribed by the
Public Examiner's Office)

RESOLUTION NO. 72
WHEREAS, it is the desire of the Village Council of the
Village of Shorewood to join with other levels of Government
in an effort to secure equal opportunity for all citizens
and to improve human relations.
NOW, THEREFORE, BE IT RESOLVED by the Village Council of the
Village of Shorewood:
1. ! Human Relations Commission is hereby established
for the V`t.11age of Shorewood.
2. The Commission shall consist of 5 members appointed
by the Village Council to serve for a period of one year.
3. The purpose of the Commission shall be to investigate
methods by which this Council may join with other levels
of Government to secure for all citizens equal
opportunities in housing, employment, public accommodations,
public sex-vices and education and to report and to make
its recommendations to the Village Council as to how
this Council may assist in implementing the Minnesota,
State pct against discrimination.

RESOLVED that the Village Council of the Village of Shorewood does
hereby accept the preliminary report for a Sanitary Sewer system for
this Village as prepared and submitted by Orr— Sohelen— Mayeron and
Associates, Inc., Consulting Engineers.
RESOLVED further that the Village of Shorewood does intend to
voluntarily join the Southwest Sanitary Sewer District in order to
provide a permanent outlet outside the Lake Ximetonka basin for its
proposed sewage effluent.
RESOLVED further that Robert W. McDougall is hereby
authorized and direotsd to enter into negotiations with the Southwest
Sanitary Sewer District for the purpose of the Village of Shorewood
ensuring an outlet for the Village's sewage effluent.

RESOLUTION TERifINATING AGREMIEi4T
PROVIDING LIBRARY FACILITY
WHEREAS, the Village of SHOREWOOD and the Village of Excelsior entered
into an agreement dated Jan�v 1. 3966 whereby the Village of
Excelsior agreed to construct and maintain a building at 343 Third Street, Excelsior
for a library, and the Village of Shoreod agreed to pay to the
Village of Excelsior certain sums in consideration therefor; and
WHEREAS, Hennepin County for the purpose of continuing its library service has
offered to purchase or lease the building; and
WHEREAS, it appears advantageous and in the public interest for the Village of
Shorewood, and the Village of Excelsior to cooperate with Hennepin
County in continuing its library service and to terminate the aforesaid agreement
providing -4 library faeility.as no .longer necessary:
NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE OF
1. The agreement providing a.library facility between the Village of
Shorewood and the Village of Excelsior dated 66
is terminated. No further payments shal
be made to the Village of Excelsior thereunder and the Village of
Excelsior shall have the right to sell or rent the library premises
to Hennepin County, Minnesota for library purposes without further
notice or consent.
2. The Village of Excelsior agrees to reimburse the Village of
Shorewood for all payments made under the aforesaid
agreement providing a library facility in accordance with the
following schedule:

Provided, that in the event the Village of Excelsior receives at any
time 20% of the cost of said facility, namely, $ 7585.20 in cash at one
time the then remaining balance of said reimbursement shall be due and payable in

Club together with the rightto construct docks and docking
facilities at said property under, pursuant to and limited
by the following terms and conditions:
(1) This permit shall be effective May 15, 1969,
for a period of 3 years. It shall be subject'A o be extended
however upon application for its extension being filed with
the council. The council may extend the permit for additional
periods upon the applicant showing proof of full compliance
with the terms of this permit.
(2) The applicant shall prior to November 1, 1969,
submit the following to the council for their approval.
a. Plans for the construction of adequate
parking for club members and their guests. The surface of
the parking area shall be covered with a dust resistent material.
The parking area must be designed in such a way as to alleviate
any drainage problems which may result therefrom.
b. Plans to provide an adequate water supply
and private sewer system, which plans shall meet the minimum
requirements for such installations as required by village
ordinances.
C. Plans to provide toilet facilities for club
members and their guests. Separate facilities shall be pro-
vided for each sex.
d. Plans for the construction and layout of
uniform type boat docks and other docking and mooring facilities.
After said plans have been approved by the council, construction
of the above facilities shall be completed within 12 months.
e. Plans for immediate acceptable toilet
facilities and temporary docks shall be submitted for approval
by the council prior to May 15, 1969 and completed and installed
prior to June 1, 1969.
(3) Use of the property shall be limited as follows:
a. Club house and social activities shall
not extend beyond 12:00 A.M.

