YIJEREAS. the final plat of M:Kinley Place at Near l\tnmtain Srd
Addi tion has been subnitted in the marmer required for the platting of
land under Shorewood Ci ty Ordinances and under Olapter 462 of Minnesota
Statutes. and all proceedings have been duly had thereunder; and
\\HEREAS. said plat is consistent wi th the Shorewood
Onprehensive Plan and the regulat ions and requirements of the laws of
the State of Minnesota and Ordinances of the City of Shorewood.
KW. 'IHEREFCIm. BE IT RESOLVED. by the City Chuncil of the
City of Shorewood:
1. That the plat of M:Kinley Place at Near l\buntain Srd
Addition is hereby approved.

2. That said approval is specifically conditioned upon the
temlS and condi t ions contained in the Developnent Agreement for
~inley Place at Near l\buntain Srd Addi t ion. attached hereto and made
a part hereof.
S. That the Mayor and City Clerk are hereby authori zed to
execute the Cert i ficate of Approval aDd Developnent Agreement on behal f
of the City Chuncil.
4. That this final plat shall be filed and recorded within. SO
days of the Developer's receipt of this resolution.
BE IT FUnHER REf:DLVED. that such execution of the Cert i ficate
upon said plat by the Mayor and City Clerk shall be conclusive showing
a proper call>l iance therewi th by the subdivider and Ci ty officials and
shall entitle such plat to be placed on record forthwith without
further fonnality, all in call>liance with Minnesota Statutes and
Ordinances of the City.

'!HIS AGREFlV.IENl', made this Ilc!ldaY of , 1987, by and
between the CIlY OF SlIEm\{ffi, a Minnesota nnmicipal corpo ation, hereinafter
referred to as the "City" and IllNIXlmN HIm. CINS'llU.JCI'ICN ~., hereinafter
referred to as the ''Developer''.
\\HEREAS, Developer has previously entered into a Developnent
Agreement with the City dated April 28,1986, for the developnent known as
Near l\buntain; and
\\HEREAS, Developer has previously filed with the City the first,
second and third final plats for said developnent; and
\\HEREAS, Developer now desires to file the fourth final plat for
said developnent, which is the plat of ~inley Place at Near l\buntain 3rd
Addition, which is a replat of the lot orignally platted as Outlot A,
Sweetwater at Near l\buntain, and which replat is attached hereto and made a
part hereof as Exhibit A.
Ml\T, 'lHEREFmE, in consideration of the foregoing premises and
acceptance by the Ci ty of the final plat of ~inley Place at Near l\buntain
3rd Addition, the City and Developer agree as follows:
1. The Developer shall subnit an Agreement Providing Alternative
Security for Subdivision Improvements for the property platted as
MCKinley Place at Near l\buntain 3rd Addition, for review and
approval by the City prior to recording of the plat.
2. Developer shall provide a copy of its proposed Declarat ion of
Covenants, Conditions, Restrictions, and Reservations, for
MCKinley Place at Near l\buntain 3rd Addition, for review and
approval by the City prior to recording of the plat. Said
Declaration shall be recorded contemporaneously with the plat and
proof of filing thereof furnished to the City.
3. Developer acknowledges that as a newly platted developnent,
additional sums will be assessed against the property as
equalization charges pursuant to Shorewood Ordinance No. 80.

Developer and the City agree that all such charges are to be
added to the balance remaining on the original assessments and
spread over the subject property. Installments shall be paid
annually for the remainder of the tenn of the original
assessments, together with interest on the balance remaining, at
the rate of six and one-half percent (6.5%) per annum. A
schedule of such charges is set forth in Exhibit B, attached
hereto and made a part hereof.
4. All other applicable provisions of the Near l\bunts:dn
Developnent Agreement executed by the parties on April2B, 1986,
are hereby made a part of this Agreement and are fully
incorporated herein by reference.
