RESOLUTION NO. 2.5-8L
A RESOLUTION GRANTING A SETBACK VARIANCE
TO JIM KANTOLA
WHEREAS, Jim Kantola (Applicant) is the owner of real property located at 20845
Radisson Road, in the City of Shorewood, County of Hennepin, legally described as:
"Tracts A, B, D and E, Registered Land Survey No. 175; and Lot 14, Auditor's
Subdivision No. 175, Hennepin County, Minnesota."
WHEREAS, the Applicant has applied to the City for a setback variance to construct an
attached garage and a setback variance to rebuild a nonconforming deck; and
WHEREAS, the Applicant's request was reviewed by the City Planner, and his
recommendations were duly set forth in a memorandum to the Planning Commission dated
19 July 1995, which memorandum is on file at City Hall; and
WHEREAS, after required notice, a public hearing was held and the application was
reviewed by the Planning Commission at their regular meeting on 1 August 1995, the minutes of
which meeting are on file at City Hall; and
WHEREAS, the Applicant's request was considered by the City Council at their regular
meeting on 28 August 1995, at which time the Planner's memorandum and the minutes of the
Planning Commission were reviewed and comments were heard by the Council from the City
staff.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Shorewood as follows:
FINDINGS OF FACT
1 . That the configuration of the lot is such that portions of the lot lie on both sides of
the traveled surface of Radisson Road.
2. That Radisson Road has no right-of-way adjacent to the Applicant's lot.
3 . That the existing house on the property is located 10 feet from the paved surface of
Radisson. Road.
4. That the garage proposed to be built by the Applicant will be 31 feet from the paved
surface of Radisson Road, requiring a variance of 19 feet.
5. That the site is characterized by a dramatic drop in topography from the north end of
the lot to the shoreline of Christmas Lake, and that the steepest drop occurs at the 50-foot setback
line.
6. That building a garage at or behind the 50-foot setback line would result in
significant site alteration and unnecessary loss of trees.
7 . That the proposed garage will be further back from the street than many of the
structures on Radisson Road.

That the deck on the rear of the house is currently eight feet too close to the side lot
line.
9. That the deck can be rebuilt in compliance with the lO-foot side yard setback
requirement.
CONCLUSIONS
A. The Applicant has failed to satisfy the criteria for the grant of a variance to rebuild the deck
under Section 1201.05 of the Shorewood City Code and has not established an undue hardship as
defined by Minnesota Statutes Section 462.375, Subd. 6(2).
B. That based on the foregoing the City Council hereby denies the Applicant's request for a
variance to rebuild the deck two feet from the side lot line.
C. That the Applicant has satisfied the criteria for the grant of a variance to build a garage
under Section 1201.05 of the Shorewood City Code and has established an undue hardship as
defined by Minnesota Statutes Section 462.375, Subd. 6(2).
D. That based upon the foregoing, the City Council hereby grants the Applicant's request for a
variance to construct an attached garage up to 24' x 24', which will be 31 feet from the street right-
of-way, subject to the Applicant maintaining an end-loading design for the garage.
E. That the City Clerk is hereby authorized and directed to provide the Applicant with a
certified copy of this Resolution for filing with the Hennepin County Recorder or Registrar of
Titles.
ADOPTED BY THE CITY COUNCIL OF THE CITY OF SHOREWOOD this 11th
day of September, 1995.