b. No liquor license, beer license, bottle club
license or food license shall be issued to the
occupants of the property.
C. No more than 30 sailboats shall be docked or
moored at the property at any one time.
d. No more than 2 power boats shall be moored at
the premises overnight.
e. The premises shall not be used for the purposes
of dropping in of sailboats or launching of
power boats or trailers.
f. The premises shall be used for club and social
activities and they shall not be rented out
to other clubs or organization.
g. All structures including existing structures
located on the property shall meet building
codes of the village.
h. No boat house to store sailboats shall be
constructed on the premises.
i. There shall be no off season storage of
boats on the premises.
j. All sailboats docked at the property shall
be kept in boat lifts, except that buoys
may be used for temporary dockage or mooring,
but not beyond the hour of 9:00 P.M.
k. The premises shall be maintained in a neat
and clean manner.
1. The applicant shall forthwith correct any un-
satisfactory condition to the premises which
are called to its attention by the council.
RI. Activities on the premises shall not create a
nuisance or''noise so as to impair the comfort
or convenience of persons residing in the
neighborhood.
n. Violation of state statutes or ordinances
of the Village of Shorewood shall not be
permitted on the premises.
o. Upon approval of the plans specified in 2a
through 2d and the expiration of the period
for completion of the work in accordance with
the plans, the details of each such plan shall
become a condition to this spec?- -use permit.
By motion adopted at the May 12, 1969 meeting, the description
contained in this special use permit was amended to correct a
typographical error. The correct description is shown herein.

WHEREAS, It is proposed to install and construct a water
system, including mains to serve homes and residences in the
Village of Shorewood, and that that system be integrated as
part of a total system, which would include the villages
of Excelsior, Tonka Bay and Greenwood, together with Shorewood,
and such a water system would be paid by means of an assessment
against benefited property to the extent of all, or a portion
of such costs, pursuant to Minnesota Statutes, Section 429.011
to 429.111.
NOW THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE
VILLAGE OF SHOREWOOD, That
The proposed improvement be referred to the Village
Engineer, Bernie Mittelsteadt, of Orr- Schelen- Mayeron &
Associates, Inc., for study and that he is instructed to
report to the Council with all convenient speed, advising
the Council in a preliminary way as to whether the proposed
improvement, being a water system for the Village of Shorewood,
which would be integrated as part of the overall system for
the four villages referred to above, or in conjunction with
one or two of them, is feasible, and as to whether it should
best be made as proposed, or in connection with some other
improvement or in a different manner, and the estimated cost
of the improvement as recommended.

IT IS HEREBY RESOLVED by the Village Council of the
Village of Shorewood that it wishes to express its appreciation
for the cooperation and work which Mr. Elmer J. Peterson,
Hennepin County Surveyor and his staff have rendered to
this village. We wish to thank Mr. Peterson and all of the
employees of the Hennepin County Surveyor's office for the
work which they have done in assisting this village in
establishing and locating the public streets within this
village.
The Village Clerk is instructed to forward a copy of
this resolution to Mr. Elmer J. Peterson and to the Hennepin
County Board so that that board will be informed of the
services which its surveyor has rendered to this community
for which this community and:its council is sincerely
grateful.

A RESOLUTION BY THE VILLAGE OF SHOREWOOD
AGREEING AND CONSENTING TO BECOME A PARTY
TO THE SOUTHWEST SANITARY SEWER DISTRICT.
WHEREAS, the Village of Chanhassen in the County of Carver;
the Villages of Deephaven, Eden Prairie and Minnetonka in the
County of Hennepin; and the Village of Prior Lake and the Town
of Eagle Creek in the County of Scott; all within the State of
Minnesota; by agreement dated the 29th day of March, 1968, are
presently engaged in the construction of a joint sanitary sewage
system pursuant to the provisions of Section 471.59, Minnesota
Statutes, and other applicable statutes, and;
WHEREAS, the Village of Shorewood in the County of Hennepin
and the State of Minnesota is geographically so situated that it
is logical and feasible that the Village of Shorewood become a
party to said agreement heretofore referred to and to become a
full participant in the construction and operation of a joint
sanitary sewage system according to all the terms and conditions
and provisions of the said joint agreement dated the 29th day of
March, 1968, and as supplemented by a resolution requesting and
recommending the terms of financing of Phases I and II of the
Southwest Sanitary Sewer District plant and interceptor system
adopted by the Southwest Sanitary Sewer District Board on the 22nd
day of August, 1968, and concurred in by subsequent resolutions
adopted by each of the aforesaid municipalities parties to said
agreement, and;
WHEREAS, the Village Council of the Village of Shorewood has
considered the matter of becoming a party to the aforesaid joint
powers agreement and deems it feasible and in the public inLeresu
and for the best welfare of the Village of Shorewood to do so,
subject, however, to the understanding that Chapter 449, Laws of
1969, providing for a metropolitan sewage service makes the pro-
visions of Section 3.06 of the resolution requesting and recom-
mending the terms of financing of Phases I and II of the Southwest
Sanitary Sewer District sewage treatment plant and interceptor
system, dated August 22, 1968, providing for a tax levy sufficient
to pick up the proportionate share of that municipality's obliga-
tion from the commencement of the operation of the district, no
longer applicable:
NOW THEREFORE BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE
VILLAGE OF SHOREWOOD that the Village of Shorewood hereby agrees
and consents to become a full party to that certain joint powers
agreement existing between the Villages of Chanhassen, Deephaven,
Eden Prairie, Minnetonka, Prior Lake and the Town of Eagle Creek,
dated March 29, 1968, to the same extent and as though joining in
the execution of said joint powers agreement as an original party
thereto; and the Village of Shorewood hereby accepts and assumes
all the rights and obligations thereunder subject to the afore-
said qualification in respect to the enactment of Chapter 449,
Laws of 1969; and furthermore agrees and concurs in the resolution
requesting and recommending the terms of financing of Phases I and
II of the Southwest Sanitary Sewer District sewage treatment plant
and interceptor system as adopted by the Southwest Sanitary Sewer
District Board on the 22nd day of August, 1968.
BE IT FURTHER RESOLVED that upon the concurring resolutions
adopted by the present members of the Southwest Sanitary Sewer
District, that the participation of the Village of Shorewood
shall commence and be effective as of the first day of December,
1969.

