RESOLUTION NO. J~-85_
A RESOLUTION APPROVING A PUBLIC RIGHT-OF-WAY PERMIT
FOR WHITLEY MOTT
WHEREAS, Whitley Mott (Applicant) is the owner of real property located at 24890
Yellowstone Trail in the City of Shorewood, County of Hennepin, State of Minnesota, legally
described as:
"Lot 2, Block 1, Mott Addition"; and
WHEREAS, the Applicant's property abuts Sam's Way, a public street right-of-way in
which the street has not been constructed; and
WHEREAS, the Applicant proposes to locate his driveway and private sewer service in
the right-of-way of Sam's Way; and
WHEREAS, the City does not intend to maintain the driveway, right-of-way or private
sewer line.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Shorewood as follows:
1. That the Applicant is granted approval of a permit to use the public right-of-way for
private purposes subject to the following:
a. The Applicant, his successors and assigns are responsible for the
maintenance and upkeep of the right-of-way of Sam's Way, the private driveway and the
private sewer line located in the right-of-way.
b. The Applicant, his successors and assigns shall be responsible for the
disconnection of the private sewer line from the City system at such time as gravity sewer
is available to the site.
c. The Applicant must submit plans for construction of the private sewer line
for approval by the City Engineer.
2. That the City Clerk furnish the Applicant with a certified copy of this resolution for
recording purposes.
3 . That the Applicant record this resolution with the Hennepin County Recorder or
Registrar of Titles within thirty (30) days of the date of the certification of this resolution.
ADOPTED BY THE CITY COUNCIL OF THE CITY OF SHOREWOOD this 11th
day of September, 1995.