WHEREAS, it is proposed to improve the entire Village of
Shorewood by the construction of a sanitary trunk sewer system
and sanitary lateral sewer system to serve the entire village
including facilities as may be necessary to provide for the
carrying off and treatment of the effluent of said sewer system
which shall include the use of interceptors through the village
limits as well as interceptors from the village limits to the
location of a suitable sewage treatment plant, and to assess
the benefited property for all or a portion of the cost of the
improvement pursuant to Minnesota Statutes, Section 429.011
to 429.111 (Laws 1953, Chapter 398, as amended.
NOW THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL
OF THE VILLAGE OF SHOREWOOD, MINNESOTA:
That the proposed improvement be referred to Orr- Schelen-
Mayeron & Associates, Inc., 1104 Currie Avenue, Minneapolis,
Minnesota, Village Engineers, for study, and that they be
instructed to report to the council with all convenient speed,
advising the council in a preliminary way as to whether the
proposed improvement is feasible and as to whether and how it
should best be made, or whether it should be made in connection
with some other improvement, and the estimated cost of the
improvement as recommended.

WHEREAS, the VILLAGE OF SHOREWOOD, Minnesota, and ORR-
SCHELEN-MAYERON & ASSOCIATES, INC. have by agreement made and
entered into the 28th day of June, 1966, set out the terms
and conditions whereby the VILLAGE OF SHOREWOOD has employed
ORR-SCHELEN-MAYERON & ASSOCIATES, INC. to provide the VILLAGE
OF SHOREWOOD with professional engineering services, and
WHEREAS, the parties to said agreement deem it necessary
that the agreement be amended as hereinafter set forth,
NOW, THEREFORE, In consideration of the premises and
mutual covenants of the parties hereto,
IT IS AGREED By and between the parties hereto that the
said agreement for engineering services between the VILLAGE OF
SHOREWOOD, Minnesota, and ORR-SCHELEN-! & ASSOCIATES, INC.
relating to sanitary sewer facilities be and is hereby amended
as follows:
1. That ARTICLE X be and hereby is amended by the addition of tb
following subdivision:

RESOLUTION APPROVING THE PRELIMINARY ENGINEERING
REPORT AND CALLING A PUBLIC HEARING ON SANITARY
SEWER IMPROVEMENT NO. 1969 -1
BE IT RESOLVED By the Village Council of the Village of
Shorewood, Minnesota, as follows:
1. Pursuant to a resolution of this Council adopted July
28 1969, a preliminary engineering report has been prepared by
Orr - Schelen - Mayeron & Associates, Inc., and has been submitted
to this Council advising this Council as to the feasibility and
estimated cost of construction of a sanitary sewer system for
this Village.
2. That said preliminary engineering report is hereby
approved and ordered filed.
3. That said improvement shall be hereafter designated as
Sanitary Sewer Improvement No. 1969 -1.
4. That this Council shall consider the improvement in
accordance with the report and the assessment of all property
within this Village for all or a portion of the cost of the
improvement pursuant to Minnesota Statutes, Sections 429.011
to 429.111 as amended, at an estimated total cost of the
improvement of $7,387,000.00.
5. That this-,Council shall meet on the 24th day of November
1969, in the Council Chambers of the Village of Shorewood, located
in the Minnewashta Grade School at 7:30 p.m. for the purpose of
holding a public hearing on such proposed improvement, and the
clerk is hereby authorized and directed to give mailed -and
published notice of such hearing as required by law, which notice
shall be in substantially the following form:

Notice is hereby given that the Village Council of the
Village of Shorewood will meet in the Council Chambers of the

A RESOLUTION ACCEPTING THE VILLAGE OF
TONKA BAY AS A PARTY TO A JOINT POWERS
AGREEMENT DATED MARCH 29, 1968.
WHEREAS, the Village of Chanhassen in the County of Carver,
and the Villages of Deephaven, Eden Prairie, Greenwood, Shorewood,
and the City of Minnetonka in the County of Hennepin, and the
Village of Prior Lake and the Town of Eagle Creek in the County
of Scott, all in the State of Minnesota, are parties to an agree-
ment dated the 29th day of March, 1968, providing for the con-
struction and operation of a joint sanitary sewage system pursuant
to the provisions of Section 471.59, Minnesota Statutes, and other
applicable statutes, and;
WHEREAS, the Village of Tonka Bay in the County of Hennepin
and the State of Minnesota is geographically so situated that it
is logical. and feasible that the Village of Tonka Bay become a
party to said agreement heretofore referred to, and;
WHEREAS, the Village Council of the Village of Tonka Bay did
adopt a resolution dated the 25th day of November, 1969, agreeing
and consenting to become a full party to that certain agreement
heretofore referred to, to become effective on December 1, 1969,
and to assume all the rights and obligations thereunder, together
with the obligations incurred as a result of the resolution re-
questing and recommending the terms of financing of Phases I and
II of the Southwest Sanitary Sewer District sewage treatment plant
and interceptor system adopted by the Southwest Sanitary Sewer
District Board on the 22nd day of August, 1968, and concurred in
by all of the aforesaid municipalities parties to said agreement,
subject to the only qualification that it is agreed that Chapter
449, Laws of 1969, establishing a metropolitan sewer service board,
makes certain provisions of Section 3.06 of the resolution request-
ing and recommending the terms of financing as heretofore referred
to no .longer applicable, and;
WHEREAS, the Village Council of the Village of Shorewood deems
it proper and in the public interest to accept the Village of Tonka
Bay as a party to the joint powers agreement heretofore referred to;
NOW THEREFORE BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE
VILLAGE OF SHOREWOOD that the Village of Tonka Bay be and hereby is
accepted by the Village of Shorewood as a full party to that certain
joint powers agreement dated March 29, 1968, providing for the con-
struction and operation of a joint sanitary sewage system to the same
extent as though one of the original signatories thereto to be effective
as of December 1, 1969.

the year 1970, or as long as the Village of Greenwood
is in existence during said year, be and hereby is

to execute the same in behal of the Village of
Shorewood.
RESOLUTION NO. 69 -17
RESOLUTION TEMINATING AGREEMENT PROVIDING LIBRARY FACILITY
WHEREAS, the Village of Excelsior has received Resolutions from the
Villages of Deephaven, Greenwood, Shorewood and Tonka Bay agreeing to terminate
the Agreement dated January 1, 1966, whereby the Village of Excelsior agreed to
construct and maintain a building at 343 Third Street, Excelsior, for a library;
and
WHEREAS, it appears advantageous and in the public interest of the Village
of Excelsior to cooperate with Hennepin County in continuing its library service
by leasing the library building to Hennepin County and to terminate the afore -
said'^;re ment providing a library facility as no longer necessary,
NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE OF EXCELSIOR, MINNESOTA:
1. The agreement providing a library facility between the
Villages of Deephaven, Greenwood, Shorewood and Tonka
Bay dated January 1, 1966, is terminated. No further
payments shall be made to the Village of Excelsior under
this agreement and the Village of Excelsior shall have
the right to sell or rent the library premises to
Hennepin County, 14innesota for library purposes without
further notice or consent.
2. The Village of Excelsior agrees to reimburse the Villages
of Deephaven, Greenwood, Shorewood and Tonka Bay in ac-
cordance with the schedule shown on the attached Resolu-
tions of each of the said villages, provided that in the
event the Village of Excelsior receives at any time twenty
percent (20 %) of the cost of said facility, namely $7585.20
in cash at one time the then remaining balance of said re-
imbursement shall be due and payable in full.
